The Israeli High Court of Justice ruled to evict Israeli settlers who had been occupying Palestinian-owned land for 30 years in the Jordan Valley. The court accepted a petition by 20 Palestinian landowners filed 5 years ago but gave the settlers 7 years to leave the 1,000 dunams (250 acres) of land which was planted with date-bearing palms. The judge wrote in her ruling that the settlers’ cultivation of the land was done in violation “of international law, but also in violation of the government’s declared policy and even contrary to halakhic law.” (HA 11/9)

PA foreign minister Riyad al-Maliki filed a complaint to the International Atomic Energy Agency over Israeli heritage minister Amichai Eliyahu’s comment that Israel could drop a nuclear bomb on Gaza, calling the comment the “prevailing discourse in Israel” and “an official recognition that Israel possesses nuclear weapons and weapons of mass destruction.” PA president Mahmoud Abbas spoke with Dutch prime minister Mark Rutte, who invited Abbas to the Netherlands. Hamas deputy political leader Saleh al-Arouri condemned the U.S. for supporting the continuation of the war on Gaza while encouraging humanitarian pauses and called on Arab states that have normalized relations with Israel to sever political and economic ties. The New York Times reported that Israeli officials have been pushing other countries to lobby Egypt to allow Israel to displace Palestinians to the Sinai. The Times also reported that U.S. officials overseeing arms transfers to foreign countries will approve the sale of 24,000 assault rifles to Israel, despite concerns that some of the rifles will be handed out to settlers and civilian militias in Israel. Israeli national security minister Itamar Ben-Gvir has handed out weapons to settlers and promised more will arrive. Axios reported on 11/6 that the Biden administration, the Senate Foreign Relations Committee, and the House Foreign Affairs Committee have approved the Israeli purchase of M16 rifles from U.S. companies on the condition that they would not be handed to civilians in Israeli settlements in the West Bank. Al Jazeera reported that Arafat Hamdan, who died in Israeli custody on 10/24, died because he was beaten and left in the sun with a bag over his head for hours while being refused his diabetes medicine. For the first time U.S. president Joe Biden called for a “pause” to “get the prisoners out.” White House press secretary Katrine Jean-Pierre announced that the Biden administration will develop a national strategy to counter Islamophobia in the U.S., mentioning the “barbaric killing of Wadea al-Fayoume” a Palestinian American child who was killed by his landlord near Chicago on 10/15. The U.S. House of Representatives blocked a motion to censure Democrat Rashida Tlaib (D-MI). The motion, which was brought to the floor by Marjorie Taylor Greene (R-GA), charged Tlaib with “anti-Semitic activity” and “leading an insurrection,” referring to a Jewish-led sit-in at the Capitol where protestors demanded a ceasefire in Gaza. Taylor Greene has herself made anti-Semitic comments. 23 Republicans voted against the motion and 13 Democrats abstained. National Security Council spokesperson John Kirby said the U.S. still wants to move forward with its efforts to normalize ties between Saudi Arabia and Israel and claimed that Saudi Arabia has indicated a willingness to proceed. The Knesset approved temporary legislation to allow Israeli prisons to admit new inmates beyond their legal capacity, allowing worsening conditions for Palestinian prisoners, including reducing living spaces and forcing prisoners to sleep on mattresses on the floor. The bill will be in effect for 3 months. Israel prisons have received 500 new Palestinian prisoners since 10/7, including 118 who crossed from Gaza to Israel in relation to Operation Al-Aqsa Flood. The Israeli High Court of Justice ruled in 2017 that prisoners must be given at least 37.7 square feet of space. U.S. president Joe Biden landed in Israel for meetings with Israeli prime minister Benjamin Netanyahu, President Isaac Herzog, and the war cabinet. Biden was supposed to travel to Amman for meetings with President Abbas, Jordanian king Abdullah II, and Egyptian president Abdel-Fattah el-Sisi, but the meetings were cancelled by the 3 leaders after Israel bombed al-Ahli Arab Hospital in Gaza, killing 471 people. Biden told Netanyahu during a meeting that “it appears as though it was done by the other team, not you” in reference to the hospital bombing. Biden cautioned Israel not to be consumed by rage, saying the U.S. made mistakes after 9/11. Biden also announced $100 million in humanitarian aid to Palestinians as the Senate was working on passing a bill providing $10 billion in extra military aid to Israel. Biden said aid to Gaza could start arriving on 10/20, as Egypt needs to “patch the road” to the crossing. Senator Bernie Sanders (D-VT) blocked an attempt by Senator Rick Scott (R-FL) to prevent the Biden administration from dispersing the $100 million in aid to Palestinians. 33 Democratic senators urged Secretary of State Antony Blinken to lead efforts to provide humanitarian aid to Gaza. Around 300 Jewish Americans were arrested at the U.S. Capitol while protesting Israel’s war in Gaza. The protest was arranged by Jewish Voice for Peace. After President Biden’s meeting with Prime Minister Netanyahu, Netanyahu’s office released a statement saying that Israel will not allow aid from its territory to enter Gaza until the captives are returned. The statement also said Israel demands that the Red Cross be able to visit the captives and that Israel will not “thwart” humanitarian aid from Egypt as long as it only consists of food, water, and medicine. President el-Sisi said during a press conference with German chancellor Olaf Schulz that Israel could allow Palestinians in Gaza to stay in the Naqab desert until Israel can “do what they wish to do with the militant operatives in the Gaza Strip.” El-Sisi also spoke with President Biden about aid coming through the Rafah crossing. Saudi foreign minister Faisal bin Farhan met with his Iranian counterpart Hossein Amir-Abdollahian in the sidelines of an OIC meeting in Jeddah, discussing the situation in Gaza. Amir-Abdollahian called on the OIC members to sanction Israel and expel Israeli ambassadors. The OIC called for an immediate ceasefire and for Israel to lift the siege of Gaza. The hospital, which was filled with patients and Palestinians seeking shelter from Israeli bombardment, had received evacuation warnings from Israel on 10/14, 10/15, and 10/16. Israel claimed it was an errant rocket fired by Hamas that caused the mass casualties, however all evidence presented by Israel was debunked in subsequent investigations. Other Israeli airstrikes killed around 200 Palestinians, mostly in Rafah and Khan Yunis. Israel also assassinated the head of Hamas’ Shura Council Osama Mazini, who led negotiations on the prisoner exchange that saw Gilad Shalit transferred to Israel in exchange for 1,000 Palestinian prisoners in 2011, and Hamas commanders Muhammad Alwadia, Ayman Nofal, and Akram Hijaz. In the West Bank, there were large demonstrations against the PA and the Israeli bombing of the al-Ahli Arab Hospital throughout the West Bank, with PA forces violently dispersing Palestinian protesters, killing a 12-year-old girl in Jenin with live ammunition, and injuring many others with tear gas. In East Jerusalem, Israeli settlers toured the Haram al-Sharif compound. In Lebanon, Israeli forces attacked targets north of the Blue Line. A UK Channel 4 investigation said evidence presented by Israel was both likely fabricated and contradictory, but did not reach a conclusion regarding the origin of the blast. Hamas deputy political leader Salah al-Arouri called the operation a “preemptive strike” based on intelligence that Israel was planning to attack after the Sukkot holidays. Israeli military spokesperson Richard Hecht said Israel may not use the same “level of fidelity” in warning civilians before striking homes and apartment buildings. It had been reported that Israel no longer used smaller munitions to “knock” on the roofs of apartment buildings or call building managers before demolishing them with larger bombs. Hecht also called the parliament and ministries in Gaza legitimate targets. Hecht further said Palestinians in Gaza should flee to Egypt via the Rafah crossing, first saying that it is open and later tweeting that he did not know if it was open. U.S. president Joe Biden gave a televised speech calling the Hamas operation on 10/7 “pure, unadulterated evil,” recounting unconfirmed Israeli narratives of militants committing rapes. Biden also compared Hamas to ISIS, attributed the operation to anti-Semitism, rather than resistance, and reiterated his stance in support of Israel, saying Israel has a “duty to respond,” despite the mass civilian casualties in Gaza. Biden further stated that the U.S. is sending ammunition and interceptors for the Iron dome to Israel. Lastly, Biden warned other countries and organizations against getting involved against Israel. EU high commissioner for foreign affairs Josep Borell said he had invited PA and Israeli foreign ministers Riyad al-Maliki and Eli Cohen to an EU foreign ministers meeting to discuss the situation in Palestine and Israel. Borell also said that Israel must adhere to international law, saying Israel violates the law by imposing a total blockade on Gaza. Elsewhere, an Israeli settler attempted to ram Palestinians on a street in Tuqu’. Israeli settlers also threw stones at Palestinian vehicles traveling west of Jericho, causing damage. Israeli forces also shot and killed a Palestinian who allegedly attempted to ram soldiers at a checkpoint in Hebron using a tractor. Israeli forces also violently dispersed Palestinian protesters in al-Arroub refugee camp, killing a Palestinian and injuring 1 other with live ammunition. Elsewhere, Israeli forces violently dispersed a funeral procession in Beit Umar, killing 1 person and injuring 5 with live ammunition and others with baton rounds and tear gas. Hamas’ Izzeddin al-Qassam Brigades spokesperson Abu Obaida said the Qassem Brigades would not negotiate the release of captives while Gaza was being bombarded. Earlier in the day Abu Obaida said Qassam Brigades would begin executing 1 Israeli captive each time Israel bombs a civilian target. There was no indication that the threat was carried out as civilian buildings were being bombed by Israel. Hamas official Moussa Abu Marzouk told Al Jazeera that Hamas is open to discussing a truce and all political dialogue. PA president Mahmoud Abbas spoke to Turkish president Recep Tayyip Erdoğan, UN secretary-general Antonio Guterres, and Saudi crown prince Mohammed bin Salman about the Hamas-Israel war. Reuters reported that Qatar was mediating a prisoner exchange that will see Israeli women and children released by Hamas in exchange for the release of 36 Palestinian women and children from Israeli prisons. Egyptian sources also said that Egypt was in close contact with Israel and Hamas to prevent further escalation, calling on Israel to exercise restraint and Hamas to keep the captives in good condition. Israeli defense minister Yoav Gallant said that he had ordered that no power, water, food, or gas enters Gaza, saying “[w]e are fighting human animals and we act accordingly.” His office later said Gallant had ordered the intensity of the Gaza bombings to increase. Several Israeli politicians called for the formation of an emergency unity government, including Finance Minister Bezalel Smotrich, who said the emergency government should “bring about the complete elimination of Hamas and the terrorist organizations in Gaza.” Benny Gantz’s National Unity party demanded that Smotrich and National Security Minister Itamar Ben-Gvir not be part of the war cabinet and that no legislation unrelated to the war would be promoted. Axios reported that Israeli prime minister Netanyahu told U.S. president Joe Biden that Israel will invade Gaza. The Washington Post reported that the U.S. is preparing for a prolonged war in Gaza and is assessing Israeli diplomatic, political, and military needs. The White House briefed members of Congress that Israel will need replenishment for the Iron Dome, ammunition rounds, precision-guided missiles, and small-diameter bombs. Biden said in a briefing that 11 U.S. citizens have been killed by Hamas and that there likely are U.S. captives being held in Gaza. The U.S. also said Iran was complicit in the Hamas attack and warned Iran about getting involved in the fighting. Iran denied any involvement or knowledge. The EU, Germany, and Austria said they suspended all aid to Palestinians in response to Hamas’ operation in Israel. None of the aid in question is delivered to Hamas. National Unity Party leader Benny Gantz met with U.S. national security advisor Jake Sullivan at the White House for a briefing on the Saudi-Israeli normalization deal negotiations. It was reported that the White House is seeking to have Gantz’s party and other opposition parties replace the Religious Zionist Party and the Jewish Power Party if Bezalel Smotrich and Itamar Ben-Gvir oppose concessions to Palestinians as part of the normalization deal. 20 U.S. senators wrote a letter to U.S. president Joe Biden urging his administration to preserve the option of a two-state solution in a potential Saudi-Israeli normalization deal. The senators said Israel should commit to not annexing any of the West Bank; halt settlement expansion; dismantle illegal settlements, including those retroactively legalized; allow natural growth in Palestinian towns and cities; and allow Palestinians to travel within the West Bank without interference. Haaretz reported that the Israeli Justice Ministry’s pardons department had approached the family of Mohammed Abu Khdeir, who was killed by 3 Israeli settlers in 2014, asking about the family’s stance on reducing the sentence of the 3, 2 of whom were sentenced to life in prison. Abu Khdeir’s father called the request “completely insane.” The 3 settlers abducted Abu Khdeir and burned him alive in forest near Jerusalem. (HA 9/28)

Israeli attorney general Gali Baharav-Miara approved usage of the NSO Pegasus spyware for wiretapping in the Israeli police investigation into the killing of a Palestinian family of 5 in Basmat Tab’un on 9/27. Saudi Arabia, Jordan, Egypt, the UAE, and the EU sponsored a conference called The Peace Day Effort to advance the two-state solution through political, economic, cultural, and security-oriented means. The conference was held in New York on the sidelines of the annual UN General Assembly meeting and attended by around 30 foreign ministers. China’s ambassador to the UN and U.S. deputy assistant secretary of state for Israeli-Palestinian affairs Andrew Miller also attended. Saudi foreign minister Prince Faisal bin Farhan Al Saud said before the conference that it was convened as “[p]eople have started to losing hope in a two-state solution” and that there can be no solution to the Palestinian-Israeli conflict without the establishment of a Palestinian state. Ahead of traveling to the U.S. for the annual UN General Assembly session Israeli prime minister Benjamin Netanyahu said that Israelis who protest his government’s judicial overhaul are aligning themselves with the PLO and Iran. The Prime Minister’s office later clarified, after backlash from the Israeli opposition and Jewish organizations in the U.S., that Netanyahu was criticizing that Israelis were protesting Israel at the same time as supporters of the PLO and BDS were and that they should also protest “those who deny the State of Israel’s right to exist.” Later in the day, Netanyahu met with Tesla, X, and Space X owner Elon Musk in Silicon Valley, defending Musk against charges of anti-Semitism brought by the Anti-Defamation League, among others. The Israeli foreign and defense ministries amended rules to allow U.S. citizens of Palestinian, Syrian, and Iranian background to enter Israel and Palestine through the Ben Gurion Airport and not have to undergo additional screening at an Israeli embassy. The changes were made to satisfy U.S. demands to admit Israel into the Visa Waiver program. PA president Mahmoud Abbas visited Jenin for the first time in 12 years, giving a speech in Jenin refugee camp. Abbas praised the steadfastness of the Jenin residents in light of Israel’s attacks. Israeli national security minister Itamar Ben-Gvir told Israeli settlers at the partly resettled Evyatar settlement outpost that the settlers should “[r]un to the hilltops” and build settlements “in all the hills around.” Ben-Gvir also called for the Israeli military to “launch a military operation, take down buildings and eliminate terrorists. U.S. national security adviser Jake Sullivan spoke with his Israeli counterpart Tzachi Hanegbi, expressing concern about Israeli settler attacks on Palestinian villages. Israeli finance minister and minister in charge of settlement policy at the Israeli Defense Ministry Bezalel Smotrich told members of his Religious Zionist Party that Khan al-Ahmar needs to be demolished because of its strategic location and not because it is unrecognized by Israel, as has been the official Israeli line so far. Israel informed the PA that about 1,000 Palestinians living in the Masafer Yatta area will receive eviction notices in the coming days and that they will be forcibly transferred to a different location. The Palestinian prisoner Nasser Abu Hamid died of cancer in an Israeli hospital while incarcerated on 7 life sentences. Abu Hamid was sentenced in 2002. The Palestinian Prisoners’ Administration said Abu Hamid died due to Israeli medical neglect. The PA called for a day of mourning and condemned Israel’s decision to hold Abu Hamid’s body for future negotiations. The UN special political and decolonization committee approved draft resolution A/C.4/77/L.12/REV.1 requesting the International Court of Justice give its opinion on the legal status of the Israeli occupation of Palestine since 1967. The resolution will go to the UNGA for a vote. The draft resolution passed 98-17 with 52 countries abstaining. Notably, Ukraine voted for the draft resolution and the UK abstained. The U.S., Israel, Australia, Austria, Canada, the Czech Republic, Hungary, and Italy were among the countries to vote against. According to Israel’s ambassador to the UN Gilad Erdan, Israel lobbied “dozens of countries that we have persuaded not to support” the draft resolution. 14 Palestinian factions, including Hamas and Fatah, signed an agreement in Algeria to hold Palestinian elections. The agreement comes after 2 days of meetings mediated by Algerian officials. At the meetings were Hamas chairman of the political bureau Ismail Haniyeh, Fatah member Azzam al-Ahmad, and PFLP secretary general Talal Naji. The agreement recognized the PLO as the sole representative for the Palestinian people and called for elections within 1 year. PA president Mahmoud Abbas met with Russian president Vladimir Putin in Kazakhstan.
