An Israeli government-appointed commission headed by former Israeli supreme court justice Ephraim Levy issues a nonbinding legal judgment that Israel’s presence in the West Bank is not occupation and that the government should grant retroactive approval to unauthorized settlement outposts. The commission states that unauthorized outposts were established with the knowledge and encouragement of senior government officials that amounted to ‘‘implied agreement’’ by the government. During the day, unidentified Palestinians fire 1 Qassam rocket fr. Gaza into Israel, causing no damage or injuries. In the evening, Palestinian gunmen inside Gaza fire into Israel, hitting a parked civilian vehicle, but causing no injuries. Late at night, Israeli warplanes and helicopters carry out 3 air strikes on Khan Yunis and Rafah in s. Gaza, causing no reported casualties. The targets include a training site used by the al-Ansar Brigades (military wing of a small faction called al-Ahrar Movement, which was formed shortly after Hamas’s 2007 takeover of Gaza by disaffected Fatah members who aligned themselves with Hamas), and 2 open areas used by rocket-launching teams. In the West Bank, the IDF patrols in 2 villages nr. Ramallah in the morning; in Tulkarm in the afternoon; and in Qalqilya, 1 nearby village, and 1 village nr. Jenin late at night. The IDF also bulldozes a plot of Palestinian agricultural land outside Qalqilya and conducts late-night arrest raids, house searches in Bayt Umar. Jewish settlers stone Palestinian cars driving nr. Hebron. Jewish settlers also enter a Palestinian area (exact location not reported) to pray at a local religious site without proper coordination with the IDF; the IDF intervenes to remove the settlers. Russian pres. Vladimir Putin makes a 1-day visit to Israel for the unveiling of a monument dedicated to Russian soldiers. In addition, he meets with Israeli PM Netanyahu, DM Barak, and other senior officials who urge Russia to pressure Iran to halt its nuclear program, Syria to halt violence against the opposition, and the Palestinians to resume negotiations. Unidentified Palestinians fire 2 mortars fr. Gaza into Israel, causing no damage or injuries. Israeli naval vessels fire warning shots at Palestinian fishing boats off the n. Gaza coast, forcing them to return to shore. In the West Bank, the IDF patrols in 2 villages nr. Ramallah in the morning; and in Qalqilya, 1 nearby village, and 1 village nr. Ramallah late at night. Israel detains all but a few of 100s of pro-Palestinian protesters attempting to enter Israel through Ben-Gurion Airport to attend an anti-occupation rally in Bethlehem. Organizers claim that more than 1,500 supporters booked tickets to Israel, but only 3 make it to Bethlehem. Israel says most were stopped at their point of departure after it gave foreign governments no-fly lists identifying suspected activists. (NYT, WP, WT 4/16; JPI 4/27)

Israeli naval vessels detain a fishing boat that approaches the 3 naut. mi. boundary off the Gaza coast, detaining and questioning 3 fishermen onboard, releasing them by the end of the day, but confiscating their boat. Unidentified Palestinians fire at least 1 Qassam rocket fr. Gaza into Israel, causing no damage or injuries. Late at night, an Israeli warplane makes an air strike on an open area nr. Gaza City, causing no damage or injuries. In the West Bank, the IDF conducts morning patrols inside Jericho and Qalqilya (normally the PA security forces have security control during daylight hours and the IDF stays away), as well as in 1 village nr. Ramallah; conducts afternoon patrols in 2 villages nr. Qalqilya (synchronized), 2 nr. Ramallah, and 1 nr. Jericho; and conducts late-night patrols in 1 village nr. Ramallah. Jewish settlers fr. Nachliel settlement nr. Ramallah uproot around 250 olive trees on a nearby plot of Palestinian land. Jewish settlers fr. Ma’on settlement nr. The New York Times reports that around this date, the PASF detains 2 prominent Palestinians for posting comments critical of the PA on Facebook: Palestinian blogger Jamal Abu Raihan for posing a satirical column depicting PA Pres. Abbas as a donkey and complaining of PA corruption; and Palestinian journalist Tareq Khamees for posting a comment in support of others who have recently been arrested for criticizing the PA (also seizing his laptop). By this date, the PA Atty. Gen. Ahmad al-Mughni has also ordered PA authorities to block several websites supportive of Abbas rival, former Gaza security chief Muhammad Dahlan. Early in the morning, the IDF drops leaflets from helicopters over n. Gaza border areas nr. Bayt Lahiya warning that the IDF will use deadly force against anyone approaching the border fence. Late at night, IDF troops on the s. Gaza border fire on residential areas of Khan Yunis, damaging a house but causing no injuries. On the Rafah border, 1 Palestinian is killed and 2 are injured in a smuggling tunnel collapse. In the West Bank, Israel’s Shin Bet arrests 13 Palestinians fr. al-Am’ari r.c. (including 2 Palestinian Red Crescent Society employees, the goalie of Palestine’s Olympic soccer team, and a senior PA intelligence officer) for plotting a series of attacks on IDF soldiers nr. Ramallah, claiming that the prominent mbrs. of the group intended to use their status to perpetrate attacks. The IDF seals off a plot of land in the al-Ja’wana area Bayt Furik village (nr. Nablus), confiscating 6 tents and 2 water tanks belonging to local Palestinians; patrols in 3 villages nr. Ramallah (synchronized) and 1 nr. Qalqilya in the morning; patrols in 3 villages nr. Jenin, Qalqilya, and Ramallah in the afternoon; and conducts late-night patrols in 1 village nr. Tulkarm. The IDF also conducts late-night arrest raids, house searches in Qalqilya and nr. Nablus. The IDF issues an eviction order to several Jewish settler families who moved into a house in Hebron, near the al-Ibrahimi Mosque/Tomb of the Patriarchs, several days ago that they claim to have purchased fr. the Palestinian owner (who claims the deeds were forged). The IDF cites the settlers for failing to secure the proper permits from the Israeli military to reside in the West Bank, calling their presence “a risk to public order,” and ordering them to vacate the building by 3:00 p.m. local time on 4/3. (NYT 4/4, 4/5)

The IDF makes a brief early morning incursion into c. Gaza, searching and firing on residential areas in Bureij r.c., but entering no buildings and making no arrests. In the West Bank, the IDF demolishes 4 tents, 3 barnyards, and 3 residential barracks in a bedouin encampment in al-Maleh in the Jordan Valley; demolishes 2 barnyards nr. Tubas. The IDF also patrols in 1 village nr. Ramallah in the morning, 1 village nr. Qalqilya in the afternoon, and 1 village nr. Ramallah in the evening; conducts late-night arrest raids, house searches in and around Hebron, nr. Bethlehem, and nr. Ramallah (firing on the occupants of 1 raided home, wounding 3 Palestinians); conducts late-night patrols in 1 village nr. Qalqilya. Jewish settlers fr. Brakha settlement nr. Nablus attack Palestinian farmers working their land nearby; the IDF observes but does not intervene. Jewish settlers escorted by IDF troops begin leveling a large area of Palestinian agricultural land in Kafr Lakif village nr. Qalqilya; local Palestinian gather to protest and are informed by the IDF that the area has been approved for construction of an industrial zone; the soldiers agree to suspend the digging until the matter is clarified but bar Palestinians from the site. Jailed Fatah tanzim leader Marwan Barghouti issues a statement on the 10th anniversary of his arrest by Israel that is read to a crowd of supporters in Ramallah, stating that “the launch of large-scale popular resistance at this stage serves the cause of our people.” He also calls for “stopping all forms of security and economic coordination [with Israel] in all areas immediately.” (JPI 4/6)

Israel severs working relations with the UNHRC over the 3/22/12 res. calling for an investigation into settlements, calling the council biased against Israel. (NYT, WP, WT 3/27; JPI 4/6)

The U.S. Supreme Court orders a lower court to decide whether Americans born in Jerusalem can claim Israel as their birthplace on their passports. Congress approved legislation in 2002 allowing this, but the executive branch has claimed Congress overstepped its authority by attempting to override the president’s right to set foreign policy. The U.S. officially recognizes Jerusalem as occupied Palestinian territory and does not recognize Israel’s claim to united Jerusalem as its capital. (NYT 3/27; WJW 3/29)

J Street holds its annual conference. Fmr. Israeli PM Ehud Olmert gives the keynote speech at the gala dinner, emphasizing that PA pres. Abbas “wants peace with Israel and he accepts the existence of Israel as Israel declares itself to be.” (JPI 4/6)

In Amman, Israeli and Palestinian negotiators meet with Quartet reps. (including special envoy Blair) and then with Jordanian FM Nasser Judeh. Judeh says that the Palestinian team, as requested, turned over its position papers on security and borders and that the Israeli team formally received them. The sides have agreed to hold talks “on a continual basis” in Jordan to explore reviving formal negotiations and to observe a media blackout, with only Judeh issuing public statements after the sessions. Israel does not submit its own comprehensive position papers, but pledges “that through this continuing dialogue there will be an Israeli counterproposal or an Israeli response.” (WJW 1/3; NYT, WP 1/4; WT 1/5)

IDF troops make a brief incursion into s. Gaza to level land and clear lines of sight along the border fence e. of Abasan and Khuza, firing toward nearby residential areas to keep Palestinians indoors (causing no reported injuries). Israeli naval vessels fire on Palestinian fishing boats off the n. Gaza coast, forcing them to return to shore. In the West Bank, the IDF conducts morning patrols in Jenin and (synchronized) in 3 villages nr. Ramallah; conducts evening patrols in Tulkarm and 1 village nr. Jenin; conducts latenight arrest raids, house searches nr. Qalqilya. OCHA reports that since 12/21, the IDF has demolished 25 water-related structures (wells, cisterns, water pools, and water storage tanks) used for domestic and agricultural purposes; 21 were in Hebron governorate, 4 in Salfit governorate. OCHA also reports that in the past 2 wks., the IDF has demolished the remaining structures on the Palestinian side of the Qarni crossing, which Israel closed on 3/2/11 when the Kerem Shalom crossing became fully operational. The Israeli High Court accepts an agmt. reached between the state and settlers under which the state agrees to suspend plans to demolish immediately 9 structures in the Ramat Gilad unauthorized settlement outpost, giving the settlers until 3/2012 to remove the structures themselves. The settlers claim that the state has agreed in exchange to expand the zoning boundaries for nearby Karnei Shomron settlement to include Ramat Gilad (retroactively legalizing the outpost), but the official documents submitted to the court do not say this. Israeli PM Netanyahu says that since the 11/24 Abbas-Mishal meeting seemed more symbolic than substantive and the PLO/PA has not made moves since the 11/1/11 UNESCO vote to gain membership in other UN organizations, he is considering releasing VAT taxes. (NYT 11/29) (see 11/23/11)

In the 1st Lebanese-Israeli crossborder attack since 10/2009, unidentified assailants fire 3 rockets fr. s. Lebanon into n. Israel, damaging 2 buildings in the western Galilee, but causing no injuries. Israel responds with artillery fire, causing no reported damage or injuries. Bosnia, a rotating UNSC mbr., announces that it will abstain from the vote on the Palestinian membership in the UN, making it impossible for the Palestinians to secure the 9 votes needed to approve the application, making a U.S. veto unnecessary. The lack of 9 supporting votes also means the Palestinians cannot ask the UNGA to consider the measure under the Uniting for Peace res. (res. 377). (NYT 11/1)

UNESCO’s general conference votes (107-14, with 52 abstentions and 20 not present) to approve Palestine’s full membership. The U.S., Israel, and Canada immediately announce they are cutting off funding to the organization. (CNN, HA 10/31; NYT, WT 11/1)

Unidentified Palestinians fire 5 rockets fr. Gaza into Israel, causing no damage or injuries. Israel prepares to launch a major attack on Gaza in response, but Egypt intervenes, saying intelligence indicates it was a small Salafist group that fired the rockets, not Hamas or Islamic Jihad, and asking Israel to wait 24 hrs. before responding to see if the cease-fire will take hold. The IDF demolishes 3 Palestinian homes in al-Khan al-Ahmar in East Jerusalem; patrols in Tulkarm, 1 nearby village, and 1 village nr. Egypt completes repairs to its natural gas pipeline damaged during the 2/2011 Egyptian unrest (see Quarterly Update in JPS 159) and resumes sending natural gas to Israel. The Israeli navy detains a ship, the German-owned and Liberian flagged Victoria, en route fr. Syria to Egypt, 200 mi. off the Israeli coast that Israel claims was attempting to deliver arms to Gaza fr. Iran, taking it to Ashdod for further inspection; Israeli authorities said the ship carried 4 crates holding some 70,000 rounds of ammunition for Kalashnikov rifles, 1,000s of mortars, 6 Chinese C-704 antiship missiles, and 2 radar systems. Iran denies smuggling arms. The IDF makes a brief incursion into c. Gaza to level lands e. of al-Bureij r.c. to clear lines of sight. On the Rafah border, 2 Palestinians are killed, 4 are injured in an explosion in a smuggling tunnel. The UN Office for the Coordination of Humanitarian Affairs (OCHA) reports that another 4 Palestinians have been killed in tunnel accidents since 3/2. Meanwhile, Hamas’s acting PM in Gaza Ismail Haniyeh invites Abbas to Gaza for reconciliation talks; Abbas responds favorably. Inside Israel, 2 cars owned by Israeli Palestinian students at Safad Academic College were torched during a campus event to promote Arab-Jewish dialogue. Israeli DM Ehud Barak resigns as head of the Labor party, taking 4 rightleaning party mbrs. with him to form a “new centrist independence faction” within Netanyahu’s governing coalition. The 8 remaining Labor MKs immediately withdraw fr. the coalition, leaving Netanyahu with a smaller but more stable coalition, controlling 66 of 120 Knesset seats. IDF troops on the n. Gaza border fire 5 tank shells at Palestinian shepherds tending a flock 600 m. fr. the border fence, killing 3 Palestinian civilians (a 91-yr.-old man, his teenage grandson, and another teenager) and their 30 sheep. In response, the PRCs fire 2 Qassam rockets fr. Gaza into Israel, causing no damage or injuries. In the West Bank, the IDF patrols in Marda nr. On the sidelines of the convening of the UN General Assembly (UNGA) in New York, U.S. pres. Barack Obama moderates a meeting between Netanyahu and Abbas, encouraging them to resume peace negotiations promptly. (WP 9/23; WJW 9/24; JPI 10/1)

The IDF significantly increases attacks on Gaza for the 2d straight day, as international mediation efforts led by Egypt to secure a cease-fire also intensify.

Combat notes: The IDF tightens the cordon around Gaza City (focusing attacks on the outlying neighborhoods of Shaykh Ajlin, Tal al-Hawa, and al-Zaytun and open areas n. of the city), with troops reportedly taking fire from Palestinian rocket-propelled grenade antitank missiles and mortars. The IDF also launches a major incursion into Jabaliya under heavy shelling, engaging in heavy exchanges of fire with Palestinian gunmen, killing at least 13. In s. Gaza, the IDF continues heavy attacks on Khuza, including air strikes, intense shelling, and widespread bulldozing of some 50 houses and farms; Israeli fire is so heavy and constant that residents report being unable to reach the injured or flee their homes to seek shelter outside the village; IDF troops pull back fr. Khuza after nightfall.

The IDF reports carrying out more than 160 air strikes across Gaza. Air strike target areas include Bayt Hanun, Bayt Lahiya, Gaza City (al-Sabra, Shaykh Ridwan, al-Zaytun), Jabaliya r.c., Khan Yunis, Khuza, Nussayrat r.c., Rafah, al-Shuka, Tal al-Za‘atar, and the Twam area. Israeli gunboats shell Nussayrat r.c. Heavy tank and artillery fire are reported nr. Bayt Lahiya (white phosphorous suspected) and in Dayr al-Balah, Jabaliya town, Khan Yunis (white phosphorous suspected), Khuza, Nussayrat r.c. (confirmed use of flechette shells). For a 2d day, nearly half of the air strikes take place after nightfall, targeting Gaza City. Palestinians report 12 hrs. of constant Israeli bombardment of the Rafah border, with the IDF claiming to destroy 90 smuggling tunnels. (The IDF also demolishes 1 tunnel on the Gaza–Israel border nr. the Nahal Oz crossing.) Specific targets include a Hamas police headquarters in Gaza City, 31 groups of armed men, 25 rocket-launching sites, and 13 suspected weapons manufacturing and storage facilities.

On the ground, the IDF reports a total of 6 soldiers wounded (2 moderately, 4 lightly) in 2 exchanges of gunfire with Palestinians. In a 3d incident, IDF reservists open fire on an IDF paratrooper unit, seriously wounding 1 and moderately wounding 3. Palestinians report around 70 Gazans killed today, putting the estimated Palestinian toll at 971 dead and 4,400 wounded. The Israeli toll stands at 13–14 dead, more than 125 injured. (Israeli military intelligence confirms that 1 soldier killed on 1/6 or 1/8 was targeted by a suicide bomber, stating that several Palestinian suicide bombers, including some women and some dressed as IDF soldiers, have approached combat units.)

Palestinians fire about 11 rockets and 6 mortars into Israel, causing no reported damage or injuries.

Humanitarian notes: The IDF observes another 3-hr. lull, allowing 102 truckloads of aid into Gaza. (The IDF states that 1,028 truckloads of humanitarian goods have been allowed into Gaza since 12/27.) During the lull the ICRC rescues 100 Palestinians trapped in Jabaliya. Heavy IDF attacks in Rafah force UNRWA to close a medical center just n. of the border to ensure the safety of patients and to open more shelters for displaced residents. Human Rights Watch calls Israel’s 3-hr./day breaks to facilitate humanitarian aid “woefully insufficient.” Other aid groups (including Doctors Without Borders, the ICRC, the UN) complain that they are still able to import and distribute only a fraction of the emergency supplies available for Gaza because of Israeli delays and restrictions. In the West Bank, IDF troops at the Tarqumiyya crossing nr. Hebron fatally shoot a Palestinian who allegedly attempts to grab the gun of a border patrol officer after being denied permission to cross the checkpoint. Late in the evening, the IDF conducts arrest raids, house searches in Bayt Awa, Dura, and Kafr Khalil (all nr. Hebron). A Jewish settler driving nr. Azun village e. of Qalqilya opens fire on Palestinian youths who stone his car, killing 1 Palestinian teenager, wounding 2. (HA 1/13; PCHR 1/15)
