A UN Human Rights Council (UNHRC) fact-finding mission releases its report on Israel’s West Bank settlements, describing them as a ‘‘creeping form of annexation,’’ and calling on Israel to cease construction immediately and ‘‘initiate a process of withdrawal.’’ The report, presented by mission leader Christine Chanet, urges the international community to cut economic links with the settlements. The U.S. refuses to take part in the Council’s debate. Meanwhile, UN High Commissioner for Human Rights Navi Pillay states that Israeli settler violence ‘‘continues to be perpetrated with impunity,’’ and further notes that excessive force by the IDF has resulted in Palestinian fatalities. Palestinian government employees begin a 2-day general strike to protest a delay in the payment of their wages due to Israel’s withholding of around $100 m. customs revenue. Around 50,000 workers take part in the strike. Meanwhile, Palestine Monetary Authority chief Jihad al-Wazir says that Palestinian banks will lend the PA $100 m., set to be repaid when the Arab League delivers its promised financial safety net. Palestinian pres. Mahmud Abbas offers to take in Palestinian refugees fleeing from fighting in Syria, and UN secy.-gen. Ban Ki-moon calls on Israel to facilitate their entry. Meanwhile, the UN launches its biggest aid appeal to date for Syria, estimating that it needs $1.5 b. to cope with a ‘‘dramatically deteriorating humanitarian situation.’’ Meanwhile, the Security Council passes a U.S.-and-Russian-drafted resolution on extending the peacekeeping mission in the demilitarized zone between Syria and Israel. Israel approves 1,500 new housing units in the Ramat Shlomo settlement in East Jerusalem. Teachers in the West Bank go on strike to protest the delay in the payment of their salaries. The PA has not set a target date for paying back salaries. Hamas’s Interior Ministry in Gaza says that Fatah will be allowed to celebrate its 48th anniversary in Gaza, in order ‘‘to promote the atmosphere of unity.’’ (MNA 12/17)

Syrian rebels take control of Yarmuk r.c. nr. Damascus after a fierce battle pitting rebels and anti-Asad Palestinians against the pro-Asad PFLP–GC. PLO official in Syria Anwar Abdul-Hadi says that over half the Palestinian population of Yarmuk r.c. has fled; Palestinian amb. to Syria puts the figure at 95%. (MNA, REU 12/17)

PLO Executive Comm. mbr. Hanan Ashrawi urges the EU to go beyond verbal condemnation of Israeli violations and to take action—such as a full ban on the import of settlement products and reconsidering the EU-Israel Association Agreement—in light of Israel’s persistent human rights abuses. Canadian FM John Baird says that PM Stephen Harper has relayed to Israeli PM Netanyahu Canada’s opposition to the recent settlement expansion plans. Speaking after a visit to Damascus, Filippo Grandi, head of the UN Relief and Works Agency (UNRWA), says that parties in Syria’s civil war must respect the neutrality of Palestinian refugees. He expresses particular concern over the role of the Popular Front for the Liberation of Palestine–General Command (PFLP–GC), a pro-Asad faction that is strong in the Yarmuk r.c. nr. Damascus. The Israeli governmentt announces it will confiscate the VAT tax revenues it has collected for the PA during 11/2012, and use the NIS 460 m. of funds to offset the PA’s debt to Israel’s Electric Corporation. On 11/11, Israel’s fin. min. Yuval Steinitz had warned of such a measure in response to the UN bid. (HA 12/2)

The Israeli newspaper Ha’Aretz reports that 5 senior European ambassadors—from Britain, France, the EU, Germany, and Holland—have communicated strong opposition to Israel’s 11/30 plan to expand settlements and develop the E1 area outside of East Jerusalem. An anonymous British diplomat tells the paper that ‘‘London is furious with the decision over the E1 corridor.’’ UN secy.-gen. Ban Ki-moon describes Israel’s plan as an ‘‘almost fatal blow’’ to prospects for peace. Israel announces that it will build 3,000 new settlement housing units as a response to the successful Palestinian UN vote, as well as advance plans for thousands more units in occupied East Jerusalem and the area known as E1, between Jerusalem and Ma’ale Adumim settlement. White House spokesperson Tommy Vietor says the Israeli decision is ‘‘counterproductive’’ and makes ‘‘it harder to resume direct negotiations or achieve a two-state solution.’’ Palestinian pres. The IDF’s attacks on the Gaza Strip continue, with reports indicating nearly 20 more Palestinians killed and as many as 300 Israeli air strikes during the day. As the Palestinian death toll approaches 50, with scores more wounded, Gaza’s hospitals feel the strain. IDF targets include the private homes of Hamas officials, police buildings, government buildings, and smuggling tunnels. Israel’s interior min. Eli Yishai says that the goal of the operation is to ‘‘send Gaza back to the Middle Ages.’’ Palestinian armed groups fire over 70 rockets into Israel, with Israel’s Iron Dome defense system intercepting 57 rockets, bringing the total of intercepted projectiles since the start of Operation Pillar of Defense to over 250. Tunisian FM Rafik Abdesslem makes a solidarity visit to the Gaza Strip, vowing that his government will take steps in the Arab League and UN to stop Israeli aggression. Most of the diplomatic focus is on tentative Egyptian efforts to mediate a cease-fire. In Cairo, Egyptian pres. Morsi holds talks with Turkish PM Recep Tayyip Erdogan, Qatar’s Emir Shaykh Hamad Bin-Khalifa al-Thani, Hamas leader Khalid Mishal, and Islamic Jihad leader Ramadan ‘Abdallah Shalah. Dep. head of Hamas’s politbureau Musa Abu Marzuq says despite efforts to secure a temporary cease-fire, Israel and Hamas are both far from reaching an agreement. The attacks are claimed by the PFLP, the DFLP, and the PRCs. Israel does not acknowledge the statement by the Palestinian factions. As many as 35 unidentified gunmen attack an Egyptian checkpoint near the Rafah border, fatally shooting 16 Egyptian security officers and wounding 3. Some of the assailants then steal 2 armored personnel carriers, which they pack with explosives and drive toward Kerem Shalom commercial crossing, where the borders of Egypt, Israel, and Gaza meet. The IDF calls in an air strike on the vehicles as they breach the border, killing at least 3 assailants. No group takes responsibility. Egypt seals the Rafah border crossing into Gaza as a precaution. Israel shuts the Israeli-Egypt side of Kerem Shalom and halts fuel shipments to Gaza through the Israel-Gaza side, but otherwise continues to allow limited imports of goods from Israel to Gaza. The PA cancels plans to host a meeting in Ramallah of foreign envoys representing the Non-Aligned Movement to express solidarity with the Palestinians, stating that Israel has refused to grant entry permits to the representatives of Algeria, Bangladesh, Cuba, Indonesia, and Malaysia on the grounds that their countries do not recognize the State of Israel. The PA reportedly (NYT 8/6) intended to announce plans to revive its UN statehood effort at the opening of the next UNGA session in 9/2012. The World Bank reports that the Palestinian economy is facing its worst crisis since 1994, noting that the recent growth rate of 7.7% between 2007 and 2011 is insufficient to run a state because it is overly contingent on donor aid. The report says that sustainable growth can only be met through increased trade and private sector growth, which are hampered by restrictions imposed by Israel. Separately, UN special coordinator for the Middle East peace process Robert Serry warns that the PA is facing insolvency and has been late paying government salaries because donors have failed to fulfill pledges. Hamas reports that senior IQB official Kamal Ghanaja (an aide to assassinated IQB commander Mahmud al-Mabhuh; (see QU in JPS 155) has been killed in Damascus. His body, bound and tortured, was found in his burned Damascus home. While Hamas accuses Israel of assassination, Israel says it believes the Syrian regime, angry over Hamas’s refusal to support Asad, carried out the murder. Washington Jewish Week reports that 60 rabbis representing the Washingtonbased Rabbinic Cabinet of the Jewish Federation of North America (JFNA) recently made a lobbying trip to New York to meet with the UN representatives of 12 countries (mostly Eastern European) to press the UN to reverse its ‘‘poor and unjust treatment of Israel,’’ to block Palestinian statehood efforts, and to urge the dismantling of UN committees that focus exclusively on Palestinian issues (e.g., the Division for Palestinian Rights, the Comm. on the Exercise of the Inalienable Rights of the Palestinian People, and the Special Comm. to Investigate Israeli Human Rights Practices Affecting the Palestinian People). The group was advised by fmr. U.S. ambs. to the UN Richard Shifter and Jeanne Kirkpatrick. The JFNA says it requested meetings with 14 countries, but 2 (unnamed) declined. (WJW 6/28)

In an op-ed in the New York Times, former lead Israeli peace negotiator Gilead Sher, former Israeli Security Agency head Ami Ayalon, and Israeli entrepreneur Orni Petruschka (organizers of a new group called Blue White Future) argue that since serious Israeli-Palestinian peace talks are unlikely to resume soon, Israel should adopt a “radically new unilateral approach” (which they term “constructive unilateralism”): openly “strive . . . to establish facts on the ground” that would impose a 2-state solution based on 1967 borders with Israel’s desired land swaps “regardless of whether Palestinians leaders have agreed.” The proposed borders would be based on Israel’s separation wall. At the same time, Israel would cease settlement expansion in areas that it does not intend to keep and prepare a plan to relocate settlers (they estimate 100,000) from settlements that would fall under permanent Palestinian control. Relocation would not take place, and the IDF would remain deployed in the West Bank, until the Palestinians signed a formal final-status agreement recognizing Israel’s fait accomplis. They argue that the plan meshes well with the Palestinians’ own constructive unilateralism of late (i.e., Abbas’s mission to gain UN recognition of Palestinian statehood), since it would be easier for Israel to negotiate with the Palestinians state to state. Netanyahu’s special ministerial panel examining the future of 3 unauthorized West Bank settlement outposts legalizes the outposts of Bruchin (pop. 350) and Rachelim (pop. 240) in the north, and Sansanna (pop. 240) in the south, stating that “these communities were founded in the 1990s based on the decisions of a past government.” The panel also calls on the Israeli High Court to put off the 5/1/12 deadline to evacuate 30 homes in Ulpana outpost (constructed on private Palestinian land), which the government describes as a “neighborhood of Beit El” settlement. UN. Secy.-Gen. UN Secy.-Gen Ban makes a brief visit to Gaza to inaugurate a UN-funded housing project. Relatives of Palestinians jailed in Israel try to block his entry to the Erez crossing to protest his refusal to meet with them. During the visit, Ban calls on Israel to maintain the cease-fire with Gaza and allow Gaza’s borders to open for trade. In a State of the Union address devoted to domestic affairs, Pres. Obama pointedly calls on Syrian pres. Asad to realize “that the forces of change cannot be reversed and that human dignity cannot be denied” and urges the international community to “isolate” his regime. Jordan says King Abdallah will receive Hamas leader Mishal on 1/29, when he makes his 1st official visit to Jordan in 13 yrs. Hamas officials announce that the movement’s leadership has decided to evacuate their families and most personnel fr. The Inter-Parliamentary Union (IPU) formally apologizes to Israel for allowing a Hamas mbr. to take part in a dialogue in Geneva (ca. 1/14) on Israel’s treatment of Palestinian prisoners as part of a Palestinian delegation and vows that Hamas mbrs. will be barred fr. future IPU events. Israel had threatened (1/16) to withdraw fr. the IPU in protest. The IPU is a nongovernmental organization with permanent observer status at the UN. Israeli hackers bring down the Saudi Arabian Monetary Agency and the Abu Dhabi Securities and Exchange websites, release the email addresses and passwords of 89 Saudi university students, and steal and threaten to release the Facebook login information for 30,000 account holders in Muslim countries in retaliation for the 1/16 denial of service attacks on the TASE and El Al and the 1/6 leak of Israeli credit card information. One of the Israeli hackers, Anonymous 972, issues a statement saying “Usually we do not like to hurt innocent sites, but there is now a cyber war, and every war has victims. . . . Every time an Israeli site get[s] hacked, the same thing will happen to Saudi sites.” The Israeli hacker who claims to have the Facebook information, Hannibal Hacker, also claims that he could publish bank account details of 10 million Arabs and the credit card details of 4 million Arabs if cyberattacks on Israel continue. Anonymous Israeli officials say that 2 wks. ago, Abbas, under heavy Quartet pressure (especially fr. the U.S.), submitted a proposal for restarting talks that dropped demands that Israel halt settlement construction but demanded that Israel release in exchange 100 Palestinian prisoners jailed since before the Oslo process began. Israel rejected this on the grounds that (1) it would replace 1 precondition with another, and (2) it was vague about whether the talks that would result would be preparatory talks or direct negotiations between Abbas and Netanyahu. There is no official Palestinian, U.S., or Quartet comment on this. Another Israeli official says that Israel is concerned that if talks do not resume by 1/26/12, Abbas would resume Palestinian statehood efforts at the UN, including seeking membership in various UN organizations. As of this date, Congress has freed up only $40 m. of the $192 m. in humanitarian aid to the Palestinians that was frozen in light of the UN bid (see QU in JPS 162). USAID and the White House are pressuring Congress to release the rest of the money, calling it “in the interest of the Palestinians, Israel and the United States” to ensure continued development “vital to the establishing and strengthening the foundations necessary for a future Palestinian state.” (WP 12/29)

Fatah and Hamas announce that, in keeping with their 5/2011 reconciliation deal, they have agreed on formation of a new Central Elections Commission to prepare for presidential and parliamentary elections. They fail to reach an agreement on formation of a caretaker government to take the Palestinians to elections, postponing further discussion until late 1/2012. (JPI 12/30)

After a UNSC briefing on the Middle East, 14 UNSC mbrs. criticize the U.S. (without naming it directly) for blocking any criticism of Israel’s recent approvals for new settlement construction in East Jerusalem and the West Bank and of the increasing settler violence, as well as for threatening to veto any UNSC res. supporting Palestinian statehood. British UN Ambassador Mark Lyall Grant, speaking on behalf of the European UNSC mbrs. (Britain, France, Germany, and Portugal), calls recent Israeli settlement and settler actions “devastating” to the 2-state solution, saying “Israel’s security and the realization of the Palestinians’ right to statehood are not opposing goals. On the contrary, they are mutually reinforcing objectives. But they will not be achieved while settlement building and settler violence continues.” Grant also calls on Israel and the Palestinians to send their comprehensive proposals on territory and security to the Quartet as soon as possible. The PA warns that unless Israel releases VAT taxes (suspended on 11/1/11 in violation of the 1994 Oslo Accord), it will be unable to pay civil servants salaries on 12/1 (affecting around one-third of Palestinians) and PA services would likely be disrupted. PA PM Salam alFayyad states: “With each passing day, the [PA] becomes weaker, and it is fast approaching the day when it becomes completely incapacitated.” The UN, U.S., and Quartet have each contacted Israeli PM Netanyahu in recent days to urge him to restore the transfers, with Quartet special envoy Tony Blair stating today: “Only those who oppose peace and Israeli-Palestinian cooperation benefit from the withholding of PA funds.” A Netanyahu aide says that if the PA pledges not to pursue membership in any more UN organizations and backs off planned reconciliation talks with Hamas, Israel would probably restore the transfers, saying, “The idea is to influence Palestinian decision making.” (NYT 11/24; WP 11/28)

(WP 9/24) Within 3 hrs. of Abbas’s speech, the Quartet issues a vague statement calling on Israel and the Palestinians to return to talks within a month, with the objective of reaching a final agreement within a year. While Quartet special envoy Blair heralds this as “breakthrough,” UN and U.S. officials say the idea is to delay UNSC consideration of the Palestinian application to the UN on the assumption that if talks are “underway and making progress,” the UNSC would put off a vote in hopes that the parties could reach negotiated agreement. In the West Bank, 1,000s of Palestinians gather in Ramallah’s Clock Tower Square after dark to watch Abbas’s UN address televised live and celebrate the application for statehood. Similar rallies are held across the West Bank, but are banned in Gaza by Hamas authorities, who are angry that Abbas did not consult with Hamas over the process. Observers note (e.g., NYT, WP 9/24) that the “festive mood was tempered with resentment at . . . Obama’s firm stance against the initiative.” One Palestinian on the street states (WP 9/24): “We are choking on the American double standard. America supported the movements for freedom in Egypt, Tunis, Libya and Yemen, but this stops when it comes to the Palestinian people. We are asking, why?” During the day, the regular weekly protest against the separation wall in Bil‘in, al-Nabi Salih, and Ni‘lin are turned into rallies in support of the UN statehood initiative; in al-Nabi Salih, Palestinian demonstrators burn Israeli flags and posters of Obama. Similar small rallies are held at Qalandia r.c. The IDF fires rubber-coated steel bullets, tear gas, and percussion grenades at the demonstrators, causing no serious injuries. Meanwhile, nr. Kiryat Arba settlement in Hebron, a Palestinian boy is killed in a hit-and-run by a vehicle with Israeli plates. Later in the day in the same area, a Jewish settler man and his infant son, residents of Kiryat Arba, die in a car crash; the IDF says it was an accident, but local settlers accuse the army of covering up a murder, claiming that vengeful local Palestinians stoned the vehicle causing it to crash. The IDF denies the claims and expresses concern that settlers are attempting to provoke violence on the eve of Abbas’s UN speech. Meanwhile, unarmed Palestinians patrolling the outskirts of Qusra village in the n. West Bank (subject of numerous recent attacks by Jewish settlers fr. Esh Kodesh outpost) throw stones at a group of armed Jewish settlers that try to enter the village, sparking a clash; the IDF intervenes, firing tear gas and live ammunition at the Palestinians, killing 1 Palestinian and wounding 7.
