Israeli settlers also ram Palestinian-owned sheep in al-Muarajat, killing and injuring several. Meanwhile, Israeli settlers attack Palestinian shepherds in Shaab al-Butum, forcing them to flee. Israeli forces open fire at a Palestinian vehicle before assaulting Palestinians in the car and seizing it in Tuqu’. PA ambassador to the UN Riyad Mansour says a ceasefire is needed to implement the provisional measures instituted by the ICJ on 1/26. The U.S. House of Representatives passes H.R. 6679, preventing entry to the U.S. of members of the PLO, Hamas, and Islamic Jihad in a 422-2 vote. The bill would need to be approved by both the Senate and the president. PLO secretary-general Hussein al-Sheikh calls the bill a “dangerous decision” and demands a response from the Biden administration. Haaretz reports that Israeli commanders have instructed soldiers to set fire to Palestinian homes in Gaza and that in the past months hundreds of homes have been destroyed by Israeli soldiers setting fire to them. A photo of a note left behind by Israeli soldiers reads “[w]e are not burning the house so you can enjoy it, and when you leave – you will know what to do.” (HA 1/31)

Haaretz also reports that in the aftermath of 10/7/2023, Zaka community emergency response volunteers staged scenes in Israeli villages that were attacked to attract donations for the organization instead of properly handling bodies of deceased Israelis and spread accounts of atrocities that never happened to garner media attention. The Israeli military decided from 10/7/2023 to let Zaka handle the bodies of the dead instead of using its unit trained in the identification and collection of human remains. (HA 1/31)

Ynet reports that Prime Minister Netanyahu told the UN envoys from Malta, Bulgaria, Czechia, Hungary, Romania, Ukraine, Slovenia, and Sierra Leone that UNRWA must be replaced during a meeting in Jerusalem. (AJ, AP, REU 1/31)

Axios reports that U.S. secretary of state Antony Blinken has instructed the State Department to review and present policy options on U.S. and international recognition of a Palestinian state. A senior U.S. official tells Axios that some people in the Biden administration think that recognition of a Palestinian state should be the first step toward ending the Israeli occupation rather than the last. A federal judge in Oakland, California, dismisses a lawsuit brought by Palestinian Americans seeking to end U.S. support for Israel’s campaign in Gaza on the basis of genocide, saying he would have issued an injunction but is legally not able to do so due to a lack of jurisdiction. The judge, Jeffrey White, instead implores the Biden administration to “examine the results of their unflagging support” of Israel on the basis that “it is plausible that Israel’s conduct amounts to genocide.” (NYT 1/31; AJ, INT, HA 2/1)

The city of Chicago follows a number of other U.S. cities in calling for a ceasefire in Gaza. Some 70 cities in the U.S., including Atlanta, Minneapolis, Seattle, Detroit, and St. Louis, have passed resolutions on the Israeli attacks on Gaza with most calling for a ceasefire. The Nasser Hospital in Khan Yunis suffers a complete electricity blackout as it is besieged by Israeli forces for the fifth day in a row. The ICJ rules that there is a basis to further investigate the South African genocide case against Israel and that the ICJ has jurisdiction to hear the case. The court issues 6 provisional measures: 1) Israel must take all possible measures to prevent acts as outlined in Article 2 of the Genocide Convention, including not killing members of a particular group [Palestinians], not causing physical or psychological harm to members of that group, not inflicting living conditions which are calculated to bring about the end of the existence of a people, and not carrying out acts to precent the births within the group. 2) Israel must ensure its military does not carry out any of the actions outlined in measure 1. 3) Israel must prevent and punish incitement to commit genocide. 4) Israel must ensure the delivery of basic services and essential humanitarian aid. 5) Israel must prevent the destruction of evidence of war crimes and allow fact-finding missions access. 6) Israel must submit a report on all steps taken to abide by the measures within 1 month. 4 of the orders are approved by 15 of the 17 judges, while 2 of the measures are approved by 16 of the 17 judges. The only judge to vote against all measures is Judge Julia Sebutinde of Uganda. Aharon Barak, the judge representing Israel, votes for measures 3 and 4. The measures issued by the court fall short of South Africa’s demand for a ceasefire. Hamas welcomes the ICJ orders and calls on the international community to force Israel to implement the decisions. PA ambassador to the UN Riyad Mansour calls the measures against Israel “historic.” South Africa calls the ruling a “decisive victory.” Israeli prime minister Benjamin Netanyahu instructs his ministers not to comment on the ICJ decision and calls the ruling “outrageous.” The U.S. State Department says the ICJ did not “make a finding about genocide” despite the court specifically saying that it is continuing its trial of Israel on charges of genocide. Saudi Arabia, Iran, Malaysia, Qatar, Spain, Ireland, Scotland, Belgium, and the AU welcome the ICJ ruling. Turkey and Egypt express disappointment that the court did not call for a ceasefire. UNRWA announces an investigation and says it has terminated the contracts of the 9 of the staffers, with further investigations into 2 other staffers. 1 staff has been killed. The U.S., Germany, the Netherlands, Canada, Finland, Australia, Italy, and the UK say they have paused additional funding to UNRWA while they are reviewing the allegations and UN’s steps to address them. Hamas issues a report titled “Our Narrative” explaining Operation Al-Aqsa Flood, calling it a “natural response” to the Israeli attempts to kill the Palestinian cause. Among the reasons given for the attack are the Israeli settlement campaign, the Judaization of the West Bank and Jerusalem, and the killing of thousands of Palestinian civilians since 2000. Hamas rejects claims that it deliberately targeted civilians, pointing to reports in Israeli media that Israeli forces targeted cars and homes in Israel on 10/7, but acknowledges that some civilians may have been killed by Hamas militants by accident during its confrontation with Israeli forces. Prime Minister Netanyahu rejects a Hamas proposal to end the Israeli attacks. A UN Security Council resolution calling for ceasefire and the unconditional release of the Hamas-held captives was vetoed by the U.S., with the UK abstaining and the remaining 13 members voting in favor. Before the vote, PA UN envoy Riyad Mansour said the objective of the Israeli campaign was to ethnically cleanse Gaza, adding Israeli representatives were publicly admitting it. U.S. UN ambassador Robert Wood said the Hamas attack on 10/7 was the “worst attack on our people” in decades. The U.S. Senate failed to pass a $111 billion bill to provide $50 billion to Ukraine and $14 billion to Israel in a 49-51 vote. All Republicans and Democratic senators Bernie Sanders (D-VT) and Chuck Schumer (D-NY) voted against the bill. Republicans sought to separate the aid for Israel from the aid for Ukraine as many Republican senators are opposed to significant spending on Ukraine, while Sanders opposed spending on Israel given the Palestinian death toll in Gaza. Reuters reported that an “orientation note” circulated among EU foreign ministers ahead of a meeting showed the EU was considering tougher sanctions on Hamas and imposing sanctions against violent Israeli settlers. At least 7,000 people were missing in rubble, including 1,700 children. 234 Palestinians have been killed by Israeli forces and settlers in the West Bank and East Jerusalem since 10/7, including 58 children. More than 3,174 people have been injured. 30 Palestinians were released from Israeli prisons, 15 women and 15 children, on the fifth day of the prisoner exchange. 12 captives held in Gaza were released to Israel, including 10 Israeli women and 2 Thai nationals. Hundreds of Palestinians cheered the release of the captives, and members of both Hamas and Islamic Jihad were present during the handover to the Red Cross. Israel added 46 Palestinian prisoners to the list of people it is willing to exchange for Hamas-held captives, including 20 Palestinian citizens of Israel who had been arrested after 10/7 on charges of incitement. The Hadash party condemned the Israeli decision, saying it could serve as a justification for the Israeli government to revoke their citizenship. Hamas leader in Gaza Yahya Sinwar reportedly visited some of the Hamas-held captives on 10/8, telling them they would not be harmed. In the West Bank, armed Israeli settlers forced a Palestinian family to leave their home near Tuqu’, stealing furniture, solar panels, and water tanks. Israeli forces also shot and injured 2 Palestinians during a raid in Fahma. Elsewhere, Israeli forces demolished a Palestinian home in Shuqba. 52 Palestinians were arrested during late-night raids in and around Hebron, Nablus, Jenin, Bethlehem, Ramallah, and Tulkarm. In East Jerusalem, Israeli settlers toured the Haram al-Sharif compound. Israeli forces punitively demolished the family home in Silwan of a Palestinian killed by Israel forces who allegedly killed 7 Israelis in January. In Gaza, Israeli forces stormed al-Shifa Hospital, assaulting and detaining Palestinians seeking shelter there, holding them blindfolded and naked outside the hospital, demolishing walls, and opening fire inside the hospital. Israel also arrested al-Shifa’s only electric generator mechanic and the technician working on the oxygen stations. 50 people were killed in an airstrike on a mosque in al-Sabrah and 25 were killed in an Israeli airstrike on the Sheikh Radwan neighborhood of Gaza City. The number of fatalities was likely much higher since the Gaza Ministry of Health was unable to communicate with hospitals and civil defense members in northern Gaza. Jordan said Israel had injured 7 of its staff members at the Jordanian field hospital. Israel also blew up Gaza’s parliament building and hit the last functioning flour mill in Gaza in Deir al-Balah with an airstrike. The first shipment of fuel entered Gaza via the Rafah crossing; it was restricted to use for UN vehicles only. UN vehicles ran out of fuel again on 11/16 due to the low quantity of fuel delivered. 12 UN Security Council members voted for a resolution introduced by Malta calling for urgent, prolonged humanitarian ceasefires and unconditional release of the captives held by Hamas. The U.S., UK, and Russia abstained. A Russian amendment calling for a ceasefire was blocked by the U.S. PA UN envoy Riyad Mansour said the resolution fell short of condemning Israel for its attacks on Palestinian civilians, assaults on hospitals and schools, and the killing of UN staff, journalists, and doctors. U.S. president Joe Biden said at a press conference after a meeting with Chinese president Xi Jinping that it “would be a big mistake [for Israel] to reoccupy Gaza,” and that a “real” Palestinian state must be created to end the overall conflict. Biden also falsely claimed Israel was bringing incubators to al-Shifa Hospital, despite the hospital not needing incubators but rather fuel to power the incubators. 24 House Democrats urged President Biden to end “grave violations of children’s rights” by calling for an immediate ceasefire. Senator Chris Van Hollen (D-MD) called the Israeli refusal to allow fuel to be delivered to water desalination plants and generators at hospitals “inhumane.” Capitol police violently dispersed protesters blocking the entrance to the Democratic Party’s headquarters and calling for a ceasefire (AJ, HA 11/15; AJ 11/16)

In the UK parliament 56 out of 198 Labour Party members broke with the party line to vote in support of a ceasefire. The motion, which failed 293-125, was put forward by the Scottish National Party. A motion to expel the Israel ambassador and impose sanctions on Israel failed in the Irish parliament. The motion, which was denied in an 85-55 vote, was proposed by the Social Democrats party. (IN 11/15; HA 11/16)

The UN reported that over 1.4 million Palestinians, more than half the population in Gaza, have been displaced since 10/7 and that since 11 p.m. on 10/12 there has been a complete electricity blackout due to the Israeli blockade. As of 10/23, at least 27,781 housing units had been destroyed and 150,000 had been damaged in Israeli airstrikes since 10/7. At least 45% of all housing units have been either destroyed or damaged in Israeli airstrikes. UNRWA said 10 of its staff have been killed in the past 3 days, bringing the total number of UNRWA staff killed by Israel to 63. 26 trucks carrying aid to Gaza entered via the Rafah crossing. The WHO said it had not been able to resupply al-Shifa and al-Quds hospitals because of the risk of Israeli airstrikes. A draft document written by the Israeli Ministry of Intelligence said Israel may try to forcefully displace Palestinians in Gaza to Egypt. 2 other options in the document included that Israel hands control of Gaza to the PA or that is establish “local Arab rule” by Palestinians in Gaza. The Israeli High Court of Justice denied a petition by 3 Israeli organizations to remove a temporary order allowing worsening conditions for Palestinian prisoners. The judges said “[t]he assessment of human rights violations in times of war is not comparable to such assessments in peaceful situations.” (HA 10/30)

At the UN Security Council, PA ambassador to the UN Riyad Mansour criticized the international community for not forcing Israel to stop its bombing of Gaza, saying “they are besieged and bombed with nowhere safe to go.” Israeli UN ambassador Gilad Erdan wore a yellow Star of David, resembling the markings forced on Jewish people by Nazi Germany, saying “Never Again.” Dani Dayan, the chairperson of the Israeli Holocaust Remembrance Center, Yad Vashem, said Erdan’s actions “disgraces both Holocaust victims and Israel.” UNRWA commissioner-general Phillippe Lazzarini told the Security Council that a ceasefire was a “matter of life and death for millions,” and charged Israel with collective punishment. In Gaza, an Israeli airstrike killed 471 Palestinians in al-Ahli Arab Hospital in Gaza City. The hospital, which was filled with patients and Palestinians seeking shelter from Israeli bombardment, had received evacuation warnings from Israel on 10/14, 10/15, and 10/16. The UN reported that over 1 million Palestinians have been displaced since 10/7 and that since 11 p.m. on 10/12 there has been a complete electricity blackout due to the Israeli blockade. At least 11,887 housing units have been destroyed in Israeli airstrikes since 10/7. The number is likely much higher as the latest data is from 10/14. The Palestinian civil defense team said that more than 1,000 Palestinians were under the rubble of buildings in Gaza. Israel attempted to deny that it killed hundreds of Palestinian civilians in an airstrike on al-Ahli Arab Hospital in Gaza, presenting a range of questionable evidence to put the blame on Islamic Jihad. Israeli government social media accounts published what it claimed to be evidence that it was a rocket misfire not an airstrike, but later deleted the videos when a New York Times journalist questioned the timing of the videos. Military spokesperson Daniel Hagari said “[a]ccording to our intelligence, Hamas checked reports and understood it was a Palestinian Islamic Jihad misfire, then launched a global media campaign to inflate numbers of casualties.” Israel has previously employed misinformation campaigns to deflect blame for atrocities, on occasion then taking responsibility long after the event, as in the case of the killing of Shireen Abu Akleh. A UK Channel 4 investigation said evidence presented by Israel was both likely fabricated and contradictory, but did not reach a conclusion regarding the origin of the blast. Israeli president Isaac Herzog called reports that Israel conducted the airstrike “21st century blood libel.” Many Western leaders called for an investigation or referred to the loss of life without condemning the perpetrators. Leaders in the Middle East were unequivocal in their condemnation of the Israeli airstrike. Israeli military spokesperson Richard Hecht said Israel may not use the same “level of fidelity” in warning civilians before striking homes and apartment buildings. It had been reported that Israel no longer used smaller munitions to “knock” on the roofs of apartment buildings or call building managers before demolishing them with larger bombs. Hecht also called the parliament and ministries in Gaza legitimate targets. U.S. president Joe Biden gave a televised speech calling the Hamas operation on 10/7 “pure, unadulterated evil,” recounting unconfirmed Israeli narratives of militants committing rapes. Biden also compared Hamas to ISIS, attributed the operation to anti-Semitism, rather than resistance, and reiterated his stance in support of Israel, saying Israel has a “duty to respond,” despite the mass civilian casualties in Gaza. Biden further stated that the U.S. is sending ammunition and interceptors for the Iron dome to Israel. Lastly, Biden warned other countries and organizations against getting involved against Israel. Hamas called Biden’s speech deplorable and inflammatory, saying Hamas launched its operation to defend the Palestinian people and put an end to the occupation. Biden also spoke with Prime Minister Netanyahu about U.S. assistance. 392 members of the U.S. House of Representatives co-sponsored a resolution in support of Israel, calling the Hamas operation “barbaric.” It is unknown if the resolution will pass, as it is unclear if the acting speaker of the House Patrick McHenry (R-NC) has the authority to bring the resolution to the floor. Palestinian militants fired rockets at Israel and attacked Israelis on the ground near the Gaza fence, resulting in hundreds of casualties and causing damage. PA president Mahmoud Abbas addressed the UN General Assembly at its annual meeting, warning that peace in the region is impossible without the “Palestinian people enjoying full legitimate and national rights.” Abbas criticized world leaders for not holding Israel accountable for its atrocities and called on UN members to recognize the State of Palestine. It was reported that Palestinian officials had trouble getting meetings for Abbas on the sidelines of the UN General Assembly due to the publication on 9/7 of Abbas’ remarks at the Fatah Revolutionary Council in August that were said to be anti-Semitic. PA ambassador to the UN Riyad Mansour said in an interview that the Palestinian leadership is confident that Saudi Arabia would protect Palestinian interests in a potential normalization deal with Israel and that the Saudis have accepted the Palestinian position on the negotiations, including restarting peace talks and protecting Palestinians’ right to self-determination. Haaretz reported that the Palestinian demands includes a settlement freeze, expanding Areas B and C, full membership at the UN, reopening the PLO office in Washington, and reopening the U.S. consulate in East Jerusalem. The UN Security Council issued a presidential statement expressing “deep concern and dismay” over Israel’s 2/12 announcement to legalize settlement outposts and expand settlements by more than 10,000 housing units. The U.S. supported the statement which was made in lieu of a vote on a draft resolution calling on Israel to halt settlement activity. It was reported on 2/19 that the U.S. had convinced the UAE and the PA to drop the binding resolution, which the U.S. said it would veto, and instead present the statement. Israeli prime minister Benjamin Netanyahu announces that his government does not intend to renew the mandate of the Temporary International Presence in Hebron (TIPH), an international civilian group that has been monitoring “efforts to maintain normal life” in Hebron since it was established as part of the Hebron Protocol in 1997. The TIPH’s mandate, which has been renewed every 6 months since then, is set to expire on 1/31.
