Haaretz reports that Israeli commanders have instructed soldiers to set fire to Palestinian homes in Gaza and that in the past months hundreds of homes have been destroyed by Israeli soldiers setting fire to them. A photo of a note left behind by Israeli soldiers reads “[w]e are not burning the house so you can enjoy it, and when you leave – you will know what to do.” (HA 1/31)

Haaretz also reports that in the aftermath of 10/7/2023, Zaka community emergency response volunteers staged scenes in Israeli villages that were attacked to attract donations for the organization instead of properly handling bodies of deceased Israelis and spread accounts of atrocities that never happened to garner media attention. The Israeli military decided from 10/7/2023 to let Zaka handle the bodies of the dead instead of using its unit trained in the identification and collection of human remains. (HA 1/31)

A federal judge in Oakland, California, dismisses a lawsuit brought by Palestinian Americans seeking to end U.S. support for Israel’s campaign in Gaza on the basis of genocide, saying he would have issued an injunction but is legally not able to do so due to a lack of jurisdiction. The judge, Jeffrey White, instead implores the Biden administration to “examine the results of their unflagging support” of Israel on the basis that “it is plausible that Israel’s conduct amounts to genocide.” (NYT 1/31; AJ, INT, HA 2/1)

The city of Chicago follows a number of other U.S. cities in calling for a ceasefire in Gaza. U.S. intelligence agencies release a declassified report saying that they believe the Israeli assessment that Hamas and Islamic Jihad used parts of al-Shifa Hospital to operate against Israel was at least partially correct but that captives were moved before Israel stormed the hospital. The New York Times notes that U.S. officials did not provide any visual evidence to back up the assessment. The PA foreign ministry said Israel was preventing sufficient aid from entering Gaza, deliberately depriving Palestinians of their basic needs. UNRWA commissioner-general Philippe Lazzarini said Israel was “creating a stream of baseless misinformation” about UNRWA’s responsibility for the lack of aid deliveries to Gaza, saying it is Israel that is impeding aid deliveries. Israeli finance minister Bezalel Smotrich said Israel will not transfer the PA its tax revenue while he is finance minister. It has been reported that U.S. president Joe Biden told Prime Minister Benjamin Netanyahu that Israel should hand over the withheld PA funds to Norway, which will keep them until an arrangement is made to safeguard against the funds going to Hamas, a proposal Netanyahu made himself and that the PA reportedly accepted. South Africa invoked the Genocide Convention calling on the International Court of Justice (ICJ) to expedite hearings on the issue of Israel committing genocide and to order Israel to immediately stop the killing of Palestinians in Gaza. In its report delivered to the ICJ, South Africa described Israel’s actions as “genocidal in character because they are intended to bring about the destruction of a substantial part of the Palestinian national, racial, and ethnical group.” The Israeli Foreign Ministry called the South African action “blood libel.” The PA welcomed the South African action. In the first stage of the plan, all civilian captives would be released over a 7 to 10 day ceasefire period where Palestinian prisoners would also be released. The second stage would see all female soldiers released in exchange for Palestinian prisoners over a weeklong period. Israeli videos of dozens of Palestinian men being stripped to their underwear, forced to sit on the ground, and taken by Israeli forces to a large hole dug in the ground circulated in Israeli media and on social media. What happened to the men, who were taken from UN schools in Beit Lahiya, remained unknown as some of them were identified as civilians, including journalists, doctors, and academics. Hamas condemned the Israeli action, calling it revenge for Israel’s failed invasion and calling on human rights organizations to intervene. Human Rights Watch and Amnesty International said their investigation into the Israeli killing of Lebanese Reuters journalist Issam Abdallah on 10/13 revealed the killing was likely deliberate and should be investigated as a war crime. A +972 Magazine and Local Call investigation based on interviews with 7 current and former members of the Israeli intelligence community, Palestinian testimonies, data, and documentation from Gaza revealed that Israel had increased its attacks on what it calls “power targets,” which include private buildings, infrastructure, and high-rise blocks, to create a shock effect among civilians. According to the sources, the goal of bombing these civilian targets is to “lead civilians to put pressure on Hamas.” Several sources also said Israel has files that show its assessment of how many civilians will be killed in the bombing of these civilian targets. A source told the 2 publications that Israel had increased its permitted “collateral damage” from dozens when targeting a Hamas commander to hundreds and that Israel is fully aware how many civilians will be killed in its attacks. The sources also revealed that Israel use AI-based systems, such as Habsora, to identify targets, including the suspected homes of junior members of Hamas and Islamic Jihad. The New York Times reported that Israeli military and intelligence officers knew of Hamas’ plans for Operation Al-Aqsa Flood but dismissed the attack as aspirational. Israeli forces continued their large-scale raid of Jenin, fatally shooting 4 people, including 2 children aged 8 and 15, and Mohammad Zubeidi, the son of prominent Islamic Jihad member Zakaria Zubeidi. Israeli airstrikes in the city destroyed a home and a vehicle while Israeli bulldozers tore up pavements, electric poles, and water and sewage pipes. Hamas said it was working very hard to extend the ceasefire, which ends on 11/30. Hundreds of Palestinians cheered the release of the captives, and members of both Hamas and Islamic Jihad were present during the handover to the Red Cross. Israel added 46 Palestinian prisoners to the list of people it is willing to exchange for Hamas-held captives, including 20 Palestinian citizens of Israel who had been arrested after 10/7 on charges of incitement. The Hadash party condemned the Israeli decision, saying it could serve as a justification for the Israeli government to revoke their citizenship. Hamas leader in Gaza Yahya Sinwar reportedly visited some of the Hamas-held captives on 10/8, telling them they would not be harmed. In the West Bank, Israeli forces raided Tulkarm refugee camp, killing 6 Palestinians and injuring 3 in a drone strike, uprooted streets, and put 2 hospitals under siege. Israeli forces also shot and killed 2 Palestinians, including a child, during raids in ‘Azzun and Burin. Elsewhere, Israeli forces shot and injured a Palestinian in Beitunia. Israeli forces also notified a Palestinian landowner that it will seize 2.5 dunams (.62 acres) of his land in Beit Dajan to construct a settler road. Meanwhile, Israeli forces demolished 6 residential structures and 1 agricultural structure in Shaab al-Butum in the Masafer Yatta area, displacing 20 people. 38 Palestinians were arrested during late-night raids in Bethlehem, Ramallah, Qalqilya, and Tubas. In Gaza, Israeli forces attacked Khan Yunis, Gaza City, Nuseirat refugee camp, Jabalia refugee camp, and the Indonesian and Kamal Adwan hospitals, killing at least 80 people. The number of fatalities was likely much higher given the lack of communication with hospitals and civil defense members in northern Gaza. 3 premature babies died at the Kamal Adwan Hospital due to the incubators failing as a result of a lack of fuel. The administration at the Indonesian Hospital said it had been ordered by Israel to evacuate the hospital. 14 ambulances arrived at al-Shifa Hospital to start evacuating the 250 remaining patients. Israel and Hamas agreed to the terms of a 4-day ceasefire that would see 50 women and children held in Gaza released in exchange for 150 Palestinian women and children being released from Israeli prisons. The start of the ceasefire would be announced within 24 hours, awaiting the Israeli High Court of Justice’s consideration of Israeli public appeals against the deal. The ceasefire could be extended for one additional day for every 10 additional captives released from Gaza. There are about 240 captives held by Hamas and Islamic Jihad. Biden also spoke with Prime Minister Netanyahu, emphasizing the “importance of maintaining calm along the Lebanese border as well as in the West Bank,” according to the U.S. readout of their conversation. Hamas said it had agreed to the terms of the first prisoner exchange and temporary ceasefire. Islamic Jihad said it was coordinating with Hamas on the prisoner exchange deal. The Israeli war, security, and government cabinets convened in separate meetings in the evening to discuss the deal. Prime Minister Benjamin Netanyahu said the deal was likely to happen, despite opposition from National Security Minister Itamar Ben-Gvir and Finance Minister Bezalel Smotrich, and that Israel would continue its war on Gaza after the temporary ceasefire. The meeting of the government cabinet was still ongoing at the end of the day. It was reported by Haaretz that the Israeli public would have 24 hours to appeal to the Israeli High Court of Justice if the government decides to approve the deal. U.S. national security council spokesperson John Kirby said the U.S. would not support Israeli military action in southern Gaza unless it “clearly articulated [a] plan for how they are going to protect the lives of the hundreds of thousands of people that have now added to the population because they were asked to leave by the Israelis.” Kirby also said that the Biden administration was considering redesignating the Yemeni Houthi government a terrorist organization, citing its attacks on Israel and the seizure of an alleged Israeli-linked vessel on 11/19. Pentagon deputy press secretary Sabrina Singh said the U.S. continued to supply Israel with “155 mm rounds, precision-guided munitions, and air defense systems.” Politico reported that the U.S. had sent Israel the coordinates for humanitarian sites, including hospitals, and gave Israel information about the movement of aid groups to avoid Israeli attacks on protected groups. Israeli military spokesperson Daniel Hagari said, “because of Hamas’s use of hospitals for military purposes, [the hospitals] will lose special protection in the international court.” Israel has presented animations, pictures of purported tunnels, and a video from al-Rantisi Children’s Hospital that it said was proof of Hamas’s presence at hospitals, all of which did not show any evidence to back Israel’s claim. In the video from al-Rantisi Children’s Hospital, Israel showed a piece of paper hanging on the wall that it claimed was a list of Hamas militants’ names. However, the list was merely a calendar with the names of the days of the week written in Arabic. The U.S. said it had intelligence that suggested a Hamas and Islamic Jihad presence at hospitals in Gaza, including al-Shifa. A U.S. national security council spokesperson said “[w]e do not support striking a hospital from the air and we don’t want to see a firefight in a hospital where innocent people, helpless people, sick people trying to get medical care they deserve are caught in crossfire.” Hamas called for the UN to inspect all hospitals in Gaza to debunk the Israeli and U.S. claims. Doctors at al-Shifa also rejected the claim that Palestinian militants were operating in the hospital. Israeli finance minister Bezalel Smotrich said he welcomed “the initiative of members of Knesset Ram Ben-Barak and Danny Danon on the voluntary immigration of Gaza Arabs to countries around the world. This is the right humanitarian solution for the residents of Gaza and the entire region.” Smotrich was referencing an op-ed written by Ben-Barak and Danon that was published in the Wall Street Journal on 11/13. Since Israel has banned large anti-war protests, Barakeh said he had told Nazereth police that he and 40 others would rally together, leading to his arrest. Protesters later demonstrated against the arrests of the Palestinian leaders outside of a police station in Tel Aviv; 15 were arrested. During a speech at an aid conference in Paris, PA prime minister Mohammad Shtayyeh said that Hamas could not be eliminated because it is not just a military organization but “also an idea.” Shtayyeh also said Israel was waging war against all Palestinians, violating international law. French president Emmanuel Macron, who hosted the conference, said civilians in Gaza must be protected, calling for humanitarian pauses and for countries to work on a ceasefire. Egyptian foreign minister Sameh Shoukry complained that the international community has an “imbalance” in its conscience when it ignores Israeli violations of international law. In Gaza, an Israeli airstrike killed 471 Palestinians in al-Ahli Arab Hospital in Gaza City. The hospital, which was filled with patients and Palestinians seeking shelter from Israeli bombardment, had received evacuation warnings from Israel on 10/14, 10/15, and 10/16. Israel claimed it was an errant rocket fired by Hamas that caused the mass casualties, however all evidence presented by Israel was debunked in subsequent investigations. Other Israeli airstrikes killed around 200 Palestinians, mostly in Rafah and Khan Yunis. Israel also assassinated the head of Hamas’ Shura Council Osama Mazini, who led negotiations on the prisoner exchange that saw Gilad Shalit transferred to Israel in exchange for 1,000 Palestinian prisoners in 2011, and Hamas commanders Muhammad Alwadia, Ayman Nofal, and Akram Hijaz. Israeli forces shot and killed 2 Palestinians, including a minor, during raids in Halhul and Nabi Salih. An elderly Palestinian succumbed to injuries sustained from Israeli forces on 10/13 in Nablus. The Palestinian civil defense team said that more than 1,000 Palestinians were under the rubble of buildings in Gaza. Israel attempted to deny that it killed hundreds of Palestinian civilians in an airstrike on al-Ahli Arab Hospital in Gaza, presenting a range of questionable evidence to put the blame on Islamic Jihad. Israeli government social media accounts published what it claimed to be evidence that it was a rocket misfire not an airstrike, but later deleted the videos when a New York Times journalist questioned the timing of the videos. Military spokesperson Daniel Hagari said “[a]ccording to our intelligence, Hamas checked reports and understood it was a Palestinian Islamic Jihad misfire, then launched a global media campaign to inflate numbers of casualties.” Israel has previously employed misinformation campaigns to deflect blame for atrocities, on occasion then taking responsibility long after the event, as in the case of the killing of Shireen Abu Akleh. A UK Channel 4 investigation said evidence presented by Israel was both likely fabricated and contradictory, but did not reach a conclusion regarding the origin of the blast. Israeli president Isaac Herzog called reports that Israel conducted the airstrike “21st century blood libel.” Many Western leaders called for an investigation or referred to the loss of life without condemning the perpetrators. Leaders in the Middle East were unequivocal in their condemnation of the Israeli airstrike. Hamas’ Izzeddin al-Qassam Brigades spokesperson Abu Obaida said the Qassem Brigades would not negotiate the release of captives while Gaza was being bombarded. There was no indication that the threat was carried out as civilian buildings were being bombed by Israel. Hamas official Moussa Abu Marzouk told Al Jazeera that Hamas is open to discussing a truce and all political dialogue. Hamas political leader Ismail Haniyeh said Hamas had warned Israel about damaging al-Aqsa Mosque, continued settlement expansion, and raids on Palestinian cities and towns, but that Israel had ignored its warnings. Haniyeh further stated, “Israel could have silenced us by giving us crumbs, but the government turned its back on any possibility of a prisoner exchange and continued the siege of the strip.” Islamic Jihad spokesperson Dauod Shihab said Israeli captives would only be released in a prisoner exchange, adding the organization had taken women and children captives because Israel does the same. Israeli settlers also threatened Palestinians living in the Tuqu’ area that if they do not leave they will continue to experience attacks by the settlers.
