The Israeli High Court of Justice dismissed a petition by Palestinian landowners to have the Homesh outpost evacuated to allow the landowners to access their land. The court said that since the outpost’s buildings were moved to Israeli state-owned land earlier this year, they are no longer considered illegal. Israeli national security minister Itamar Ben-Gvir told Israeli settlers at the partly resettled Evyatar settlement outpost that the settlers should “[r]un to the hilltops” and build settlements “in all the hills around.” Ben-Gvir also called for the Israeli military to “launch a military operation, take down buildings and eliminate terrorists. U.S. national security adviser Jake Sullivan spoke with his Israeli counterpart Tzachi Hanegbi, expressing concern about Israeli settler attacks on Palestinian villages. The Jerusalem District Planning Committee approved proposed plans to build a new American embassy on a plot of land known as the Allenby complex, which is privately owned by several Palestinian families. It is still undetermined if the U.S. will move ahead with its plans to build the embassy on the plot of land because it was seized by Israel from the Palestinian families after the Nakba. (HA 6/22)

U.S. ambassador to Israel Tom Nides said at a Geneva Initiative event in Tel Aviv that the U.S. does “not stand and watch settler violence. I have been very clear and very specific that we will not stand by, and we are pushing the Israelis to take whatever action they need to take to stop those people.” The Saudi foreign ministry also issued a statement condemning the settler attacks. The annual UN report on the treatment of children in conflict zones left out Israel on the list of shame for the killing and mistreatment of Palestinian children. According to the report, 42 Palestinian children were killed and 933 were injured during 2022. Human Rights Watch and the PA expressed disappointment that Israel was left off the list. The chair and deputy chair of the Elders, Mary Robinson and Ban Ki-moon, issued a statement after visiting Israel and Palestine, warning that the “one-state reality is now rapidly extinguishing the prospect of a two-state solution.” The statement said that Robinson and Ban did not hear a “detailed rebuttal of the evidence of apartheid. In response to the killing of the 4 settlers, Israel revoked travel permits for all Palestinians sharing the last names of the 2 alleged perpetrators. Israeli national security minister Itamar Ben-Gvir demanded that the Israeli government respond to the killing of the 4 Israeli settlers by assassinations by airstrikes, demolitions, deportations, and death penalty. U.S. ambassador to Israel Tom Nides tweeted that he was “[d]eeply concerned about the civilian deaths and injuries that have occurred in the West Bank these past 48 hours, including that of minors,” referring to both Israeli settler and Palestinian casualties. This led to criticism from Israeli ambassador to the U.S. Michael Herzog, who said that the “balanced” statement was disrespectful to the Israeli settler casualties. The U.S., UK, and EU criticized the Israel decision to allow Israeli settlers to build a new structure at the Homesh settlement outpost and to allow settlers a permanent presence there. At a cabinet meeting, Israeli justice minister Yariv Levin defended his position that the government needs more control over the appointment of judges to the Supreme Court, saying “Arabs buy apartments in Jewish communities in the Galilee and this is causing Jews to leave these areas because they don’t want to live with Arabs,” noting that judges should understand that. Haaretz reported that Israeli attorney general Avichai Mendelblit authorized establishing an Israeli settlement on the evacuated Evyatar settlement outpost near Beita. Attorney General Mendelblit is leaving office this week. Palestinians have held weekly protests at the site since the outpost was erected in May 2021. The outpost was evacuated in June 2021, but the houses erected remained as the settlers struck a deal with the Israeli government that they could move back if Israel deemed that the land is state-owned. Israeli defense minister Benny Gantz will have to declare the area state-owned, after which there will be a 45-day period to file objections. Several Palestinians have been killed by Israeli forces in the past year while protesting the outpost. In a letter from Israeli foreign minister Yair Lapid to Israeli prime minister Naftali Bennett, Lapid warned that if the Israeli government legalized the Evyatar settlement outpost, it “could have serious diplomatic consequences and damage foreign relations, first and foremost from the United States,” saying that the U.S. has already made this clear to him. Al-Maliki also said that the EU, UN, and Russia had agreed to a ministerial meeting about the Palestinian-Israeli situation but that the U.S. had not. Former Israeli soldiers acknowledged that there is a mass grave of Palestinians killed during the Nakba in 1948 on a beach in the depopulated village of Tantura, where Israeli forces and militants massacred Palestinian prisoners of war. The Israeli government has denied the existence of the mass grave despite it being published in a thesis in 2000. The mass grave site is now a parking lot for the Dor beach built on the depopulated village. The PA foreign ministry called for an international investigation into the massacre aimed at punishing Israeli officials and institutions covering crimes committed by Israel. Israel and Germany signed a deal for Israel to buy 3 submarines from the Germany company ThyssenKrupp. Germany agreed in 2017 to cover $680 million of the price Israel will have to pay. The Knesset ministerial committee for legislation approved a bill that would bar Palestinians married to Israeli citizens from getting residency rights in Israel. The bill, which must still pass in the Knesset, builds on a temporary ban on Palestinian family unification, which expired in July 2021. Israeli deputy economy minister Yair Golan from the Meretz party called Israeli settler attacks on Palestinians a pogrom, in relation to attacks near at the Homesh settlement outpost. The Dutch government announced that it will no longer provide funding to the Union of Agricultural Work Committees (UAWC). Israel put UAWC, along with 5 other Palestinian rights organizations, on its terror list on 10/22/2021, claiming that the organizations are linked to the PFLP. The international community, including the EU, has criticized the terror designations for the organizations, saying Israel have not provided any evidence to support its claims. The Dutch government’s decision follows an external review predating the Israeli terror designation, which found that UAWC employees have personal ties to members of the PFLP, but that no funding has been used for PFLP purposes and that there are no organizational links between the PFLP and UAWC. B’Tselem reported that 2021 saw the most killing of Palestinians since 2014. According to B’Tselem, 319 Palestinians were killed by Israeli forces and Israeli settlers. 9 Israelis were killed by Palestinians. The human rights organization also said 2021 saw the most demolitions of Palestinian homes in 5 years. 295 residential structures were demolished, displacing 895 Palestinians, including 463 minors. The Washington Post reported that the UAE had planted NSO Group’s Pegasus spyware on Saudi dissident journalist Jamal Khashoggi’s then-fiancée’s phone prior to the killing of Khashoggi. The Post reported that Hanan Elatr’s devices were hacked while she was in Dubai airport due to her job as a flight attendant. While in Dubai airport, Elatr was detained and questioned as agents planted the Pegasus spyware on her devices. The Citizen Lab research group confirmed that the Pegasus spyware had been planted on her phone prior to the killing of Khashoggi. AP also reported that Citizen Lab had found Pegasus spyware on phones belonging to a Polish lawyer and a Polish prosecutor known to publicly oppose the right-wing Polish government’s attempts to undermine the judicial branch of government. Qatar and Egypt signed a deal to supply fuel and building supplies to Gaza during the Ad Hoc Liaison Committee meeting. The deal will see Qatar pay Egypt for oil and gasoline which will be given to Hamas and distributed at gas stations in Gaza and some funds will be directed at vulnerable families in Gaza and to help pay civil servants. The Israeli state prosecutor’s office urged the Jerusalem district court to uphold a ban barring Palestinian applicants for family reunification, despite the law having expired in July. The state prosecutor’s office said that the expiration of the ban is only temporary. (HA 11/15)

Mohammad Dahlan, a political rival of PA president Mahmoud Abbas, said the UAE would send another 40,000 doses of the Sputnik V vaccine to Gaza. The ICC ruled that it has territorial jurisdiction to persecute alleged war crimes committed in the occupied Palestinian territories, as it found Palestine to be “a State Party to the [Rome] Statute.” The ICC defined the occupied Palestinian territories as the West Bank, including East Jerusalem, and Gaza. Israel has argued that the ICC does not have jurisdiction to prosecute matters pertaining to Israel and Palestine because Israel is not party to the Rome Statute and because Palestine is not a state. The latter 2 of the 3 ICC judges ultimately disagreed with erasing the final hurdle to start a formal investigation, 6 years after the ICC chief prosecutor Fatou Bensouda started her preliminary investigation into alleged war crimes made by Israel and Hamas. Israeli prime minister Benjamin Netanyahu called the ruling “pure anti-Semitism” and said, “[w]e will fight this perversion of justice with all our might.” The PA prime minister Mohammed Shtayyeh praised the decision. The U.S. State Department’s spokesperson said the U.S. has “serious concern about the ICC’s attempts to exercise its jurisdiction over Israeli personnel. We have always taken the position that the court’s jurisdiction should be reserved for countries that consent to it or that are referred by the UN Security Council.” Haaretz reported that Israel has started briefing military personnel on potential implications for them if the proceedings move to a trial.
