Gaza’s border with Israel; fires missiles at 3 sites in Gaza City (the local Fatah headquarters, Hamas’s al-Risala newspaper, an electrical transformer), cutting electricity to part of the city, wounding at least 3 Palestinian children. Gaza crossings into Israel remain closed for the 8th consecutive week. Rejecting a 5/15 petition by a Palestinian human rights group, the Israeli High Court says the IDF may widen the Philadelphi Route buffer zone along the Gaza border with Egypt, potentially demolishing 100s of Palestinian homes, ruling that the army has a “real, imminent need” to do so. The IDF announces over loudspeakers in Rafah’s Bloc O section, where much bulldozing has occurred, that Palestinians have 24 hrs. to evacuate their homes; fires on residential areas to encourage Palestinians to leave. The International Comm. of the Red Cross begins setting up a tent camp in Rafah able to provide emergency housing for 1,500 Palestinians left homeless by IDF bulldozing operations in the past wk. and those fleeing in fear of further demolitions. In the West Bank, the IDF conducts arrest raids, house searches in Dahaysha refugee camp (r.c.) nr. Bethlehem, begins bulldozing 45 dunams (4 dunams = 1 acre) of Palestinian land nr. Palestinian factions reopen cease-fire talks in Cairo under Egyptian auspices. (MM 12/4; MENA, VOP, XIN 12/4 in WNC 12/6; WP, WT 12/6; MEI 12/19)

The IDF attempts to assassinate, wounds Hamas political leader and chief spokesman ‘Abd al-‘Aziz Rantisi, firing missiles at his car as he drives through Shati‘ r.c., killing a bodyguard and a Palestinian woman walking nearby, wounding 27. Later in the day, IDF helicopters fire missiles at a 2d car in Jabaliya, allegedly targeting 2 Palestinians who fired 5 Qassam rockets at Sederot earlier, causing no damage or injuries; 3 Palestinian bystanders are killed, 30 (including the 2 targets) are wounded. Reversing an 8/18/02 decision, the Israeli High Court rules that the IDF’s "neighborhood procedure" (i.e., sending a Palestinian to warn a wanted individual to surrender to IDF troops waiting nearby) is legal, saying the IDF may not force Palestinians to act as human shields, but it may use them if they “volunteer.” (HA, WT 1/22)

The Israeli High Court rules that the government can banish to Gaza the West Bank relatives of Palestinians accused of staging attacks on Israelis only in "extreme cases" where "that person, by his own deeds, constitutes a danger to the security of the state." The ruling argues that such forced transfer constitutes "assigned residence" under Articles 41 + n43 of the Fourth Geneva Convention, is there for legal under international law. The court thus upholds an 8/12 military court order to expel to Gaza for 2 yrs. the brother, sister of senior AMB mbr. Ali Ajuri (assassinated 8/6/02) for allegedly aiding in the staging of the 7/17/02 Tel Aviv bombing; overrules an order to expel another Palestinian for lending a car, food to his brother, Naseer Assida, without knowing he was (allegedly) plotting the 7/16/02 ambush of a settler bus; Assida has not been captured.
