In his State of the Union address, U.S. president Joe Biden says the U.S. military will set up a temporary pier off the coast of Gaza to deliver aid but that no U.S. soldiers will enter Gaza as it will be built offshore. During the fifth day of the ICJ hearings on the legality of the Israeli occupation of Palestinian territories, the UK argues against the ICJ providing an advisory opinion on the issue, calling the occupation a bilateral dispute. U.S. secretary of state Antony Blinken calls Israeli settlements “inconsistent with international law,” reversing what is dubbed the Pompeo Doctrine, when in 2019 the Trump administration reversed U.S. policy to declare Israeli settlements “not per se inconsistent with international law.” Blinken also calls the Israeli settlement expansion announcement from 2/22 disappointing. Israeli opposition leader Yair Lapid says he told Prime Minister Benjamin Netanyahu that he would enter the emergency government to provide a safety net in favor of a ceasefire deal to get the remaining captives released. A no confidence motion against the government at the Knesset gets 21 votes in favor, failing to obtain the 61 votes required. (HA 2/5)

UN secretary-general Antonio Guterres appoints an independent review group led by former French foreign minister Catherine Colanna to assess UNRWA’s neutrality and Israeli allegations against the agency. UK’s Channel 4 reports, after seeing the 6-page dossier Israel used to accuse 12 UNRWA staffers of taking part in Operation Al-Aqsa Flood, that Israel “provides no evidence” to back its claim. Instead, the dossier states that “from intelligence information, documents, and identity cards seized during the course of the fighting, it is now possible to flag around 190 Hamas and PIJ terrorist operatives who serve as UNRWA employees. More than 10 UNRWA staffers took part in the seventh of October.” The New York Times reports that UNRWA will lose $65 million by the end of February due to funding suspensions by Germany, Japan, and Sweden. U.S. secretary of state Antony Blinken meets with Saudi crown prince Mohammed bin Salman in Riyadh, discussing humanitarian aid to Gaza and regional diplomacy. After the meeting, Blinken says that Saudi Arabia has a strong interest in pursuing normalization with Israel but that it requires “an end to the conflict in Gaza, and a clear, credible, time-bound path to the establishment of a Palestinian state.” Blinken also announces that the U.S. will cancel visas for employees of companies that provide spyware that is used against political activists, human rights defenders, and journalists. The court issues 6 provisional measures: 1) Israel must take all possible measures to prevent acts as outlined in Article 2 of the Genocide Convention, including not killing members of a particular group [Palestinians], not causing physical or psychological harm to members of that group, not inflicting living conditions which are calculated to bring about the end of the existence of a people, and not carrying out acts to precent the births within the group. 2) Israel must ensure its military does not carry out any of the actions outlined in measure 1. 3) Israel must prevent and punish incitement to commit genocide. 4) Israel must ensure the delivery of basic services and essential humanitarian aid. 5) Israel must prevent the destruction of evidence of war crimes and allow fact-finding missions access. 6) Israel must submit a report on all steps taken to abide by the measures within 1 month. 4 of the orders are approved by 15 of the 17 judges, while 2 of the measures are approved by 16 of the 17 judges. The only judge to vote against all measures is Judge Julia Sebutinde of Uganda. Aharon Barak, the judge representing Israel, votes for measures 3 and 4. The measures issued by the court fall short of South Africa’s demand for a ceasefire. Hamas welcomes the ICJ orders and calls on the international community to force Israel to implement the decisions. The PA foreign ministry said Israel was preventing sufficient aid from entering Gaza, deliberately depriving Palestinians of their basic needs. Israeli finance minister Bezalel Smotrich said Israel will not transfer the PA its tax revenue while he is finance minister. It has been reported that U.S. president Joe Biden told Prime Minister Benjamin Netanyahu that Israel should hand over the withheld PA funds to Norway, which will keep them until an arrangement is made to safeguard against the funds going to Hamas, a proposal Netanyahu made himself and that the PA reportedly accepted. South Africa invoked the Genocide Convention calling on the International Court of Justice (ICJ) to expedite hearings on the issue of Israel committing genocide and to order Israel to immediately stop the killing of Palestinians in Gaza. In its report delivered to the ICJ, South Africa described Israel’s actions as “genocidal in character because they are intended to bring about the destruction of a substantial part of the Palestinian national, racial, and ethnical group.” The Israeli Foreign Ministry called the South African action “blood libel.” The PA welcomed the South African action. U.S. secretary of state Antony Blinken approved the sale of M107 155mm projectiles worth $147.5 million to Israel, bypassing congressional approval. It was the second time the Biden administration bypassed congressional approval for weapons transfers to Israel since 10/7. Relatedly, unnamed Israeli officials told Al-Monitor that the U.S. had started to scale down its military support to Israel due to Israel’s failure to discuss its plans for Gaza after the war. Israeli settlers also attacked Palestinian homes in Shaab al-Butum in the Masafer Yatta area, causing damage. Elsewhere, Israeli settlers attacked a motorist in the Jordan Valley, destroying his car; the man was able to escape. 1 Israeli settler wearing an Israeli military uniform was shot and killed near Beit Lid. Israeli forces shot and killed 4 Palestinians, including 1 child, during raids in Qalqilya, Jenin, and al-Bireh. Israel said 20 soldiers had been killed in Gaza since its ground invasion, leaving the Israeli death toll at around 1,400 Israelis, including foreign nationals, since 10/7. 5,431 Israelis have been injured. The UN reported that over 1.5 million Palestinians, more than half the population in Gaza, had been displaced since 10/7. There has been a complete electricity blackout in Gaza since 10/12 due to the Israel blockade. As of 10/23, at least 27,781 housing units have been destroyed and 150,000 have been damaged in Israeli airstrikes since 10/7. The number is likely much higher given the lack of recent data. For the second day in a row, around 400 foreign passport holders and about 60 injured Palestinians were evacuated to Egypt via the Rafah crossing. 102 truckloads of humanitarian aid entered Gaza. The Israeli security cabinet decided to deduct funds from the PA tax revenue that is used in Gaza, in addition to the funds it deducts from the PA that are said to be used for paying stipends to the families of Palestinian prisoners and Palestinians killed by Israel. The cabinet also decided to no longer allow Palestinians from Gaza to work in Israel and to send those held in the Israeli internment camps back to Gaza. Interior Minister Moshe Arbel approved a memorandum making it easier for Israel to revoke the citizenship for people accused of supporting, inciting, or identifying with a terrorist organization. Arbel also transferred $50.4 million to 67 Palestinian municipalities in Israel after the funds had been frozen by Finance Minister Bezalel Smotrich since July. Israeli military chief of staff Herzl Halevi said Israel would allow fuel to enter Gaza to keep hospitals running. However, Prime Minister Netanyahu’s office rejected the move. The U.S. House of Representatives passed a bill that would provide $14.3 billion in aid to Israel and deduct the same amount from the Internal Revenue Service (IRS). In the West Bank, Israeli settlers injured 5 Palestinians in Yasuf, including 3 with live ammunition and 2 with stones. Israeli settlers also assaulted Palestinians harvesting olives in Deir Istiya and al-Khader. A Palestinian family of 16 fled their home in Khirbet ar-Ratheem, south of Hebron, after Israeli settlers raided the area, causing destruction to their property and threatening them with guns. Israeli forces shot and killed a Palestinian minor during a raid in Jericho. Israeli forces also shot and injured 10 Palestinians with live ammunition during raids in Askar refugee camp, Beita, and Deir as-Sudan. Elsewhere, Israeli forces punitively demolished the home of a Palestinian man in Aqabat Jaber refugee camp using explosives. Israeli forces also seized Hamas political bureau deputy leader Salah al-Arouri’s home in Bani Zeid al-Sharqiya, turning it in to a Shin Bet facility. Meanwhile, Israeli forces prevented Palestinians from harvesting olives in Duma, Burin, Zabbuba, and Sebastia. More than 120 Palestinians were arrested during late-night raids in Aroura, Rantis, Bethlehem, Hebron, Deir Sammit, and Nablus. The Palestinian Prisoners Club said at least 1,070 Palestinians have been arrested in the West Bank since 10/7. In Gaza, around 250 Palestinians were killed in Israeli airstrikes. Rockets were fired at Israel; no new fatalities were reported. In Lebanon, anti-tank missiles fired at Israel wounded an Israeli soldier and Israel attacked Hezbollah-linked sites. The Gaza Ministry of Health said as of 5 p.m. at least 4,385 Palestinians had been killed, including at least 1,524 children, and 13,561 had been injured in Israeli airstrikes on Gaza since 10/7, including 47 entire families consisting of 500 people. The UN said that about 70% of Palestinians killed in Gaza are children and women. It is estimated that hundreds are still trapped in rubble. In addition, Israeli media reported that 1,500 Palestinian militants have been killed near Gaza. 84 Palestinians have been killed by Israeli forces and settlers in the West Bank and East Jerusalem since 10/7, including 26 children. More than 1,653 have been injured, including at least 360 with live ammunition. The UN reported that over 1.4 million Palestinians, more than half the population in Gaza, have been displaced since 10/7 and that since 11 p.m. on 10/12 there has been a complete electricity blackout due to the Israeli blockade. At least 26,756 housing units have been destroyed and 139,000 have been damaged in Israeli airstrikes since 10/7. At least 42% of all housing units have been either destroyed or damaged in Israeli airstrikes. 43 unidentified Palestinians were buried in a mass grave in Gaza City. It was the second time Palestinians in Gaza were buried in mass graves this week. The Palestinian Health Ministry said 37 medical personnel have been killed since 10/7 and 7 hospitals no longer are operational. The first trucks carrying aid to Gaza arrived through the Rafah crossing. About 35 trucks carrying aid entered Gaza. Israeli military spokesperson Daniel Hagari said fuel will not enter Gaza via the Rafah crossing. Jordanian king Abdullah II said “[t]oday Israel is literally starving civilians in Gaza but for decades Palestinians have been starved of hope, of freedom and of future,” complaining that Israel is never held accountable and calling its actions in Gaza a war crime. UN secretary-general Antonio Guterres said Hamas’ attack does not justify “collective punishment of the Palestinian people.” PA president Mahmoud Abbas called on Hamas and Israel to release all captives and prisoners.
