In East Jerusalem, Israeli forces prevent Palestinians from reaching the Haram al-Sharif compound. In Gaza, Israeli forces bomb Rafah, Khan Yunis, Jabalia refugee camp, Beit Lahiya, and Nuseirat refugee camp, killing at least 183 people. Israeli forces also open fire at Palestinians fleeing from Khan Yunis to Rafah and fire tank shells at al-Amal Hospital. The Nasser Hospital in Khan Yunis suffers a complete electricity blackout as it is besieged by Israeli forces for the fifth day in a row. The ICJ rules that there is a basis to further investigate the South African genocide case against Israel and that the ICJ has jurisdiction to hear the case. The court issues 6 provisional measures: 1) Israel must take all possible measures to prevent acts as outlined in Article 2 of the Genocide Convention, including not killing members of a particular group [Palestinians], not causing physical or psychological harm to members of that group, not inflicting living conditions which are calculated to bring about the end of the existence of a people, and not carrying out acts to precent the births within the group. 2) Israel must ensure its military does not carry out any of the actions outlined in measure 1. 3) Israel must prevent and punish incitement to commit genocide. 4) Israel must ensure the delivery of basic services and essential humanitarian aid. 5) Israel must prevent the destruction of evidence of war crimes and allow fact-finding missions access. 6) Israel must submit a report on all steps taken to abide by the measures within 1 month. 4 of the orders are approved by 15 of the 17 judges, while 2 of the measures are approved by 16 of the 17 judges. The only judge to vote against all measures is Judge Julia Sebutinde of Uganda. Aharon Barak, the judge representing Israel, votes for measures 3 and 4. The measures issued by the court fall short of South Africa’s demand for a ceasefire. Hamas welcomes the ICJ orders and calls on the international community to force Israel to implement the decisions. PA ambassador to the UN Riyad Mansour calls the measures against Israel “historic.” South Africa calls the ruling a “decisive victory.” Israeli prime minister Benjamin Netanyahu instructs his ministers not to comment on the ICJ decision and calls the ruling “outrageous.” The U.S. State Department says the ICJ did not “make a finding about genocide” despite the court specifically saying that it is continuing its trial of Israel on charges of genocide. U.S. president Joe Biden says in a speech that he is “quietly working with the Israeli government to get them to reduce and significantly get out of Gaza.” Secretary of State Antony Blinken meets with Saudi crown prince Mohammed bin Salman in al-Ula, saying after the meeting that bin Salman has expressed “clear interest” in trying to normalize ties with Israel on the condition that Israel ends its war on Gaza and agrees to take practical steps to establish a Palestinian state. In a statement after the meeting, bin Salman says he stressed the need to end the Israeli attacks on Gaza and for a path toward peace. Blinken also meets with UAE president Mohamed bin Zayed Al Nahyan in Abu Dhabi. The Israeli Supreme Court rules that international media cannot have access to Gaza via Israel without permission and without being escorted by the Israeli military, saying access could endanger Israeli forces. In Gaza, Israeli forces stormed al-Shifa Hospital, assaulting and detaining Palestinians seeking shelter there, holding them blindfolded and naked outside the hospital, demolishing walls, and opening fire inside the hospital. Israel also arrested al-Shifa’s only electric generator mechanic and the technician working on the oxygen stations. 50 people were killed in an airstrike on a mosque in al-Sabrah and 25 were killed in an Israeli airstrike on the Sheikh Radwan neighborhood of Gaza City. The number of fatalities was likely much higher since the Gaza Ministry of Health was unable to communicate with hospitals and civil defense members in northern Gaza. Jordan said Israel had injured 7 of its staff members at the Jordanian field hospital. Israel also blew up Gaza’s parliament building and hit the last functioning flour mill in Gaza in Deir al-Balah with an airstrike. Israel also dropped leaflets telling residents of al-Qarara, Khuza’a, Bani Suheila, and Abasan in southern Gaza to evacuate immediately. 2 Israeli soldiers were killed. In the UK parliament 56 out of 198 Labour Party members broke with the party line to vote in support of a ceasefire. The motion, which failed 293-125, was put forward by the Scottish National Party. The Israeli security cabinet decided to deduct funds from the PA tax revenue that is used in Gaza, in addition to the funds it deducts from the PA that are said to be used for paying stipends to the families of Palestinian prisoners and Palestinians killed by Israel. The cabinet also decided to no longer allow Palestinians from Gaza to work in Israel and to send those held in the Israeli internment camps back to Gaza. Interior Minister Moshe Arbel approved a memorandum making it easier for Israel to revoke the citizenship for people accused of supporting, inciting, or identifying with a terrorist organization. Arbel also transferred $50.4 million to 67 Palestinian municipalities in Israel after the funds had been frozen by Finance Minister Bezalel Smotrich since July. Israeli military chief of staff Herzl Halevi said Israel would allow fuel to enter Gaza to keep hospitals running. However, Prime Minister Netanyahu’s office rejected the move. The U.S. House of Representatives passed a bill that would provide $14.3 billion in aid to Israel and deduct the same amount from the Internal Revenue Service (IRS). The bill was unlikely to pass in the Senate due to the deduction in funds from the IRS and the lack of funding for Ukraine. Senator Chris Murphy (D-CT) said the civilian deaths in Gaza were unacceptable and called on Israel to “immediately reconsider its strategy and shift to a more deliberate and proportionate counterterrorism campaign.” Senator Dick Durbin (D-IL) called for a ceasefire, among the U.S. senators to do so. U.S. secretary of state Antony Blinken said President Abbas and “virtually every other leader that I have talked to in the region” warned against the idea of transferring Palestinians from Gaza to the Sinai Peninsula. Blinken also met with Egyptian president Abdel Fattah el-Sisi, announcing the Rafah crossing was open. It was unclear if it was only open for aid or for travel; reporting suggested it was not open for either. El-Sisi criticized Blinken for his remarks in Israel earlier in the week, when Blinken said he came to Israel “as a Jew,” and el-Sisi said the Israeli attacks on Gaza go beyond self-defense and amount to collective punishment. Human Rights Watch, Amnesty International, and the Euro-Med Human Rights Monitor confirmed earlier reports that Israel had used white phosphorus munitions to attack Gaza and Lebanon. U.S. president Joe Biden met Israeli prime minister Benjamin Netanyahu on the sidelines of the annual UN General Assembly meeting in New York. According to a White House statement, Biden cautioned Netanyahu about further advancing his judicial overhaul without gaining a broad consensus and invited Netanyahu to the White House later in 2023. Israeli officials said the Biden-Netanyahu conversation mostly concerned the Israeli-Saudi normalization deal. U.S. national security council coordinator for the Middle East and North Africa Brett McGurk and presidential envoy on energy security Amos Hochstein, who have been leading the U.S. negotiations with Saudi Arabia on normalization, also attended the meeting. It was the first time Biden and Netanyahu met since Netanyahu took office in December 2022. According to an Israeli official, Netanyahu told Biden that there can be a Palestinian component to the deal but the Palestinians cannot have veto power. Saudi Arabian crown prince Mohammed bin Salman told Fox News in an interview that normalization with Israel is moving closer every day. Israeli finance minister Bezalel Smotrich said the Israeli government will start deducting additional funds from the PA taxes Israel collects to pay for the PA’s debt to the Israel Electric Corp (IEC). A spokesperson for Smotrich said the amount would be $5.2 million to $7.8 million per month depending on how much energy the PA purchases from the IEC. PLO secretary-general Hussein al-Sheikh, head of PA intelligence Majed Faraj, and PA president Mahmoud Abbas’ foreign policy advisor Majdi Khaldi arrived in Riyadh for meetings with Saudi and U.S. officials, including National Security Council Coordinator for the Middle East and North Africa Brett McGurk, to discuss the Palestinian aspect of the potential Saudi-Israeli normalization deal. Khaldi told the New York Times that the PA demand is the implementation of the Arab Peace Initiative. U.S. president Joe Biden nominated former Treasury Secretary Jack Lew to be the next U.S. ambassador to Israel. Lew will have to be confirmed by the U.S. Senate to be instated. Lew sits on the U.S. board of directors for the National Library of Israel, a partly Israeli state-owned institution. Haaretz reported that Israel continued to sell weapons to Myanmar after a U.S. and EU arms embargo was placed on the country and despite the Israeli government claiming it had ended arms sales to the country in 2018. (HA, MEE 9/5)

Papua New Guinean prime minister James Marape and Israeli prime minister Benjamin Netanyahu inaugurated the Papua New Guinean embassy to Israel in Jerusalem. Marape cited his Christian beliefs in making the decision to open the embassy in Jerusalem, which Israel will fund for the first 2 years. PLO Executive Committee member Wasel Abu Yousef said that Israel was “looking for any country – even if that country can only be seen under a microscope – so it can claim there are countries opening embassies in Jerusalem.” A picture circulating on social media showed the embassy completely empty, except for the embassy plague, the day after the inauguration. The U.S. granted Israeli finance minister Bezalel Smotrich a diplomatic visa for his trip to Washington D.C. where he will address the Israel Bonds summit. U.S. secretary of defense Lloyd Austin met with Defense Minister Gallant in Tel Aviv. Austin told reporters that diplomacy is the best option to prevent Iran from obtaining nuclear weapons. More than 90 Democratic members of the U.S. Congress signed a letter to U.S. president Joe Biden urging him to pressure the Israeli government not to undermine its judicial branch, to scale-down Israeli raids in the West Bank, and not to annex the West Bank. (HA 3/9)

EU high representative for foreign affairs Josep Borrell wrote an op-ed in Project Syndicate, saying that European and Arab states must start being more engaged in pursuing peace between Israel and Palestine as U.S. efforts have not brought peace any closer. Borrell wrote that he and other EU representatives have already taken an initiative to start talks with Saudi Arabia and the Arab League. Borrell also criticized Israel for allowing settler violence against Palestinians, not protecting civilians during military operations, expanding settlements, and eroding the status quo at the holy sites. U.S. president Joe Biden continued his 4-day Middle East trip, leaving Israel for East Jerusalem and the West Bank. In East Jerusalem, President Biden visited the Augusta Victoria Hospital, announcing $100 million in aid for the East Jerusalem Hospital Network that serves Palestinians from East Jerusalem, the West Bank, and Gaza. The funding of the hospital will need U.S. congressional approval. Biden’s predecessor Donald Trump had cut U.S. funding in medical aid for the PA. Biden’s visit was the 1st by a sitting U.S. president to East Jerusalem, outside of the Old City. In Bethlehem, Biden and PA president Mahmoud Abbas met and held a press conference, where President Abbas stressed that a 2-state solution will not be tenable forever and called for accountability for Israel’s killing of Palestinian American journalist Shireen Abu Akleh. Additionally, Abbas called on the U.S. to reopen its consulate to Palestinians and delist the PLO from the U.S. list of terrorist organizations, saying “we are not terrorists.” Biden for his part called for a “full and transparent” investigation into the killing of Abu Akleh, voiced support for a 2-state solution along the 1967 borders with land swaps, and announced that Israel had said it would allow Palestinian phone companies to connect to 4G networks by the end of 2023. Biden also announced $201 million in funding for UNRWA and $15 million in aid for food security via the UN World Food Program and 2 NGOs. Additionally, it was reported that Israel will open the Allenby Bridge on a 24-hour basis and assess if the PA should have a presence at the crossing. It was reported by Palestinian sources that the 2 leaders gave separate statements after failing to agree on a joint statement. After meeting with President Abbas, Biden headed to Saudi Arabia where he was greeted by Saudi crown prince Mohammed bin Salman with a “fist-bump,” despite promising during his presidential campaign to make Saudi Arabia a pariah due to Crown Prince bin Salman’s involvement in the killing of journalist Jamal Khashoggi. It was announced by U.S. national security advisor Jake Sullivan that Saudi Arabia had opened its air space to all Israeli flights as part of the 2 countries’ path to normalization and Saudi officials said they would start discussions to approve flights from Israel to Saudi Arabia for Muslim pilgrims. Saudi Arabia’s foreign minister Adel al-Jubeir told CNN in an interview that his country remains committed to the Arab Peace Initiative, saying “we need to have a process, and this process needs to include the implementation of the Arab Peace Initiative. In the West Bank, PA forces arrested 9 Palestinian protesters during a general strike in Hebron over rising food prices. Food prices have been rising throughout the world due to Russia’s blockade of Ukrainian wheat and global supply chain issues. In Palestine, prices on flour, sugar, and cooking oil have risen up to 30% in the last quarter. 1 Israeli settler opened fire at Palestinians, claiming they had thrown stones at him; no injuries were reported. Israeli forces delivered a demolition notice for part of a Palestinian home in al-Rakiz in the Masafer Yatta area. Israeli forces also raided Nabi Salih, firing tear gas at Palestinians protesting the incursion; no injuries were reported. Elsewhere, Israeli forces violently dispersed a Palestinian protest in Tubas, causing tear-gas related injuries. Israeli forces also delivered notices to Palestinians in Tarqumiyah informing them that 600 dunams (148 acres) of agricultural land will be seized by Israel to expand the settlements of Telem and Adora. In East Jerusalem, Israeli forces raided Silwan, firing tear gas at Palestinians and causing injuries. In Jerusalem, Israeli right-wing activists raided the Greek Garden and the Church of Holy Trinity on Mount Zion, damaging property of the Greek Orthodox church. The Israeli Knesset failed to pass the 1st vote on extending the Emergency Regulations – Judea and Samaria, Jurisdiction and Legal Aid, extending Israeli law to Israeli settlers living in the West Bank. 58 voted against and 52 voted for, as the Israeli right-wing opposition voted against the measure to trigger the dissolution of the coalition government. The emergency regulation expires at the end of June. 2 party members in the Israeli coalition, Mazen Ghanaim from the United Arab List and Ghaida Rinawie Zoabi from Meretz, voted against the bill, as did the members of the Joint Arab List. Amnesty International (AI) called on Israel to “immediately release” Salah Hammouri, a Palestinian-French human rights lawyer who works for Addameer and who has been held in administrative detention since 3/7. A survey conducted by the Israeli Democracy Institute found that 60% of Israeli Jews favored segregation from the country’s Palestinian community, up from 45% in last year’s survey. In comparison, about 20% of Palestinian citizens of Israel favored segregation. (HA 6/6)

Haaretz reported on recently released documents at the Israeli State Archive, which details conversations between Israeli and U.S. officials during the 1st Israeli Invasion of Lebanon. In the trove of released documents are conversations between then Israeli prime minister Menachem Begin and U.S. president Ronald Reagan, where President Reagan suggests that Palestinian refugees in Lebanon become Lebanese citizens. Prime Minister Begin responds by suggesting that Palestinians in Lebanon be deported to Libya, Iraq, Syria, or Saudi Arabia. (HA 6/6)

At a UN security council (UNSC) meeting on Israel-Palestine, UN secretary-general António Guterres said that the situation was “utterly appalling,” calling for an immediate ceasefire. Israeli prime minister Benjamin Netanyahu said that the Israeli defense ministry and the civil administration’s higher planning committee will approve 800 new settlement units in the Itamar, Beit El, Shavei Shomron, Oranit, Givat Ze’ev, Tal Menashe, and Nofei Nehemia settlements and settlement outposts. Prime Minister Netanyahu also said on Facebook that “[w]e’re here [in the West Bank] to stay. We’re continuing to build the Land of Israel.” Leader of the Israeli opposition Yair Lapid of the Yesh Atid party called the announcement of the new settlement units “irresponsible,” citing the U.S. presidential transition on 1/20. France’s foreign ministry, the Organisation of Islamic Cooperation, Egypt, Saudi Arabia, and the PA denounced the settlement expansion. Israeli defense minister Benny Gantz also approved a small number Palestinian construction projects in al-Walaja, Hizma, Bethlehem, and Bayt Jala. All the projects need secondary approval. PA president Mahmoud Abbas issued 3 presidential decrees, 2 of which critiques say serves to bolster the power of the PA presidency ahead of potential elections later this year. 1 decree allows the PA president to select judges instead of approving judges, who would be selected based on seniority. The decree also allows the president to force Palestinian judges to retire 5 years before the set retirement age of 70. A 2d decree establishes administrative courts, which can hear petitions against officials and institutions, previously a duty of the High Court of Justice. An Israeli court in Lod ruled that screening or distributing the movie Jenin Jenin from 2002 by Mohammad Bakri should be banned and copies of the movie destroyed. Bakri was also ruled to pay $55,000 to an Israeli soldier who appears in archival footage used for the movie and $16,000 for the cost of the trial. Defense Minister Benny Gantz said that he regretted forming a coalition with Prime Minister Netanyahu, saying that Netanyahu “cheated me and cheated you [the Israeli public].” He then called on all opposition leaders, including the Joint Arab List’s Ayman Odeh, to join him in sending “Bibi [Netanyahu] home” in the upcoming election. The foreign ministers of Germany, France, Jordan, and Egypt met in Cairo to discuss reviving peace talks between Israel and Palestine. The quartet expressed willingness to work closely with the U.S. to map steps toward peace. In a statement, the 4 called for a Palestinian state with East Jerusalem as its capital. According to the Jerusalem Post, the 4 countries had tried to invite the Israeli and PA foreign ministers to the meeting, but both were unable or unwilling to travel for the meeting. U.S. billionaire and mega-donor to Benjamin Netanyahu, Donald Trump, and Israeli settlements Sheldon Adelson died. Adelson had recently flown the convicted Israeli spy Jonathan Pollard to Israel from the U.S. so he could immigrate after being released from parole, and he bought the U.S. ambassador’s house in Tel Aviv from the U.S. state department earlier in 2020. At a virtual Arab League meeting, a majority of countries rejected a Palestinian proposal to condemn the UAE for its normalization deal with Israel. PA foreign minister Riyad al-Maliki accused the U.S. of blackmailing Palestinians and some Arab countries. The secretary-general of the Arab League Ahmad Aboul Gheit reiterated that the Arab Peace Initiative remains the Arab League’s stance on the Palestinian-Israeli conflict. According to senior advisor to U.S. president Donald Trump, Jared Kushner, Saudi Arabia has allowed Israeli commercial air traffic to use Saudi Arabian airspace. Kushner also said that the U.S. peace plan presented in January was aimed at “trying to save the two-state solution, because . . . if we kept going with the status quo . . . ultimately, Israel would have eaten up all the land in the West Bank.” The U.S. peace plan allows Israel to annex 30 percent of the West Bank. The Sudanese foreign ministry fired its spokesperson after he said on 8/18 that Sudan was looking forward to normalizing ties with Israel, a claim that the foreign ministry denied that same day. Saudi Arabia’s foreign minister Prince Faisal bin Farhan Al Saud said that “Saudi Arabia considers Israel’s unilateral policies of an annexation and building settlements as an illegitimate and detrimental to the two states solution . . . Saudi Arabia reaffirms its commitment to peace as a strategic option based on the Arab Peace Initiatives.” The Arab Peace Initiative stipulates normalization with Israel is predicated on the establishment of a Palestinian state. One day after Israeli defense minister Avigdor Lieberman resigned in protest of Prime Minister Benjamin Netanyahu’s decision to reach a cease-fire with the armed Palestinian groups in Gaza, both Finance Minister Moshe Kahlon and Interior Minister Aryeh Deri call for snap elections to be held as soon as possible. Meanwhile, hundreds of Israelis from communities near Gaza gather in central Tel Aviv to protest the government’s response to the recent rocket fire from Gaza. Many call for Netanyahu to resign. Netanyahu, for his part, presents to a group of leaders from the border communities a NIS 500 million (approximately $135 million) plan to support them over the next 2 years. UNRWA commissioner general Pierre Krähenbühl says that the agency has almost entirely made up for the budget shortfall caused by U.S. president Trump’s decision to slash U.S. support for UNRWA earlier this year. He says that UNRWA has raised an addition $382 million, bringing the deficit to just $64 million. “I’ll be very honest in saying, I don’t think many people believed that we would be able to overcome a $446 million shortfall at the beginning of the year,” he says, crediting the EU, Kuwait, Qatar, Saudi Arabia, and the UAE for each upping their pledges of support this year.
