UNRWA says some of its staff have been forced to give confessions under torture and ill-treatment by Israeli forces. The statement follows an Israeli claim that there are more than 450 Hamas and Islamic Jihad affiliated people working for UNRWA and the release of audio files purporting to be evidence that 2 UNRWA workers confessed to taking part in events on 10/7/2023. UN special representative of the secretary-general on sexual violence in conflict Pramila Patten says during a press conference that a UN investigation team has found that Palestinians in the West Bank are subject to “cruel, inhuman and degrading treatment” in detention and are subject to “disproportionate physical and sexual violence, including sexual harassment and threats of rape during house raids, including at night, and at checkpoints.” Patten also say that the team has “found clear and convincing information that sexual violence, including rape and sexual torture” has been committed against Israeli captives released after being held in Gaza and that there are “reasonable grounds to believe conflict-related sexual violence” occurred on 10/7/2023 in at least 3 locations. Patten says some highly publicized allegations of sexual violence were determined to be unfounded and stresses that the report is not the result of an investigation as Israel did not share any evidence of allegations. The New York Times reports that a forthcoming UNRWA report will charge Israel with “a range of ill-treatment” experienced by Palestinians taken from Gaza to detention centers in Israel. The ICJ rules that there is a basis to further investigate the South African genocide case against Israel and that the ICJ has jurisdiction to hear the case. The court issues 6 provisional measures: 1) Israel must take all possible measures to prevent acts as outlined in Article 2 of the Genocide Convention, including not killing members of a particular group [Palestinians], not causing physical or psychological harm to members of that group, not inflicting living conditions which are calculated to bring about the end of the existence of a people, and not carrying out acts to precent the births within the group. 2) Israel must ensure its military does not carry out any of the actions outlined in measure 1. 3) Israel must prevent and punish incitement to commit genocide. 4) Israel must ensure the delivery of basic services and essential humanitarian aid. 5) Israel must prevent the destruction of evidence of war crimes and allow fact-finding missions access. 6) Israel must submit a report on all steps taken to abide by the measures within 1 month. 4 of the orders are approved by 15 of the 17 judges, while 2 of the measures are approved by 16 of the 17 judges. The only judge to vote against all measures is Judge Julia Sebutinde of Uganda. Aharon Barak, the judge representing Israel, votes for measures 3 and 4. The measures issued by the court fall short of South Africa’s demand for a ceasefire. Hamas welcomes the ICJ orders and calls on the international community to force Israel to implement the decisions. PA ambassador to the UN Riyad Mansour calls the measures against Israel “historic.” South Africa calls the ruling a “decisive victory.” Israeli prime minister Benjamin Netanyahu instructs his ministers not to comment on the ICJ decision and calls the ruling “outrageous.” The U.S. State Department says the ICJ did not “make a finding about genocide” despite the court specifically saying that it is continuing its trial of Israel on charges of genocide. Biden is said to have spoken to Netanyahu almost every other day since 10/7 until a phone call on 12/23 where Biden ended the conversation in anger over Israel withholding the PA’s tax revenue, not allowing enough aid to enter Gaza, the intensity of the Israeli bombing of Gaza, and the lack of engagement on plans for after Israel’s war. Senator Chris Van Hollen (D-MD) tells Axios that “Netanyahu has given Biden the finger” at every juncture and that the Biden administration pleads with Netanyahu but gets “slapped in the face over and over again.” Axios also says Secretary Blinken’s visit to Israel earlier in the week was contentious due to the Israeli refusal to pay the PA its full tax revenue. Israeli finance minister Bezalel Smotrich said Israel will not transfer the PA its tax revenue while he is finance minister. South Africa invoked the Genocide Convention calling on the International Court of Justice (ICJ) to expedite hearings on the issue of Israel committing genocide and to order Israel to immediately stop the killing of Palestinians in Gaza. In its report delivered to the ICJ, South Africa described Israel’s actions as “genocidal in character because they are intended to bring about the destruction of a substantial part of the Palestinian national, racial, and ethnical group.” The Israeli Foreign Ministry called the South African action “blood libel.” The PA welcomed the South African action. U.S. secretary of state Antony Blinken approved the sale of M107 155mm projectiles worth $147.5 million to Israel, bypassing congressional approval. It was the second time the Biden administration bypassed congressional approval for weapons transfers to Israel since 10/7. Relatedly, unnamed Israeli officials told Al-Monitor that the U.S. had started to scale down its military support to Israel due to Israel’s failure to discuss its plans for Gaza after the war. Israel and Hamas agreed to the terms of a 4-day ceasefire that would see 50 women and children held in Gaza released in exchange for 150 Palestinian women and children being released from Israeli prisons. The start of the ceasefire would be announced within 24 hours, awaiting the Israeli High Court of Justice’s consideration of Israeli public appeals against the deal. The ceasefire could be extended for one additional day for every 10 additional captives released from Gaza. There are about 240 captives held by Hamas and Islamic Jihad. Israel agreed to stop military movement and allow people to travel from the north of Gaza to the south on Salah al-Din road, but said it would not allow movement to the north. 300 trucks carrying aid, including fuel, would be allowed into Gaza every day. Furthermore, Hamas said Israel had agreed to stop drone flights over southern Gaza during the period of the ceasefire and not fly over northern Gaza for 6 hours a day and that Israel could not attack or arrest anyone during the 4-day period. Israel published a list of 300 Palestinian prisoners, including 123 children, that it deemed eligible for release. Most of the prisoners on the list were arrested in the past 2 years for minor offenses. The Israeli security cabinet decided to deduct funds from the PA tax revenue that is used in Gaza, in addition to the funds it deducts from the PA that are said to be used for paying stipends to the families of Palestinian prisoners and Palestinians killed by Israel. The cabinet also decided to no longer allow Palestinians from Gaza to work in Israel and to send those held in the Israeli internment camps back to Gaza. Interior Minister Moshe Arbel approved a memorandum making it easier for Israel to revoke the citizenship for people accused of supporting, inciting, or identifying with a terrorist organization. Arbel also transferred $50.4 million to 67 Palestinian municipalities in Israel after the funds had been frozen by Finance Minister Bezalel Smotrich since July. The UN reported that over 1.4 million Palestinians, more than half the population in Gaza, have been displaced since 10/7 and that since 11 p.m. on 10/12 there has been a complete electricity blackout due to the Israeli blockade. As of 10/23, at least 27,781 housing units had been destroyed and 150,000 had been damaged in Israeli airstrikes since 10/7. At least 45% of all housing units have been either destroyed or damaged in Israeli airstrikes. UNRWA said 10 of its staff have been killed in the past 3 days, bringing the total number of UNRWA staff killed by Israel to 63. 26 trucks carrying aid to Gaza entered via the Rafah crossing. The WHO said it had not been able to resupply al-Shifa and al-Quds hospitals because of the risk of Israeli airstrikes. The Palestinian Red Crescent Society said an Israeli airstrike damaged its warehouse in Gaza City. Israel closed off the water to Gaza again after reopening 2 water lines in the past week. Al Jazeera journalist Youmna ElSayed said her family had received a phone call from Israel warning them to flee south from Gaza City. Israeli media reported that Finance Minister Bezalel Smotrich had sent a letter to Prime Minister Benjamin Netanyahu, informing him that monthly payments to the PA delivering the PA’s tax revenue had stopped. (AJ 10/30)

A draft document written by the Israeli Ministry of Intelligence said Israel may try to forcefully displace Palestinians in Gaza to Egypt. 2 other options in the document included that Israel hands control of Gaza to the PA or that is establish “local Arab rule” by Palestinians in Gaza. The Israeli High Court of Justice denied a petition by 3 Israeli organizations to remove a temporary order allowing worsening conditions for Palestinian prisoners. The judges said “[t]he assessment of human rights violations in times of war is not comparable to such assessments in peaceful situations.” (HA 10/30)

At the UN Security Council, PA ambassador to the UN Riyad Mansour criticized the international community for not forcing Israel to stop its bombing of Gaza, saying “they are besieged and bombed with nowhere safe to go.” Israeli UN ambassador Gilad Erdan wore a yellow Star of David, resembling the markings forced on Jewish people by Nazi Germany, saying “Never Again.” Dani Dayan, the chairperson of the Israeli Holocaust Remembrance Center, Yad Vashem, said Erdan’s actions “disgraces both Holocaust victims and Israel.” UNRWA commissioner-general Phillippe Lazzarini told the Security Council that a ceasefire was a “matter of life and death for millions,” and charged Israel with collective punishment.
