The ICJ rules that there is a basis to further investigate the South African genocide case against Israel and that the ICJ has jurisdiction to hear the case. The court issues 6 provisional measures: 1) Israel must take all possible measures to prevent acts as outlined in Article 2 of the Genocide Convention, including not killing members of a particular group [Palestinians], not causing physical or psychological harm to members of that group, not inflicting living conditions which are calculated to bring about the end of the existence of a people, and not carrying out acts to precent the births within the group. 2) Israel must ensure its military does not carry out any of the actions outlined in measure 1. 3) Israel must prevent and punish incitement to commit genocide. 4) Israel must ensure the delivery of basic services and essential humanitarian aid. 5) Israel must prevent the destruction of evidence of war crimes and allow fact-finding missions access. 6) Israel must submit a report on all steps taken to abide by the measures within 1 month. 4 of the orders are approved by 15 of the 17 judges, while 2 of the measures are approved by 16 of the 17 judges. The only judge to vote against all measures is Judge Julia Sebutinde of Uganda. Aharon Barak, the judge representing Israel, votes for measures 3 and 4. The measures issued by the court fall short of South Africa’s demand for a ceasefire. Hamas welcomes the ICJ orders and calls on the international community to force Israel to implement the decisions. PA ambassador to the UN Riyad Mansour calls the measures against Israel “historic.” South Africa calls the ruling a “decisive victory.” Israeli prime minister Benjamin Netanyahu instructs his ministers not to comment on the ICJ decision and calls the ruling “outrageous.” The U.S. State Department says the ICJ did not “make a finding about genocide” despite the court specifically saying that it is continuing its trial of Israel on charges of genocide. Israeli military spokesperson Daniel Hagari said, “because of Hamas’s use of hospitals for military purposes, [the hospitals] will lose special protection in the international court.” Israel has presented animations, pictures of purported tunnels, and a video from al-Rantisi Children’s Hospital that it said was proof of Hamas’s presence at hospitals, all of which did not show any evidence to back Israel’s claim. In the video from al-Rantisi Children’s Hospital, Israel showed a piece of paper hanging on the wall that it claimed was a list of Hamas militants’ names. However, the list was merely a calendar with the names of the days of the week written in Arabic. The U.S. said it had intelligence that suggested a Hamas and Islamic Jihad presence at hospitals in Gaza, including al-Shifa. A U.S. national security council spokesperson said “[w]e do not support striking a hospital from the air and we don’t want to see a firefight in a hospital where innocent people, helpless people, sick people trying to get medical care they deserve are caught in crossfire.” Hamas called for the UN to inspect all hospitals in Gaza to debunk the Israeli and U.S. claims. Doctors at al-Shifa also rejected the claim that Palestinian militants were operating in the hospital. The PA Health Ministry said at least 32 patients at al-Shifa Hospital had died in the past 3 days, including 6 premature babies. 155 truckloads of aid entered Gaza through via the Rafah crossing. About 600 foreign nationals were evacuated to Egypt. The UN indicated that 12,500 displaced people, 900 patients, and 1,000 health workers fled the hospital over the weekend, saying that around 200,000 Palestinians have fled northern Gaza to the south since 11/5. The Hamas-affiliated media outlet Shehab News Agency leaked a 3-minute audio clip of PLO secretary-general Hussein al-Sheikh criticizing PA president Mahmoud Abbas and other leaders in the PA. In the clip Secretary-General al-Sheikh says that President Abbas “is a partner in the chaos and has an interest for it to remain.” Al-Sheikh told Al-Araby al-Jadeed that the recording was fabricated. The Knesset approved amendments to the Basic Law on the Government to allow 2 ministers at the defense ministry. An Israeli military court refuted claims by defense and foreign ministers Benny Gantz and Yair Lapid that a Spanish woman working for Health Work Committees had any links to the 6 Palestinian rights organizations that Israel last month deemed terrorist. The 2 ministers had tried to justify the designation by using the conviction of the Spanish woman as evidence, which the military court then rejected. The cybersecurity firm ESET published a report saying that the Israeli spyware company Candiru’s spyware was used to hack 20 websites in the UK, Yemen, South Africa, Italy, Iran, and Syria, including Middle East Eye. Israel’s attorney general Avichai Mendelblit said he would not intervene in the eviction case against Palestinian families in Shaykh Jarrah. Israel’s ambassador to the U.S. and UN, Gilad Erdan, visited the Associated Press headquarters in New York, meeting with AP’s president and CEO Gary Pruitt “to restore the relations between Israel and the Associated Press” in the wake of Israel’s air strike demolishing AP’s offices in Gaza on 5/15. Ambassador Erdan justified the air strike that demolished the high-rise by alleging that Hamas was using an office in the 14-story building to jam the Iron Dome missile defense system. Israeli defense minister Benny Gantz said that Israel will not interfere in the Palestinian elections but will not be working with Hamas if the party gains more influence. Defense Minister Gantz’s statement is contradicted by Haaretz, reporting that the Shin Bet director threated PA president Mahmoud Abbas to cancel the elections and that Israel has been arresting Palestinian candidates it does not want to see in the Palestinian parliament. Israeli president Reuven Rivlin picked Israeli prime minister Benjamin Netanyahu to be the 1st to try to form a government. President Rivlin said that none of the candidates had a real chance of forming a government but that he had picked Netanyahu because he had received the most endorsements. An Iranian cargo ship was hit by a limpet mine in the Red Sea between Yemen and Eritrea. In the meeting, Argaman is reported to have told President Abbas to cancel the Palestinian elections because Hamas was running, which Abbas refused to do. After releasing its annual report on human rights abuses with language of the Israeli occupation removed from the title of the section on the West Bank and Gaza, the U.S. state department spokesperson Ned Price said that the U.S. does consider the West Bank to be occupied by Israel. The Israeli security service Shin Bet announced that it had arrested a Palestinian from the West Bank who had planned an attack in Jerusalem close to Israeli election day. According to Shin Bet, the attack was planned with Hamas operatives in Gaza. Elsewhere in the West Bank Israeli forces arrested 16 Palestinians during late-night raids in and around Nablus, Bethlehem, Jenin, Tulkarm, and Ramallah. 3 Palestinian land surveyors were attacked by Israeli settlers in Ras Karkar west of Ramallah; all 3 were treated at a hospital for their injuries. A young Israeli woman is found dead in a forest on the outskirts of West Jerusalem. The circumstances around her death are initially unclear (Israel’s Shin Bet will, on 2/9, report that she was raped and killed by a West Bank Palestinian who was “nationalistically motivated”). In the West Bank, IDF troops detain 2 members of the International Solidarity Movement who were escorting Palestinian students to school through an Israeli security zone in Hebron. They also confiscate a vehicle and arrest 1 Palestinian during a raid near Hebron; and patrol near Nablus, Jenin, Hebron, and Tulkarm. Along Gaza’s border, IDF troops arrest 2 Palestinians attempting to cross into Israel near Jabaliya refugee camp. They also open fire on Palestinian shepherds working near Gaza City and al-Bureij refugee camp, causing no injuries. Hundreds of Palestinians in Gaza claim that the PA has not delivered their salaries on time this month. A PA official in Ramallah says that the payments are being delayed due to a “technical fault” and that the delay has nothing to do with PA president Mahmoud Abbas’s efforts to increase pressure on Hamas in Gaza. The World Bank approves a $30 million grant to support the PA’s efforts to improve government transparence and to strengthen the electricity, water, and health sectors of the Palestinian economy. (MNA, WAFA 2/8)

Israeli settlers shoot and kill a Palestinian farmer outside Qusra village near Nablus. The Palestinian press reports that they killed the man when he tried to stop them from entering his fields. According to the Israeli press, the settlers were hiking in the area when a group of Palestinian youths surrounded them and threw stones at them, provoking the shooting. Following the incident, minor clashes break out between Palestinian youths and IDF troops; 2 Israeli soldiers are lightly injured. Also, settlers throw stones at Palestinians and their property in Qusra and nearby Asira village; 10 Palestinians and 1 Israeli soldier are injured in the ensuing clashes. Meanwhile, Israeli forces arrest 10 Palestinian farmers after they refused an evacuation order of their lands near Hebron. The IDF issues arrest summons for 2 Palestinians during raids near Bethlehem, and patrols near Hebron, Tulkarm, and Qalqilya. In East Jerusalem, Israeli settlers assault a Palestinian and her daughter in the Old City, causing light injuries to both. Off Gaza’s coast, Israeli naval forces open fire on Palestinian fishing boats near Bayt Lahiya and later near Jabaliya refugee camp, causing no damage or injuries. Unidentified persons in Gaza fire several mortar shells at IDF troops patrolling along Gaza’s northern border, causing no injuries. The IDF launches strikes on Hamas and Islamic Jihad in Palestine (PIJ) positions in Bayt Hanun, Gaza City, and Rafah (3 Palestinians are injured). The IDF later says that PIJ was responsible for the mortars, and that the attack was likely retaliation for the Israeli demolition of a PIJ tunnel on 10/30 (see JPS 47 [2]). Israel’s Shin Bet accuses the Palestinian manager of the Gaza branch of World Vision, a Christian aid group, with redirecting around $43 m. of the group’s money to Hamas over the past 6 years. The manager, Mohammad Halabi, was arrested at the Erez border crossing on 6/15. Hours later, the Australian govt. suspends its funding of World Vision. The charity responds, saying that programs in Gaza “have been subject to regular internal and independent audits, independent evaluations, and a broad range of internal controls,” and that they “have no reason to believe the allegations are true.” (NYT, TOI 8/4; TOI 8/5; AJ 8/9)

Egypt’s military announces that it has killed the leader of the Sinai Province of the Islamic State (SPIS) with a recent air strike nr. al-Arish in n. Sinai. The strike was one of many that reportedly killed 45 other SPIS fighters and destroyed a lot of their supplies and munitions. (HA, REU 8/4)

Hebron, sparking clashes in which 3 Palestinians are injured with rubber-coated metal bullets. The IDF also patrols in the n. Jordan Valley, where they assault a Palestinian farmer and lightly injure him. IDF troops fire tear gas at dozens of Palestinians throwing stones at the soldiers; 1 Palestinian youth and 1 Israeli officer are injured. Israeli soldiers also conduct a raid s. of Bethlehem; patrol in Tulkarm. Following a march marking Hamas’s 27th anniversary, the IDF conducts late-night arrest raids nr. Hebron. Jerusalem’s municipal Planning and Building Committee removes from its agenda two construction plans for the expansion of Har Homa settlement and a waste infrastructure project for Ma’ale Adumim settlement. Israeli media reports that PM Benjamin Netanyahu may adopt a package of ‘‘goodwill gestures’’ ahead of U.S. Pres. Obama’s upcoming visit, including transferring responsibility for 2 West Bank roads to the PA, releasing Fatah prisoners, and approving building plans for Palestinian villages in Area C currently considered illegal. Israeli security agency Shin Bet announces that for the 1st year since 1973, there were no Israeli casualties from a Palestinian attack in the West Bank. The report covering 2012 says that there was an uptick in so-called popular terror in the West Bank, referring to stone-throwing and Molotov cocktails. The report notes that 10 Israelis were killed in security-related incidents during 2012, and that more than 2,500 rockets and mortar shells were fired from the Gaza Strip into Israel. However, Shin Bet reports that since Operation Pillar of Defense in November 2012, no rockets have been fired. The report also records that 8 rockets were fired at Israel from Egypt’s Sinai Peninsula, and that there were 11 attempts to fire anti-aircraft weaponry at IDF planes, up from just 1 effort in 2011.
