World Central Kitchen (WCK) suspends all operations in Gaza after 7 of its workers are killed in an Israeli airstrike (see above), returning 3 ships docked off the coast of Gaza carrying 240 tons of aid to Cyprus. The organization runs 68 community kitchens in Gaza and has sent some 1,700 truckloads of aid into Gaza. Several investigations into the Israeli bombing of the WCK aid convoy reveal that the 3 vehicles the aid workers were in were targeted in 3 strikes 1.5 miles apart. The 3 vehicles were clearly marked with WCK’s logo on the top of the cars. The Israeli narrative changes several times during the period after the attack, from saying an armed person was traveling with the vehicles to saying the clearly marked vehicles were misidentified. Prime Minister Benjamin Netanyahu calls the attack “unintended” and “tragic” and says “[t]hese things happen in wartime.” UN special rapporteur on the occupied Palestinian territories Francesca Albanese says the Israeli attack was a deliberate effort to starve the population of Gaza. PA president Mahmoud Abbas appoints the current chairperson of the Palestine Investment Fund and former deputy prime minister and minister of national economy, Mohammed Mustafa, as the new PA prime minister. Abbas says in a statement that he asked Mustafa to create a plan to re-unify the administration of Gaza and the West Bank, lead reforms in the PA government, security services, and economy, and fight corruption. The UN Security Council meets to discuss the situation in Rafah and an Algerian draft resolution calling for a ceasefire. Stephane Dujarric, spokesperson for the UN secretary-general, says the UN will not play a part in Israel’s plans for evacuation of Rafah, saying “there is no place that is currently safe in Gaza.” ICC chief prosecutor Karim Khan says he is deeply concerned about Israel’s plans in Rafah, adding “[a]ll wars have rules and the laws applicable to armed conflict cannot be interpreted so as to render them hollow or devoid of meaning.” Khan also says Israel has not changed its conduct in Gaza and “those who do not comply with the law should not complain later when my Office takes action pursuant to its mandate.” (AJ, HA, NYT 2/12; AJ, HA 2/13)

The U.S. Senate votes 70-29 to approve a bill which if approved by the House and President Biden would provide $95 billion in military aid to Ukraine, Taiwan, and Israel, including $14 billion to Israel, ban funding of UNRWA, and provide $9.15 billion in humanitarian assistance to civilians in conflict zones, including in Gaza and the West Bank. Biden calls on the House to immediately approve the Senate bill, which he says, “provides Israel with what it needs to protect its people against the terrorist groups like Hamas and Hezbollah and others.” Before voting in favor of the bill, Senator Chris Van Hollen (D-MD) says Israel is committing “textbook” war crimes in Gaza. Israeli videos of dozens of Palestinian men being stripped to their underwear, forced to sit on the ground, and taken by Israeli forces to a large hole dug in the ground circulated in Israeli media and on social media. What happened to the men, who were taken from UN schools in Beit Lahiya, remained unknown as some of them were identified as civilians, including journalists, doctors, and academics. Israeli soldiers continued their sieges of the Indonesian and al-Shifa hospitals; around 500 patients and staff were evacuated from the Indonesian Hospital to a hospital in Khan Yunis later in the day. Hamas said it had agreed to the terms of the first prisoner exchange and temporary ceasefire. Islamic Jihad said it was coordinating with Hamas on the prisoner exchange deal. The Israeli war, security, and government cabinets convened in separate meetings in the evening to discuss the deal. Prime Minister Benjamin Netanyahu said the deal was likely to happen, despite opposition from National Security Minister Itamar Ben-Gvir and Finance Minister Bezalel Smotrich, and that Israel would continue its war on Gaza after the temporary ceasefire. The meeting of the government cabinet was still ongoing at the end of the day. It was reported by Haaretz that the Israeli public would have 24 hours to appeal to the Israeli High Court of Justice if the government decides to approve the deal. U.S. national security council spokesperson John Kirby said the U.S. would not support Israeli military action in southern Gaza unless it “clearly articulated [a] plan for how they are going to protect the lives of the hundreds of thousands of people that have now added to the population because they were asked to leave by the Israelis.” Kirby also said that the Biden administration was considering redesignating the Yemeni Houthi government a terrorist organization, citing its attacks on Israel and the seizure of an alleged Israeli-linked vessel on 11/19. Pentagon deputy press secretary Sabrina Singh said the U.S. continued to supply Israel with “155 mm rounds, precision-guided munitions, and air defense systems.” Politico reported that the U.S. had sent Israel the coordinates for humanitarian sites, including hospitals, and gave Israel information about the movement of aid groups to avoid Israeli attacks on protected groups. The Israeli security cabinet decided to deduct funds from the PA tax revenue that is used in Gaza, in addition to the funds it deducts from the PA that are said to be used for paying stipends to the families of Palestinian prisoners and Palestinians killed by Israel. The cabinet also decided to no longer allow Palestinians from Gaza to work in Israel and to send those held in the Israeli internment camps back to Gaza. Interior Minister Moshe Arbel approved a memorandum making it easier for Israel to revoke the citizenship for people accused of supporting, inciting, or identifying with a terrorist organization. Arbel also transferred $50.4 million to 67 Palestinian municipalities in Israel after the funds had been frozen by Finance Minister Bezalel Smotrich since July. Israeli military chief of staff Herzl Halevi said Israel would allow fuel to enter Gaza to keep hospitals running. However, Prime Minister Netanyahu’s office rejected the move. The Knesset approved temporary legislation to allow Israeli prisons to admit new inmates beyond their legal capacity, allowing worsening conditions for Palestinian prisoners, including reducing living spaces and forcing prisoners to sleep on mattresses on the floor. The bill will be in effect for 3 months. Israel prisons have received 500 new Palestinian prisoners since 10/7, including 118 who crossed from Gaza to Israel in relation to Operation Al-Aqsa Flood. The Israeli High Court of Justice ruled in 2017 that prisoners must be given at least 37.7 square feet of space. Biden was supposed to travel to Amman for meetings with President Abbas, Jordanian king Abdullah II, and Egyptian president Abdel-Fattah el-Sisi, but the meetings were cancelled by the 3 leaders after Israel bombed al-Ahli Arab Hospital in Gaza, killing 471 people. Biden told Netanyahu during a meeting that “it appears as though it was done by the other team, not you” in reference to the hospital bombing. Biden cautioned Israel not to be consumed by rage, saying the U.S. made mistakes after 9/11. Biden also announced $100 million in humanitarian aid to Palestinians as the Senate was working on passing a bill providing $10 billion in extra military aid to Israel. Biden said aid to Gaza could start arriving on 10/20, as Egypt needs to “patch the road” to the crossing. Senator Bernie Sanders (D-VT) blocked an attempt by Senator Rick Scott (R-FL) to prevent the Biden administration from dispersing the $100 million in aid to Palestinians. 33 Democratic senators urged Secretary of State Antony Blinken to lead efforts to provide humanitarian aid to Gaza. Hamas deputy political leader Salah al-Arouri called the operation a “preemptive strike” based on intelligence that Israel was planning to attack after the Sukkot holidays. Al-Aruri also said it initially only took soldiers as captives but that the entry of armed civilians resulted in chaos and that many of the Israeli deaths were the result of Israeli actions, citing the Hannibal Directive that allows Israeli forces to kill Israelis rather than allow enemies to hold them captive. Hamas’ Izzeddin al-Qassam Brigades spokesperson Abu Obaida said the Qassem Brigades would not negotiate the release of captives while Gaza was being bombarded. Earlier in the day Abu Obaida said Qassam Brigades would begin executing 1 Israeli captive each time Israel bombs a civilian target. There was no indication that the threat was carried out as civilian buildings were being bombed by Israel. Hamas official Moussa Abu Marzouk told Al Jazeera that Hamas is open to discussing a truce and all political dialogue. The White House briefed members of Congress that Israel will need replenishment for the Iron Dome, ammunition rounds, precision-guided missiles, and small-diameter bombs. Biden said in a briefing that 11 U.S. citizens have been killed by Hamas and that there likely are U.S. captives being held in Gaza. The U.S. also said Iran was complicit in the Hamas attack and warned Iran about getting involved in the fighting. Iran denied any involvement or knowledge. Hamas launched Operation Al-Aqsa Flood, entering Israeli towns and villages near Gaza through the Gaza fence and by air, using improvised paramotoring gliders, attacking military equipment with explosive drones, and firing thousands of rockets. Palestinian militants took control of at least 14 Israeli bases, police stations, and towns, in addition to the Beit Hanun (Erez) crossing, and bulldozed parts of the Gaza fence. More than 200 people were captured by militants and brought to Gaza, as were dozens of Israeli military vehicles. Hamas political leader Ismail Haniyeh said Hamas had warned Israel about damaging al-Aqsa Mosque, continued settlement expansion, and raids on Palestinian cities and towns, but that Israel had ignored its warnings. Haniyeh further stated, “Israel could have silenced us by giving us crumbs, but the government turned its back on any possibility of a prisoner exchange and continued the siege of the strip.” Islamic Jihad spokesperson Dauod Shihab said Israeli captives would only be released in a prisoner exchange, adding the organization had taken women and children captives because Israel does the same. In the West Bank, Israeli settlers threw stones at Palestinian vehicles traveling near Huwwara, injuring 1 and causing damage. Israeli settlers also vandalized citrus and almond trees and other property near Kafr ad-Dik. Israeli forces shot and killed 1 Palestinian man after he shot and killed an Israeli soldier near the Kedumim settlement, west of Jit. Hamas claimed responsibility for the killing of the soldier, citing Israel’s massive attack on Jenin on 7/3 and 7/4. Israeli forces also razed a road and seized a tent and a vehicle near Duma. Elsewhere, Israeli forces opened fire at a Palestinian vehicle traveling near Haris, causing damage. Israeli forces also demolished 2 residential structures in Wadi Abu Hindi, displacing 13 Palestinians. 7 Palestinians were arrested during late-night raids in Ramallah, Kafr Ni’ma, Silat ad-Dhahr, Tura, Yatta, and Qalqilya. The Jerusalem District Court acquitted an Israeli police officer for the killing of the 32-year-old autistic Palestinian man Eyad al-Hallaq who was shot and killed in East Jerusalem on 5/30/2020. Al-Hallaq’s parents called the acquittal a “disgrace.” The police officer was subsequently reinstated and send on a commanders’ course. The police officer ignored al-Hallaq’s counselor who told him that al-Hallaq had special needs. After the acquittal, Israeli national security minister Itamar Ben-Gvir was filmed calling al-Hallaq’s mother a terrorist when she confronted him outside of the court. The Jenin Brigades issued a statement saying “[i]t is heart-breaking that we are being fatally stabbed in the back by our own people, the PA security services, which committed an act on Tuesday that no fighter or defender of this land would accept,” referring to a PA arrest of 2 Palestinians who were wanted by Israel. In the West Bank, 1 Israeli settler and Israeli forces shot and killed 2 Palestinians who allegedly shot and killed 4 Israeli settlers and wounded 4 others at a gas station near the Eli settlement east of al-Lubban ash-Sharqiya. Israeli settlers subsequently raided al-Lubban ash-Sharqiya, setting fire to 30 cars and 10 homes. Israeli settlers also raided Huwwara setting fire to 20 cars, throwing stones at Palestinian vehicles, and attacking Israeli forces. Elsewhere, Israeli settlers threw stones at Palestinian vehicles near Nablus and Za‘atra. Israeli settlers, including Religious Zionism Party MK Zvi Sukkot, also entered the evacuated Evyatar settlement outpost in an attempt to resettle it. Israeli forces issued demolition notices for 3 homes and an agricultural building in al-Karmel. Israeli forces also closed several checkpoints near Jenin, Salfit, Ramallah, and Nablus. In East Jerusalem, Israeli authorities demolished 1 Palestinian house in Silwan. Israeli forces raided the Haram al-Sharif compound, forcing overnight worshippers at al-Aqsa Mosque to leave in order to facilitate settler tours of the compound in the morning. In response to the killing of the 4 settlers, Israel revoked travel permits for all Palestinians sharing the last names of the 2 alleged perpetrators. Israeli national security minister Itamar Ben-Gvir demanded that the Israeli government respond to the killing of the 4 Israeli settlers by assassinations by airstrikes, demolitions, deportations, and death penalty. U.S. ambassador to Israel Tom Nides tweeted that he was “[d]eeply concerned about the civilian deaths and injuries that have occurred in the West Bank these past 48 hours, including that of minors,” referring to both Israeli settler and Palestinian casualties. This led to criticism from Israeli ambassador to the U.S. Michael Herzog, who said that the “balanced” statement was disrespectful to the Israeli settler casualties. In the West Bank, 2 Israeli soldiers were injured after being hit by a vehicle in Huwwara; 1 Palestinian man was arrested in relation to the incident. Israeli settlers raided Kafr Thulth, throwing stones at Palestinians and Palestinian property and setting 1 vehicle on fire; 1 Palestinian was also injured by a baton round fired by Israeli forces who intervened to aid the settlers. Israeli settlers also raided Ein Samiya, uprooting trees and throwing stones at Palestinian vehicles. Israeli forces issued notifications that Israel will seize 42 dunams (10.3 acres) of land in Sarta and Bruqin to expand a settler road. A 2-year-old boy who was critically injured by Israeli forces on 6/1 succumbed to his wounds. The PA condemned the killing, saying that 28 Palestinians children had been killed by Israeli forces since the beginning of 2023. Hamas political bureau head Ismail Haniyeh and other high-ranking officials met with Egyptian intelligence chief Abbas Kamel in Cairo, discussing reconciliation. PA prime minister Mohammad Shtayyeh met with Kamel last week. Islamic Jihad secretary-general Ziyad al-Nakhalah also met with Kamel in Cairo. It was reported that the Hamas and Islamic Jihad leadership were invited to Egypt to discuss Egyptian president Abdel Fattah El Sisi’s plan to develop Gaza, including increasing Egyptian electricity supply, rebuilding infrastructure, building a port, and developing a gas field. Israeli prime minister Benjamin Netanyahu met with representatives from Palestinian parties in the Knesset and local council to discuss the rising murder rates in those communities. Netanyahu said he agreed to form a ministerial committee, that he would chair, to address the issue. 89 Palestinians have been killed in Israel in mostly gun-related violence in 2023. U.S. secretary of state Antony Blinken spoke at the annual AIPAC conference in Washington D.C., saying that the Biden administration is committed to normalizing relations between Israel and Saudi Arabia, but that such a deal is “not a substitute for progress between Israelis and Palestinians.” Blinken will travel to Saudi Arabia in the coming days to promote a normalization deal.
