Israeli forces block the delivery of oxygen cylinders to al-Amal Hospital, resulting in the deaths of 3 patients. Al Jazeera reports that around 100 bodies are retrieved from Tel al-Hawa and Rimal in Gaza City after Israeli forces withdraw, most are killed with live ammunition. 2 Israeli soldiers are killed in combat. U.S. president Joe Biden speaks to Israeli prime minister Benjamin Netanyahu, discussing Israel’s planned invasion of Rafah. According to the U.S. readout of the conversation, Biden said Israel should not proceed without “a credible and executable plan to ensure the safety of and support for more than one million people sheltering there.” Biden also stress the need to capitalize on the ceasefire negotiations. Netanyahu tells the Israeli cabinet that Israel will remain in control of security in all the lands between the Jordan river and the Mediterranean. Axios reports that Biden pressed Netanyahu to agree to release more Palestinian prisoners than in the previous exchange to meet some of Hamas’s demands. The body of 6-year-old Palestinian Hind Rajab is found dead in Gaza City after she is killed by Israeli forces along with several members of her family on 1/30. Rajab’s call for help was widely circulated on social media. 2 medics trying to rescue Rajab were also killed after Israeli forces blew up their ambulance. Israel’s military claims that Hamas had a tunnel network and a communications center underneath the UNRWA headquarters in Gaza City. UNRWA commissioner-general Philippe Lazzarini says UNRWA staff fled the headquarters on 10/12/2023 and have not been back since but says the agency conducted an inspection of the premises in September 2023 and did not find anything suspicious. National Security Council spokesperson John Kirby says Israel moving its troops to Rafah “without due consideration for their [Palestinians sheltering there] safety would be a disaster and we would not support it.” President Joe Biden issues a memorandum saying countries receiving U.S. military aid must assure the U.S. that they are adhering to international law and requiring the state and defense departments to send a report to Congress within 90 days on the use of U.S.-supplied weapons. Biden also says in a speech that Israel’s response in Gaza has been “over the top,” and that innocent people in Gaza are “starving, in trouble and dying. Details of Hamas’s counterproposal to the Israeli, U.S., Qatari, and Egyptian ceasefire proposal are unveiled. The Hamas proposal includes 3 stages of 45 days. In the first stage, Israel and Hamas would exchange the remaining female, child, and elderly Israeli captives for 1,500 Palestinian prisoners, see 500 trucks of aid enter Gaza daily, allow Palestinians to return to their homes in Gaza, allow the entry of 60,000 temporary homes and 200,000 tents, and stop Israeli settlers from entering the Haram al-Sharif compound. In the second stage, male captives would be exchanged for more Palestinian prisoners. In the third phase, the bodies of those killed would be exchanged. The proposal also calls for securing the reconstruction of Gaza and the complete withdrawal of Israeli forces. Hamas political bureau member Mohammad Nazzal says the Hamas proposal has clear deadlines which the original proposal lacked, that Qatar, Egypt, Russia, Turkey, and the UN will be guarantors for maintaining the ceasefire, and that the proposal is final. U.S. secretary of state Antony Blinken meets with PA president Mahmoud Abbas in Ramallah, discussing negotiations for a ceasefire in Gaza, Israel’s withholding of PA tax funds, and settler violence. Abbas also expresses the importance of the U.S. recognizing the state of Palestine. Blinken also meets with Prime Minister Netanyahu, military Chief of Staff Herzi Halevi, Defense Minister Yoav Gallant, and President Issac Herzog. The Israeli Broadcasting Corporation reports that Netanyahu promises Blinken that Israel will not invade Egypt at the Philadelphi Corridor without coordination with Egypt. Blinken says at a press conference that Hamas will not play a role in the future governance of Gaza, that the death toll in Gaza remains too high, and that Israel should open the Beit Hanun (Erez) crossing to allow more aid to enter Gaza. Blinken also says that the Hamas response to the ceasefire deal has “clear non-starters,” but that he thinks there is space for an agreement to be reached. The ICJ rules that there is a basis to further investigate the South African genocide case against Israel and that the ICJ has jurisdiction to hear the case. The court issues 6 provisional measures: 1) Israel must take all possible measures to prevent acts as outlined in Article 2 of the Genocide Convention, including not killing members of a particular group [Palestinians], not causing physical or psychological harm to members of that group, not inflicting living conditions which are calculated to bring about the end of the existence of a people, and not carrying out acts to precent the births within the group. 2) Israel must ensure its military does not carry out any of the actions outlined in measure 1. 3) Israel must prevent and punish incitement to commit genocide. 4) Israel must ensure the delivery of basic services and essential humanitarian aid. 5) Israel must prevent the destruction of evidence of war crimes and allow fact-finding missions access. 6) Israel must submit a report on all steps taken to abide by the measures within 1 month. 4 of the orders are approved by 15 of the 17 judges, while 2 of the measures are approved by 16 of the 17 judges. The only judge to vote against all measures is Judge Julia Sebutinde of Uganda. Aharon Barak, the judge representing Israel, votes for measures 3 and 4. The measures issued by the court fall short of South Africa’s demand for a ceasefire. Hamas welcomes the ICJ orders and calls on the international community to force Israel to implement the decisions. PA ambassador to the UN Riyad Mansour calls the measures against Israel “historic.” South Africa calls the ruling a “decisive victory.” Israeli prime minister Benjamin Netanyahu instructs his ministers not to comment on the ICJ decision and calls the ruling “outrageous.” The U.S. State Department says the ICJ did not “make a finding about genocide” despite the court specifically saying that it is continuing its trial of Israel on charges of genocide.
