The Washington Post reports that the U.S. has raised allegations of beatings and torture of Palestinian prisoner Marwan Barghouti with Israel. UNRWA says some of its staff have been forced to give confessions under torture and ill-treatment by Israeli forces. The statement follows an Israeli claim that there are more than 450 Hamas and Islamic Jihad affiliated people working for UNRWA and the release of audio files purporting to be evidence that 2 UNRWA workers confessed to taking part in events on 10/7/2023. UN special representative of the secretary-general on sexual violence in conflict Pramila Patten says during a press conference that a UN investigation team has found that Palestinians in the West Bank are subject to “cruel, inhuman and degrading treatment” in detention and are subject to “disproportionate physical and sexual violence, including sexual harassment and threats of rape during house raids, including at night, and at checkpoints.” Patten also say that the team has “found clear and convincing information that sexual violence, including rape and sexual torture” has been committed against Israeli captives released after being held in Gaza and that there are “reasonable grounds to believe conflict-related sexual violence” occurred on 10/7/2023 in at least 3 locations. Patten says some highly publicized allegations of sexual violence were determined to be unfounded and stresses that the report is not the result of an investigation as Israel did not share any evidence of allegations. The UN Office of the High Commissioner for Human Rights (OHCHR) says it has received information that Palestinian women and girls have been “arbitrarily executed in Gaza, often together with family members, including their children.” The office also expresses alarm over the arbitrary detention of hundreds of women and girls in the West Bank and East Jerusalem, including reports of sexual assault of detainees, including rape. U.S. State Department spokesperson Matthew Miller says the U.S. “strongly encourage[s] Israel to thoroughly and transparently investigate credible allegations and ensure accountability for abuses and violations” in response to the OHCHR’s statement. The ICJ begins hearings in the case of Israel’s occupation of Palestinian territories. 52 countries will present oral and written arguments before the court between 2/19 and 2/26. The case was triggered on 12/30/2022 when a majority of members of the UN General Assembly voted to seek an opinion on the legal consequences of the Israeli occupation of Palestine. PA foreign minister Riyad al-Maliki, PA ambassador to the UN Riyad Mansour, and academics and legal experts address the ICJ judges on the first day of the hearings. Al-Maliki urges the judges to order an end to the Israeli occupation. Israeli prime minister Benjamin Netanyahu says Israel does not recognize the legitimacy of the ICJ proceedings. A report by the London School of Hygiene & Tropical Medicine and the Johns Hopkins Center for Humanitarian Health projects that between 2/7 and 8/6/2024 the excess number of deaths in Gaza could range from 4,200 to 259,680. In the best scenario where a ceasefire is reached and no epidemics occur the mean estimate is 6,550 excess deaths while in the worst scenario where the attacks escalate and epidemics occur the mean estimate of excess deaths is 85,750. In the West Bank, Israeli settlers set up mobile homes near Battir and plowed Palestinian land near Artas. Israeli forces raided Nur Shams refugee camp with more than 50 vehicles. Most of the annual Christmas celebrations in Bethlehem were canceled in protest against Israeli attacks on Gaza and in solidarity with the victims. In Gaza, Israeli forces bombed Maghazi, Gaza City, Jabalia refugee camp, Dayr al-Balah, Rafah, and Khan Yunis, killing dozens of people, including at least 100 in al-Maghazi and 21 in Khan Yunis. Israel said the bodies of 5 captives were retrieved from a tunnel under Jabalia refugee camp. Hamas said on 12/23 that it lost contact with a group holding 5 Israeli captives due to Israeli bombardment. Hamas released a statement saying its al-Qassam Brigades had killed 48 Israeli soldiers and wounded dozens of others in the past 4 days. Israel also damaged water, electricity, and sewage lines, uprooted streets, and bulldozed a monument to Yasir Arafat. Israeli forces also shot and killed a Palestinian who allegedly tried to stab a soldier near Beit Einun. Elsewhere, Israeli forces punitively demolished the family home in ‘Urif of a Palestinian killed by Israeli forces after he allegedly killed 4 settlers near the Eli settlement on 6/20. 28 Palestinians were arrested during late-night raids in and around Hebron, Ramallah, Qalqilya, Jenin, Nablus, and Bethlehem. In East Jerusalem, Israeli settlers toured the Haram al-Sharif compound. In Gaza, Israeli airstrikes killed at least 90 Palestinians in Khan Yunis and Gaza City, including at least 13 people in an airstrike on Khan Yunis. The number of fatalities was likely much higher since the Gaza Ministry of Health was unable to communicate with hospitals and civil defense members in northern Gaza. Israel said it had taken control of al-Shati refugee camp. Israel forces fired shots at al-Shifa Hospital. At the end of the day, Israel told the Gaza Ministry of Health that it will enter the hospital. Israel has bombed the vicinity of the hospital for days. 2 Israeli soldiers were killed and 4 seriously wounded in northern Gaza. Rockets were fired from Gaza, injuring 3 near Tel Aviv. In South Lebanon, Israel said it attacked Hezbollah sites in the Yiftah area. At the Red Sea, Israel said it intercepted a missile fired toward Eliat. The Gaza Ministry of Health was not able to fully update the casualty figures due to a collapse in services and communications at hospitals in northern Gaza. However, it did say that at least 11,451 Palestinians have been killed, including 4,630 children and 3,130 women, and 27,490 have been injured in Israeli airstrikes on Gaza since 10/7. Israeli military spokesperson Daniel Hagari said, “because of Hamas’s use of hospitals for military purposes, [the hospitals] will lose special protection in the international court.” Israel has presented animations, pictures of purported tunnels, and a video from al-Rantisi Children’s Hospital that it said was proof of Hamas’s presence at hospitals, all of which did not show any evidence to back Israel’s claim. In the video from al-Rantisi Children’s Hospital, Israel showed a piece of paper hanging on the wall that it claimed was a list of Hamas militants’ names. However, the list was merely a calendar with the names of the days of the week written in Arabic. The U.S. said it had intelligence that suggested a Hamas and Islamic Jihad presence at hospitals in Gaza, including al-Shifa. A U.S. national security council spokesperson said “[w]e do not support striking a hospital from the air and we don’t want to see a firefight in a hospital where innocent people, helpless people, sick people trying to get medical care they deserve are caught in crossfire.” Hamas called for the UN to inspect all hospitals in Gaza to debunk the Israeli and U.S. claims. Doctors at al-Shifa also rejected the claim that Palestinian militants were operating in the hospital. The Israeli High Court of Justice ruled to evict Israeli settlers who had been occupying Palestinian-owned land for 30 years in the Jordan Valley. The court accepted a petition by 20 Palestinian landowners filed 5 years ago but gave the settlers 7 years to leave the 1,000 dunams (250 acres) of land which was planted with date-bearing palms. The judge wrote in her ruling that the settlers’ cultivation of the land was done in violation “of international law, but also in violation of the government’s declared policy and even contrary to halakhic law.” (HA 11/9)

PA foreign minister Riyad al-Maliki filed a complaint to the International Atomic Energy Agency over Israeli heritage minister Amichai Eliyahu’s comment that Israel could drop a nuclear bomb on Gaza, calling the comment the “prevailing discourse in Israel” and “an official recognition that Israel possesses nuclear weapons and weapons of mass destruction.” PA president Mahmoud Abbas spoke with Dutch prime minister Mark Rutte, who invited Abbas to the Netherlands. An investigation by The New Yorker revealed that Spain had used the Israeli company NSO Group’s Pegasus spyware to hack the phones of 60 Catalonian leaders and activists. The investigation also revealed that Pegasus spyware was used against employees of UK prime minister Boris Johnson’s office. Citizen Lab, which cooperated with The New Yorker for the story, suspected that the UAE was behind the hack. It was reported in Israeli media that PA president Mahmoud Abbas met with new director of the Shin Bet Ronen Bar in the last week. The 2 were said to have discussed security coordination and efforts to reach a long-term ceasefire between Israel and Hamas. An Israeli military court refuted claims by defense and foreign ministers Benny Gantz and Yair Lapid that a Spanish woman working for Health Work Committees had any links to the 6 Palestinian rights organizations that Israel last month deemed terrorist. The 2 ministers had tried to justify the designation by using the conviction of the Spanish woman as evidence, which the military court then rejected. The cybersecurity firm ESET published a report saying that the Israeli spyware company Candiru’s spyware was used to hack 20 websites in the UK, Yemen, South Africa, Italy, Iran, and Syria, including Middle East Eye. Palestine Legal submitted a civil rights complaint against the George Washington University (GWU) to the DC office for human rights for discriminating against Palestinians. High-level GWU administrators had forced its employees to cancel a session for Palestinian students experiencing trauma related to the Israeli assault on Gaza in May. Hours after the IDF retaliated to projectile fire from Syria on 1/27, Hizballah fighters fire an antitank missile from inside Lebanon at an IDF convoy in a disputed area along the border nr. Shaba‘ Farms, killing 2 soldiers and injuring 7. The IDF responds with artillery fire, killing a Spanish peacekeeper with the UN Interim Force in Lebanon (UNIFIL). About an hour later, Hizballah fires mortars at several IDF positions in the area, causing no injuries.
