The UN Office of the High Commissioner for Human Rights (OHCHR) says it has received information that Palestinian women and girls have been “arbitrarily executed in Gaza, often together with family members, including their children.” The office also expresses alarm over the arbitrary detention of hundreds of women and girls in the West Bank and East Jerusalem, including reports of sexual assault of detainees, including rape. U.S. State Department spokesperson Matthew Miller says the U.S. “strongly encourage[s] Israel to thoroughly and transparently investigate credible allegations and ensure accountability for abuses and violations” in response to the OHCHR’s statement. The ICJ begins hearings in the case of Israel’s occupation of Palestinian territories. 52 countries will present oral and written arguments before the court between 2/19 and 2/26. The case was triggered on 12/30/2022 when a majority of members of the UN General Assembly voted to seek an opinion on the legal consequences of the Israeli occupation of Palestine. PA foreign minister Riyad al-Maliki, PA ambassador to the UN Riyad Mansour, and academics and legal experts address the ICJ judges on the first day of the hearings. A report by the London School of Hygiene & Tropical Medicine and the Johns Hopkins Center for Humanitarian Health projects that between 2/7 and 8/6/2024 the excess number of deaths in Gaza could range from 4,200 to 259,680. In the best scenario where a ceasefire is reached and no epidemics occur the mean estimate is 6,550 excess deaths while in the worst scenario where the attacks escalate and epidemics occur the mean estimate of excess deaths is 85,750. In the West Bank, Israeli settlers throw stones and tear-gas canisters at cars traveling near Bizarya, causing injuries and damage. Israeli settlers also demolish a Palestinian-owned home, a water well, and agricultural structures and raze farmland in Shaghab Farsa in the Masafer Yatta area. Israeli forces shoot and kill a Palestinian man in Battir. Israeli forces also seize a vehicle in Jenin. Elsewhere, Israeli forces arrest 3 Palestinians in Jericho. In East Jerusalem, Israeli forces shoot and injure a Palestinian child in the Old City, claiming he tried to stab soldiers. The child succumbs to his injuries on 2/12. In Gaza, Israeli forces bomb Rafah, Khan Yunis, and Dayr al-Balah, killing at least 112 people, including at least 25 people in an airstrike on a home in Rafah. Israeli forces block the delivery of oxygen cylinders to al-Amal Hospital, resulting in the deaths of 3 patients. Al Jazeera reports that around 100 bodies are retrieved from Tel al-Hawa and Rimal in Gaza City after Israeli forces withdraw, most are killed with live ammunition. 2 Israeli soldiers are killed in combat. U.S. president Joe Biden speaks to Israeli prime minister Benjamin Netanyahu, discussing Israel’s planned invasion of Rafah. According to the U.S. readout of the conversation, Biden said Israel should not proceed without “a credible and executable plan to ensure the safety of and support for more than one million people sheltering there.” Biden also stress the need to capitalize on the ceasefire negotiations. Netanyahu tells the Israeli cabinet that Israel will remain in control of security in all the lands between the Jordan river and the Mediterranean. Axios reports that Biden pressed Netanyahu to agree to release more Palestinian prisoners than in the previous exchange to meet some of Hamas’s demands. In the West Bank, Israeli settlers razed 5 dunams (1.2 acres) of land and threw stones at Palestinians and Israeli activists in Khirbet al-Farisiyya. Israeli settlers also vandalized 15 vehicles in Umm Safa. Elsewhere, Israeli settlers wearing military uniforms raided Khirbet Zanuta, demolishing a residential structure, 2 agricultural structures, and part of an EU-funded school. Israeli forces shot and killed 5 Palestinians during raids in Qalqilya, Sa’ir, and Qalandia. Israeli forces also shot and injured 35 Palestinians, including 5 children, during raids in Bani Naim, Qalqilya, and Qalandia. Elsewhere, Israeli forces demolished 6 agricultural structures in al-Ubeidiya. 60 Palestinians were arrested during raids in and around Dheisheh refugee camp, Jericho, Ramallah, Silwad, Jalazone refugee camp, and Abu Dis. In East Jerusalem, Israeli forces raided Kafr ‘Aqab, injuring 10 with live ammunition, 1 with a baton round, 3 with beatings, and others with tear gas. In Gaza, Paltel said telecommunications were cut off in all of Gaza. At least 349 people were killed and 750 injured in Israeli attacks, including 108 in Beit Lahiya and 40 in Khan Yunis and others in Gaza City and Khan Yunis. Israeli forces ordered Palestinians in the Dayr al-Balah district to evacuate south as Israel continued to heavily bomb the Rafah and Khan Yunis districts. Israel announced that it had approved the Lower Aqueduct plan in East Jerusalem, the first major new settlement plan to be fully approved in East Jerusalem since 2012, according to Ir Amim. The final approval greenlit the construction of 1,792 housing units on 186 dunams (46 acres) of land, including on privately owned land belonging to Palestinians in Umm Tuba. PA president Mahmoud Abbas spoke with U.S. vice president Kamala Harris in a phone call, discussing the situation in Palestine and need for aid to enter Gaza. U.S. senator Bernie Sanders (D-VT) called the proposed U.S. military aid package to Israel “absolutely irresponsible,” labelling Israel’s attacks on Gaza immoral and in violation of international law during a speech at the Senate. (AJ, HA 12/5)

Haaretz said that several stories about Hamas militants’ actions during Operation Al-Aqsa flood were unfounded, including that 40 babies were killed, some of which were said to be beheaded, a story recounted by U.S. president Biden. Other stories recounted by Prime Minister Netanyahu, such as children being bound together and burned, also appeared to be false. Netanyahu’s wife Sara also relayed a false story in a letter to Biden’s wife Jill, saying one of the captives held by Hamas was pregnant and had given birth in captivity. Former State Department office of public and congressional affairs director Josh Paul, who resigned on 10/18 in protest over the Biden administration’s policy toward Israel’s attacks on Gaza, told CNN that Israel had raided the offices of Defense for Children International – Palestine (DCI – Palestine) in 2021 after the State Department had shared credible evidence of a Palestinian child being raped at al-Mascobiyya Interrogation Center in Jerusalem with Israel. DCI – Palestine’s office was raided on 7/29/2021 and the organization declared a terrorist organization on 10/22/2021 along with 5 other groups. Israeli forces raided the home of al-Aqsa Mosque preacher Sheikh Ikrimah Sabri in Silwan, issuing a demolition notice for the 5-story building he lives in. Israeli authorities forced a Palestinian family to demolish their own home in Sur Baher. Shin Bet director Ronen Bar said the Israeli cabinet had discussed assassinating leaders of Hamas “in Gaza, the Palestinian territories, in Lebanon, in Turkey, and in Qatar,” calling it “our Munich.” A Turkish intelligence official said there would be “serious consequences” if Israel kills Palestinians in Turkey. Military chief of staff Herzl Halevy said Israeli forces would fight in southern Gaza “as we did strongly and thoroughly in the northern part.” Israel also claimed to have found 800 tunnel shafts in Gaza. The U.S. said that an American warship and several commercial ships were attacked in the Red Sea. Yemen’s Houthi government said it had attacked an Israeli ship with a missile and attacked another with a drone. In the West Bank, Israeli settlers raided Jalud, setting fire to vehicles and throwing stones at homes. Israeli settlers also assaulted Palestinians and stole olive harvest in Khirbet Yanun. Elsewhere, Israeli settlers raided a store in al-Zawiya, vandalizing it and steal items. Israeli settlers also threatened Palestinians in the al-Ka’abneh community near Jericho with death if they did not flee their village; the settlers threw stones at Palestinians, vandalized a vehicle and stole another. Meanwhile, Israeli settlers with military escort also attacked Palestinians in Qarawat Bani Hassan, stealing cash and vandalizing property. Israeli settlers also attacked Palestinian shepherds in the Masafer Yatta area and vandalized 50 olive trees in Qusra. Israeli forces violently dispersed Palestinian protesters in Kafr Qaddum, injuring 2 with live ammunition and others with tear gas. Qatar, Egypt, and the U.S. said they were working on reinstating the ceasefire which expired at 7 a.m. Israel confirmed that 4 captives held by Hamas had died. The U.S. parroted Israel’s explanation for the not extending the ceasefire, saying that Hamas did not produce a list of captives for exchange. Israeli finance minister Bezalel Smotrich said he told Prime Minister Benjamin Netanyahu to announce that Israel will not negotiate another ceasefire until all captives are released from Gaza. Hamas said it was Israel who undermined extending the ceasefire by rejecting 3 separate options presented to them by mediators, but that Israel had already decided to resume its attacks. The PA said it held the U.S. responsible for the resumption of Israeli attacks on Gaza. Israel said that Hamas still holds 137 captives, including 4 from before 10/7. During the temporary ceasefire 240 Palestinians, 107 children and 133 adults, including 65 18-year-olds and 68 women, were exchanged for 105 captives held by Hamas. 75% of the Palestinians were not convicted of a crime, most were arrested within the past year with 37 since 10/7. 39 Palestinian prisoners were released from the Damon, Megiddo, and Ofer prisons on the second day of the prisoner exchange. 13 Israelis and 4 Thai nationals were released. The exchange was delayed by 7 hours as Hamas said Israel had violated the agreement by only allowing half the agreed number of aid trucks to enter northern Gaza and not releasing Palestinians who had been imprisoned for a longer period than 2 years. Israel said the UN was responsible for the lack of aid deliveries. Before the exchange took place, Israel threatened that it would start bombing Gaza at midnight if the issues were not resolved. Egypt said it had received positive signals from both sides that the ceasefire could be extended beyond the initial 4-day period. Israeli military spokesperson Richard Hecht said Israel may not use the same “level of fidelity” in warning civilians before striking homes and apartment buildings. It had been reported that Israel no longer used smaller munitions to “knock” on the roofs of apartment buildings or call building managers before demolishing them with larger bombs. Hecht also called the parliament and ministries in Gaza legitimate targets. Hecht further said Palestinians in Gaza should flee to Egypt via the Rafah crossing, first saying that it is open and later tweeting that he did not know if it was open. Biden also compared Hamas to ISIS, attributed the operation to anti-Semitism, rather than resistance, and reiterated his stance in support of Israel, saying Israel has a “duty to respond,” despite the mass civilian casualties in Gaza. EU high commissioner for foreign affairs Josep Borell said he had invited PA and Israeli foreign ministers Riyad al-Maliki and Eli Cohen to an EU foreign ministers meeting to discuss the situation in Palestine and Israel. Borell also said that Israel must adhere to international law, saying Israel violates the law by imposing a total blockade on Gaza. Israeli media reported more than 900 Israelis and foreign nationals have been killed and 2,616 injured. Israel said it had hit 500 targets in Gaza overnight and 1,100 since 10/7. The UN reported that more than 187,518 Palestinians were displaced, including 137,427 sheltering in UNRWA facilities. 790 housing units were destroyed and 5,330 were damaged since 10/7. Hamas’ Izzeddin al-Qassam Brigades spokesperson Abu Obaida said the Qassem Brigades would not negotiate the release of captives while Gaza was being bombarded. Earlier in the day Abu Obaida said Qassam Brigades would begin executing 1 Israeli captive each time Israel bombs a civilian target. There was no indication that the threat was carried out as civilian buildings were being bombed by Israel. Hamas official Moussa Abu Marzouk told Al Jazeera that Hamas is open to discussing a truce and all political dialogue. PA president Mahmoud Abbas spoke to Turkish president Recep Tayyip Erdoğan, UN secretary-general Antonio Guterres, and Saudi crown prince Mohammed bin Salman about the Hamas-Israel war. Reuters reported that Qatar was mediating a prisoner exchange that will see Israeli women and children released by Hamas in exchange for the release of 36 Palestinian women and children from Israeli prisons. Egyptian sources also said that Egypt was in close contact with Israel and Hamas to prevent further escalation, calling on Israel to exercise restraint and Hamas to keep the captives in good condition. Israeli defense minister Yoav Gallant said that he had ordered that no power, water, food, or gas enters Gaza, saying “[w]e are fighting human animals and we act accordingly.” His office later said Gallant had ordered the intensity of the Gaza bombings to increase. Several Israeli politicians called for the formation of an emergency unity government, including Finance Minister Bezalel Smotrich, who said the emergency government should “bring about the complete elimination of Hamas and the terrorist organizations in Gaza.” Benny Gantz’s National Unity party demanded that Smotrich and National Security Minister Itamar Ben-Gvir not be part of the war cabinet and that no legislation unrelated to the war would be promoted. Axios reported that Israeli prime minister Netanyahu told U.S. president Joe Biden that Israel will invade Gaza. The Washington Post reported that the U.S. is preparing for a prolonged war in Gaza and is assessing Israeli diplomatic, political, and military needs. The White House briefed members of Congress that Israel will need replenishment for the Iron Dome, ammunition rounds, precision-guided missiles, and small-diameter bombs. Biden said in a briefing that 11 U.S. citizens have been killed by Hamas and that there likely are U.S. captives being held in Gaza. The U.S. also said Iran was complicit in the Hamas attack and warned Iran about getting involved in the fighting. Iran denied any involvement or knowledge. The EU, Germany, and Austria said they suspended all aid to Palestinians in response to Hamas’ operation in Israel. None of the aid in question is delivered to Hamas. Hamas launched Operation Al-Aqsa Flood, entering Israeli towns and villages near Gaza through the Gaza fence and by air, using improvised paramotoring gliders, attacking military equipment with explosive drones, and firing thousands of rockets. Palestinian militants took control of at least 14 Israeli bases, police stations, and towns, in addition to the Beit Hanun (Erez) crossing, and bulldozed parts of the Gaza fence. Hamas political leader Ismail Haniyeh said Hamas had warned Israel about damaging al-Aqsa Mosque, continued settlement expansion, and raids on Palestinian cities and towns, but that Israel had ignored its warnings. Haniyeh further stated, “Israel could have silenced us by giving us crumbs, but the government turned its back on any possibility of a prisoner exchange and continued the siege of the strip.” Islamic Jihad spokesperson Dauod Shihab said Israeli captives would only be released in a prisoner exchange, adding the organization had taken women and children captives because Israel does the same. Palestinian Americans and Arab American civil rights organizations filed a lawsuit against the U.S. government, stating that the government is endorsing discrimination against Palestinian Americans by admitting Israel into its Visa Waiver Program. American-Arab Anti-Discrimination Committee national executive director Abed Ayoub said the organization will hold the government “accountable for any actions that create separate classes of U.S. citizens.” The other plaintiffs were 3 Palestinian Americans and the organization Democracy for the Arab World Now. The plaintiffs argued that the U.S.-Israeli memorandum, which was kept secret, for the creation of the trial period “differentiate treatment to U.S. citizens who are ‘residents’ of the occupied West Bank, no including East Jerusalem; U.S. citizens who are residents of the occupied Gaza Strip; U.S. citizens who are registered on the [Palestinian Population Registry] but not residents in either the West Bank or Gaza Strip; and U.S. citizens who are not of Palestinian nationality.” Israeli foreign minister Eli Cohen announced that Israel had been admitted to the program on 9/25 2 days before the U.S. made an official announcement on 9/27. The Israeli Justice Ministry’s police misconduct unit indicted an Israeli soldier for shooting a 16-year-old Palestinian girl in the back with a baton round while she was in her yard in Sheikh Jarrah in 2021. Fatah Central Committee member Azzam al-Ahmad said the Islamist groups that Fatah have been fighting with since the end of July in Ain al-Hilweh refugee camp have until the end of the month to hand over the accused killers of Fatah general Mohammad al-Armoushi. Al-Ahmad also said that Fatah is not opposed to the Lebanese army entering the camp and accused Hamas of fighting Fatah “in some areas of fighting.” Hamas denied that it was involved. 18 people have been killed and 140 injured in the camp since 9/7. The UN World Heritage Committee under the UNESCO voted to list Tell es-Sultan near Jericho as a World Heritage Site in Palestine during a session in Saudi Arabia. Israel criticized the decision. Last week MKs Yuli Edelstein, Limor Son Har-Melech, and Simcha Rothman wrote letters to members of the World Heritage Convention urging them not to list Jericho as a World Heritage Site in Palestine, saying Jericho is mentioned 53 times in the Bible giving Israel primacy in the city. PA president Mahmoud Abbas visited Jenin for the first time in 12 years, giving a speech in Jenin refugee camp. Abbas praised the steadfastness of the Jenin residents in light of Israel’s attacks. The visit followed Israel’s large-scale attack on Jenin refugee camp on 7/3 and 7/4. Around 1,000 PA troops secured the area for Abbas. Haaretz reported that Israel is allowing 6 settlement outposts to operate in the part of Masafer Yatta that Israel has designated a firing zone and where the Palestinian residents will be forcefully expelled. 3 of the outposts were built after the High Court of Justice ruling in May 2022 allowing the Israeli government to expel the more than 1,000 Palestinians. UNRWA commissioner-general Phillippe Lazzarini said that his agency only had secured $107 million in new contributions of the $300 million needed during a donor conference. UNRWA did not say who had provided the new funds. Lazzarini said before the conference that UNRWA needs $150 million to keep its services running until the end of 2023, $50 million to start 2024 without liabilities, $75 million to keep food programs in Gaza running and $30 million for cash distributions in Syria and Lebanon.
