Elsewhere, Israeli forces demolish 2 homes in as-Samu and 2 homes under construction in al-Simiya. Israeli forces also seize a rickshaw in Deir Balut. Anera, the second largest humanitarian organization in Gaza, suspends operations following the Israeli attack on World Central Kitchen aid workers on 4/1 that killed 7 people. 140 countries sign letters to the presidents of the UN Security Council and the General Assembly, and UN secretary-general Antonio Guterres supporting Palestine gaining full UN membership. The Security Council would have to approve full membership for Palestine before the General Assembly can vote on approval. U.S. deputy ambassador to the UN Robert Wood says the U.S. position remains that the issue of Palestinian statehood is a final status issue to be decided in talks between Israel and Palestine. PA prime minister Mohammad Mustafa addresses the first cabinet meeting of the new government, outlining 3 major priorities: easing the hardship of Palestinians in Gaza, achieving financial stability, and reform of public institutions to make them more productive, accountable, and transparent. Mustafa also speaks with UK foreign secretary David Cameron, Egyptian prime minister Mustafa Madbouly, and Japanese foreign minister Yoko Kamikawa in separate phone calls. PA president Mahmoud Abbas speaks with Jordanian king Abdullah II in a phone call, saying he supports Jordan as external forces are trying to interfere in internal Jordanian affairs, exploiting the situation in Gaza. It is not immediately clear what Abbas is referring to, but it could relate to the more than week-long protests outside of the Israeli embassy in Amman. The UN Security Council discusses Israel’s attack on the Iranian consulate in Damascus on 4/1. The Russian and Iranian ambassadors condemn the attack, as does Secretary-General Guterres who says the “inviolability of diplomatic and consular premises and personnel must be respected in all cases in accordance with international law.” The U.S., France, and the UK do not condemn the Israeli attack but say that diplomatic structures should be protected. U.S. secretary of state Antony Blinken meets with French president Emmanuel Macron in Paris. Blinken says the U.S. is in contact with Israel on how to distribute aid in Gaza, adding not enough aid is getting in. (HA 4/2)

47,800 Americans in Wisconsin vote “uninstructed” in the Democratic primary election, more than the 20,682 votes President Joe Biden defeated Donald Trump by in the state in 2020. Israeli forces also punitively demolish the family home in Hebron of a Palestinian man killed by Israeli forces in Beit Jala on 11/16/2023; the demolition is carried out with explosives, damaging other apartments in the building. Elsewhere, Israeli forces demolish an agricultural structure in Yatma. Israeli forces also arrest 5 Palestinians during a raid in Jenin. In East Jerusalem, Israeli forces arrest 10 Palestinians, including 4 children, at the Haram al-Sharif compound. In Gaza, Israeli forces bomb Gaza City, Rafah, Maghazi, Dayr al-Balah, and Khan Yunis, killing at least 130 people. Israeli forces also shoot and kill a Palestinian doctor while his is operating on a patient in the Nasser Hospital in Khan Yunis. In Lebanon, Hezbollah attacks 2 Israeli bases, injuring 3 soldiers in Kiryat Shmona. 30 rockets are also fired at Ein Zeitim and Dalton. UN high commissioner for human rights Volker Turk says Israel’s destruction of homes to create a buffer zone in Gaza “amounts to a grave breach of the Fourth Geneva Convention and [is] a war crime.” (AJ, NYT 2/8)

U.S. secretary of state Antony Blinken meets with Israeli war cabinet members Benny Gantz and Gadi Eisenkot and opposition leader Yair Lapid on the second day of his visit to Israel. National Security Council spokesperson John Kirby says Israel moving its troops to Rafah “without due consideration for their [Palestinians sheltering there] safety would be a disaster and we would not support it.” President Joe Biden issues a memorandum saying countries receiving U.S. military aid must assure the U.S. that they are adhering to international law and requiring the state and defense departments to send a report to Congress within 90 days on the use of U.S.-supplied weapons. Biden also says in a speech that Israel’s response in Gaza has been “over the top,” and that innocent people in Gaza are “starving, in trouble and dying. PA prime minister Mohammed Shtayyeh says Israel has not transferred the PA tax funds to Norway and that the PA has not received any of the money. President Mahmoud Abbas meets with French foreign minister Stephane Sejourne in Ramallah, calling on France to recognize the state of Palestine. Israeli opposition leader Yair Lapid says he told Prime Minister Benjamin Netanyahu that he would enter the emergency government to provide a safety net in favor of a ceasefire deal to get the remaining captives released. A no confidence motion against the government at the Knesset gets 21 votes in favor, failing to obtain the 61 votes required. (HA 2/5)

UN secretary-general Antonio Guterres appoints an independent review group led by former French foreign minister Catherine Colanna to assess UNRWA’s neutrality and Israeli allegations against the agency. UK’s Channel 4 reports, after seeing the 6-page dossier Israel used to accuse 12 UNRWA staffers of taking part in Operation Al-Aqsa Flood, that Israel “provides no evidence” to back its claim. Instead, the dossier states that “from intelligence information, documents, and identity cards seized during the course of the fighting, it is now possible to flag around 190 Hamas and PIJ terrorist operatives who serve as UNRWA employees. More than 10 UNRWA staffers took part in the seventh of October.” The New York Times reports that UNRWA will lose $65 million by the end of February due to funding suspensions by Germany, Japan, and Sweden. U.S. secretary of state Antony Blinken meets with Saudi crown prince Mohammed bin Salman in Riyadh, discussing humanitarian aid to Gaza and regional diplomacy. After the meeting, Blinken says that Saudi Arabia has a strong interest in pursuing normalization with Israel but that it requires “an end to the conflict in Gaza, and a clear, credible, time-bound path to the establishment of a Palestinian state.” Blinken also announces that the U.S. will cancel visas for employees of companies that provide spyware that is used against political activists, human rights defenders, and journalists. The UN Security Council meets to discuss the ICJ ruling on provisional measures. PA ambassador to the UN Riyad Mansour says a ceasefire is needed to implement the provisional measures instituted by the ICJ on 1/26. UN under-secretary-general for humanitarian affairs and emergency relief coordination Martin Griffiths calls the relief entering Gaza “grossly inadequate.” UN secretary-general Antonio Guterres calls UNRWA the “backbone of all humanitarian response in Gaza” and iterates his call for countries that have suspended funding for the agency to reverse their decisions. Israeli Channel 12 reports that Mossad director David Barnea briefed the Israeli cabinet on the ceasefire negotiations held over the weekend. Prime Minister Benjamin Netanyahu writes on X that his “red lines” on an agreement are that Israel will not end the war and will not release “thousands of terrorists,” refering to Palestinian prisoners. National Security Minister Itamar Ben-Gvir writes a letter to Netanyahu calling on him to block aid from entering Gaza. South African foreign minister Naledi Pandor says Israel is ignoring the ICJ ruling on provisional measures. The U.S. House of Representatives passes H.R. 6679, preventing entry to the U.S. of members of the PLO, Hamas, and Islamic Jihad in a 422-2 vote. The bill would need to be approved by both the Senate and the president. PLO secretary-general Hussein al-Sheikh calls the bill a “dangerous decision” and demands a response from the Biden administration. Haaretz reports that Israeli commanders have instructed soldiers to set fire to Palestinian homes in Gaza and that in the past months hundreds of homes have been destroyed by Israeli soldiers setting fire to them. A photo of a note left behind by Israeli soldiers reads “[w]e are not burning the house so you can enjoy it, and when you leave – you will know what to do.” (HA 1/31)

Haaretz also reports that in the aftermath of 10/7/2023, Zaka community emergency response volunteers staged scenes in Israeli villages that were attacked to attract donations for the organization instead of properly handling bodies of deceased Israelis and spread accounts of atrocities that never happened to garner media attention. The Israeli military decided from 10/7/2023 to let Zaka handle the bodies of the dead instead of using its unit trained in the identification and collection of human remains. (HA 1/31)

Ynet reports that Prime Minister Netanyahu told the UN envoys from Malta, Bulgaria, Czechia, Hungary, Romania, Ukraine, Slovenia, and Sierra Leone that UNRWA must be replaced during a meeting in Jerusalem. (AJ, AP, REU 1/31)

Axios reports that U.S. secretary of state Antony Blinken has instructed the State Department to review and present policy options on U.S. and international recognition of a Palestinian state. A senior U.S. official tells Axios that some people in the Biden administration think that recognition of a Palestinian state should be the first step toward ending the Israeli occupation rather than the last. U.S. National Security Council spokesperson John Kirby says the U.S. is looking for an extended pause in fighting in Gaza. State Department spokesperson Matthew Miller says the U.S. has warned Israel about reducing the size of Gaza. (AJ, HA 1/31)

A federal judge in Oakland, California, dismisses a lawsuit brought by Palestinian Americans seeking to end U.S. support for Israel’s campaign in Gaza on the basis of genocide, saying he would have issued an injunction but is legally not able to do so due to a lack of jurisdiction. The judge, Jeffrey White, instead implores the Biden administration to “examine the results of their unflagging support” of Israel on the basis that “it is plausible that Israel’s conduct amounts to genocide.” (NYT 1/31; AJ, INT, HA 2/1)

The city of Chicago follows a number of other U.S. cities in calling for a ceasefire in Gaza. The ICJ rules that there is a basis to further investigate the South African genocide case against Israel and that the ICJ has jurisdiction to hear the case. The court issues 6 provisional measures: 1) Israel must take all possible measures to prevent acts as outlined in Article 2 of the Genocide Convention, including not killing members of a particular group [Palestinians], not causing physical or psychological harm to members of that group, not inflicting living conditions which are calculated to bring about the end of the existence of a people, and not carrying out acts to precent the births within the group. 2) Israel must ensure its military does not carry out any of the actions outlined in measure 1. 3) Israel must prevent and punish incitement to commit genocide. 4) Israel must ensure the delivery of basic services and essential humanitarian aid. 5) Israel must prevent the destruction of evidence of war crimes and allow fact-finding missions access. 6) Israel must submit a report on all steps taken to abide by the measures within 1 month. 4 of the orders are approved by 15 of the 17 judges, while 2 of the measures are approved by 16 of the 17 judges. The only judge to vote against all measures is Judge Julia Sebutinde of Uganda. Aharon Barak, the judge representing Israel, votes for measures 3 and 4. The measures issued by the court fall short of South Africa’s demand for a ceasefire. Hamas welcomes the ICJ orders and calls on the international community to force Israel to implement the decisions. PA ambassador to the UN Riyad Mansour calls the measures against Israel “historic.” South Africa calls the ruling a “decisive victory.” Israeli prime minister Benjamin Netanyahu instructs his ministers not to comment on the ICJ decision and calls the ruling “outrageous.” The U.S. State Department says the ICJ did not “make a finding about genocide” despite the court specifically saying that it is continuing its trial of Israel on charges of genocide. Axios reports that President Biden’s patience with Israeli prime minister Benjamin Netanyahu is running out, citing unnamed U.S. officials. Biden is said to have spoken to Netanyahu almost every other day since 10/7 until a phone call on 12/23 where Biden ended the conversation in anger over Israel withholding the PA’s tax revenue, not allowing enough aid to enter Gaza, the intensity of the Israeli bombing of Gaza, and the lack of engagement on plans for after Israel’s war. Senator Chris Van Hollen (D-MD) tells Axios that “Netanyahu has given Biden the finger” at every juncture and that the Biden administration pleads with Netanyahu but gets “slapped in the face over and over again.” Axios also says Secretary Blinken’s visit to Israel earlier in the week was contentious due to the Israeli refusal to pay the PA its full tax revenue. Israeli Channel 12 reports that war cabinet member Gadi Eisenkot pressed the rest of the war cabinet to make a deal with Hamas to free the remaining captives, however, Prime Minister Benjamin Netanyahu and Defense Minister Yoav Gallant reportedly disagreed, saying military pressure is the only way forward. A UN Security Council resolution calling for ceasefire and the unconditional release of the Hamas-held captives was vetoed by the U.S., with the UK abstaining and the remaining 13 members voting in favor. Before the vote, PA UN envoy Riyad Mansour said the objective of the Israeli campaign was to ethnically cleanse Gaza, adding Israeli representatives were publicly admitting it. U.S. UN ambassador Robert Wood said the Hamas attack on 10/7 was the “worst attack on our people” in decades. Qatar, Egypt, and the U.S. said they were working on reinstating the ceasefire which expired at 7 a.m. Israel confirmed that 4 captives held by Hamas had died. The U.S. parroted Israel’s explanation for the not extending the ceasefire, saying that Hamas did not produce a list of captives for exchange. Israeli finance minister Bezalel Smotrich said he told Prime Minister Benjamin Netanyahu to announce that Israel will not negotiate another ceasefire until all captives are released from Gaza. Hamas said it was Israel who undermined extending the ceasefire by rejecting 3 separate options presented to them by mediators, but that Israel had already decided to resume its attacks. The PA said it held the U.S. responsible for the resumption of Israeli attacks on Gaza. Israel said that Hamas still holds 137 captives, including 4 from before 10/7. During the temporary ceasefire 240 Palestinians, 107 children and 133 adults, including 65 18-year-olds and 68 women, were exchanged for 105 captives held by Hamas. 75% of the Palestinians were not convicted of a crime, most were arrested within the past year with 37 since 10/7. 1 person self-immolated outside of the Israeli consulate in Atlanta. Authorities said a Palestinian flag was recovered at the scene. The individual was said to be in critical condition. The UN said Deputy Special Coordinator for the Middle East peace process Lynn Hastings would be replaced after Israel refused to renew her visa. In the West Bank, Israeli settlers began constructing a settler road to Givat Allam on land belonging to residents of Khirbet Yanun. 30 Palestinians were released from Israeli prisons, 15 women and 15 children, on the fifth day of the prisoner exchange. 12 captives held in Gaza were released to Israel, including 10 Israeli women and 2 Thai nationals. A Palestinian man held in Israeli prison, Majad Ahmed Zaqoul, died in Israeli custody at the Ofer prison, being the third Palestinian to die in Israeli prison since 10/7. Zaqoul was working in Israel on 10/7 and was arrested by Israel shortly after. Israel has not investigated the death of the 2 other Palestinians who died while in Israeli custody since 10/7. The PA refused to accept the partial transfer of its tax revenue collected by Israel after Israel decided to withhold sums earmarked for administration expenses in Gaza, in addition to the funds withheld that Israel says the PA pays to the families of Palestinian detainees and Palestinians killed by Israeli forces. Qatar condemned Israel for claiming that there was a tunnel system under the Qatar-funded Sheikh Hamad Hospital in Gaza. The 15 UN Security Council members failed to agree to a resolution on Israel’s attacks on Gaza. U.S. National Security Council spokesperson John Kirby said President Joe Biden and Prime Minister Netanyahu had discussed “tactical pauses.” Axios later reported that Biden asked Netanyahu for a 3-day ceasefire to allow sufficient aid to enter Gaza. In return, Hamas would release 10-15 captives and verify the identities of the remaining captives, a proposal Netanyahu reportedly rejected. Netanyahu told ABC News that a ceasefire depended on the release of the Hamas-held captives, but that Israel could allow “tactical pauses.” Netanyahu also said Israel will maintain the “overall security responsibility” for Gaza for “an indefinite period” when Israel has finished its campaign. Qatar called the attack “a new massacre against the defenseless Palestinian people.” Scottish first minister Humza Yousaf said “I am sorry to those innocent men, women and children in Jabalia Refugee Camp that the world could not protect you. The Pentagon said the U.S. has soldiers in Israel helping with identifying captives held by Hamas. The U.S. criticized Lebanon for not filling its presidency, leaving it vacant for 365 days. The Gaza Ministry of Health said as of 5 p.m. at least 6,547 Palestinians had been killed, including at least 4,000 women and children, and 17,439 had been injured in Israeli airstrikes on Gaza since 10/7. It is estimated that 1,500 were trapped in rubble. In addition, Israeli media reported that 1,500 Palestinian militants have been killed near Gaza. 102 Palestinians have been killed by Israeli forces and settlers in the West Bank and East Jerusalem since 10/7, including 29 children. More than 1,833 have been injured. Israeli officials recorded no new fatalities, leaving the Israeli death toll at around 1,400 Israelis and foreign nationals; 5,431 have been injured since 10/7. The UN reported that over 1.4 million Palestinians, more than half the population in Gaza, have been displaced since 10/7 and that since 11 p.m. on 10/12 there has been a complete electricity blackout due to the Israeli blockade. At least 27,781 housing units have been destroyed and 150,000 have been damaged in Israeli airstrikes since 10/7. At least 45% of all housing units have been either destroyed or damaged in Israeli airstrikes. The Committee to Protect Journalists said at least 24 journalists have been killed since 10/7, including 20 Palestinians, 3 Israelis, and 1 Lebanese. The UN said the shortage of fuel was undermining its efforts to help Palestinians in Gaza. Israel told 40,000 Palestinians in Dayr al-Balah and Khan Yunis to evacuate to al-Mawasi. The Palestinian Federation of Trade Unions said between 9,000 and 9,500 Palestinians from Gaza, employed in Israel, were in Israel on 10/7. 5,000 of them made it to the West Bank, with some 2,000 of them subsequently being arrested by Israel while 1,000 are unaccounted for. A Palestinian worker told Haaretz after he was released from an Israeli detention camp that Palestinians were held in the sun for 2 days without food, while they were blindfolded and their hands were tied. Human Rights Watch said the data provided by the ministry is accurate, saying their own investigations are aligned with the ministry’s data. Biden also criticized Israeli settlers for “attacking Palestinians in places that they are entitled to be.” After a call with Israeli prime minister Benjamin Netanyahu, a readout of the conversation stated that they discussed a “pathway for a permanent peace.” Newly elected House of Representatives speaker Mike Johnson’s first act as speaker was to bring a pro-Israel resolution to the floor, which passed 412-10, with 6 voting present. At the UN Security Council, the U.S. and UK vetoed a Russian resolution calling for a humanitarian ceasefire. China, Gabon, Russia, and the UAE voted for the resolution while the 9 other members abstained. Russia and China vetoed a U.S. resolution calling for “humanitarian pauses.” The UAE also voted against it, while Albania, France, Ecuador, Gabon, Ghana, Japan, Malta, Switzerland, and the UK voted in favor.
