PA president Mahmoud Abbas appoints the current chairperson of the Palestine Investment Fund and former deputy prime minister and minister of national economy, Mohammed Mustafa, as the new PA prime minister. Abbas says in a statement that he asked Mustafa to create a plan to re-unify the administration of Gaza and the West Bank, lead reforms in the PA government, security services, and economy, and fight corruption. The U.S. National Security Council welcomes the appointment of Mustafa. UK foreign secretary David Cameron also welcomes the appointment. According to Axios, State Department and White House officials have met with Mustafa and heard his plans for post-war Gaza and rehabilitating the PA economy. The PA condemns Israel for setting up barriers and gates around the Haram al-Sharif compound ahead of Friday prayers. The PA also calls on the ICC to summon Israeli national security minister Itamar Ben-Gvir for incitement to kill Palestinians, citing his statement in support of the killing of a Palestinian child in East Jerusalem on 3/12. Reuters reports that Hamas has submitted a 2-stage ceasefire proposal where the first stage would see Israeli women, children, elderly, and ill captives, including female soldiers, exchanged for 700-1,000 Palestinian prisoners. During the first stage a date for a permanent ceasefire and a deadline for Israeli withdrawal from Gaza would be set. The remaining captives would be released in another prisoner exchange. The Israeli prime minister’s office calls Hamas’s terms “unrealistic” but says the war and security cabinets will discuss the proposal on 3/15. Senate Majority Leader Chuck Schumer (D-NY) calls for new elections in Israel, calling Israeli prime minister Benjamin Netanyahu 1 of 4 major obstacles for peace, along with “radical right-wing Israelis in government and society,” Hamas, and PA president Abbas. Schumer also says that if Netanyahu remains in power then the U.S. should “play a more active role in shaping Israeli policy by using our leverage to change the present course.” House speaker Mike Johnson (R-LA) says he may introduce a standalone bill for aid to Israel, saying Schumer’s comment “made the situation even more urgent.” The House has already passed 2 Israel funding bills, which Schumer has rejected as Senate Democrats want to tie Israel funding to Ukraine funding. Leader of the Houthi movement Abdul-Malik al-Houthi says Houthi forces will attack Israeli-linked ships in the Indian Ocean that are circumventing the blockade of the Red Sea by going south of the African continent. The European Parliament pass a resolution denouncing the “catastrophic humanitarian situation in Gaza, including the risk of imminent starvation.” EU commissioner for crisis management Janez Lenarcic says that neither the EU, nor to his knowledge any other UNRWA donor, has been presented with any evidence against UNRWA employees by Israel. Israeli finance minister Bezalel Smotrich says, “the Egyptians bear considerable responsibility for October 7.” A spokesperson for the Egyptian Foreign Ministry says Smotrich is trying to divert attention from Israel’s own shortcomings. Foreign Minister Israel Katz and Interior Minister Moshe Arbel say UN special rapporteur on the Palestinian territories Francesca Albanese will be banned from Israel, citing her comments that the “victims of 7/10 were not killed because of their Judaism, but in response to Israel’s oppression.” U.S. representative to the UN Human Rights Council Michele Taylor accuses Albanese of having a “history of using anti-Semitic tropes.” (AJ, HA 2/12; AJ 2/13)

U.S. president Joe Biden meets with Jordanian king Abdullah II at the White House. Biden tells the press that Palestinians in Rafah need to be protected. The UN Security Council meets to discuss the situation in Rafah and an Algerian draft resolution calling for a ceasefire. Stephane Dujarric, spokesperson for the UN secretary-general, says the UN will not play a part in Israel’s plans for evacuation of Rafah, saying “there is no place that is currently safe in Gaza.” ICC chief prosecutor Karim Khan says he is deeply concerned about Israel’s plans in Rafah, adding “[a]ll wars have rules and the laws applicable to armed conflict cannot be interpreted so as to render them hollow or devoid of meaning.” Khan also says Israel has not changed its conduct in Gaza and “those who do not comply with the law should not complain later when my Office takes action pursuant to its mandate.” (AJ, HA, NYT 2/12; AJ, HA 2/13)

The U.S. Senate votes 70-29 to approve a bill which if approved by the House and President Biden would provide $95 billion in military aid to Ukraine, Taiwan, and Israel, including $14 billion to Israel, ban funding of UNRWA, and provide $9.15 billion in humanitarian assistance to civilians in conflict zones, including in Gaza and the West Bank. Biden calls on the House to immediately approve the Senate bill, which he says, “provides Israel with what it needs to protect its people against the terrorist groups like Hamas and Hezbollah and others.” Before voting in favor of the bill, Senator Chris Van Hollen (D-MD) says Israel is committing “textbook” war crimes in Gaza. PA ambassador to the UN Riyad Mansour says a ceasefire is needed to implement the provisional measures instituted by the ICJ on 1/26. UN under-secretary-general for humanitarian affairs and emergency relief coordination Martin Griffiths calls the relief entering Gaza “grossly inadequate.” UN secretary-general Antonio Guterres calls UNRWA the “backbone of all humanitarian response in Gaza” and iterates his call for countries that have suspended funding for the agency to reverse their decisions. Israeli Channel 12 reports that Mossad director David Barnea briefed the Israeli cabinet on the ceasefire negotiations held over the weekend. Prime Minister Benjamin Netanyahu writes on X that his “red lines” on an agreement are that Israel will not end the war and will not release “thousands of terrorists,” refering to Palestinian prisoners. National Security Minister Itamar Ben-Gvir writes a letter to Netanyahu calling on him to block aid from entering Gaza. The U.S. House of Representatives passes H.R. 6679, preventing entry to the U.S. of members of the PLO, Hamas, and Islamic Jihad in a 422-2 vote. The bill would need to be approved by both the Senate and the president. PLO secretary-general Hussein al-Sheikh calls the bill a “dangerous decision” and demands a response from the Biden administration. Haaretz reports that Israeli commanders have instructed soldiers to set fire to Palestinian homes in Gaza and that in the past months hundreds of homes have been destroyed by Israeli soldiers setting fire to them. A photo of a note left behind by Israeli soldiers reads “[w]e are not burning the house so you can enjoy it, and when you leave – you will know what to do.” (HA 1/31)

Haaretz also reports that in the aftermath of 10/7/2023, Zaka community emergency response volunteers staged scenes in Israeli villages that were attacked to attract donations for the organization instead of properly handling bodies of deceased Israelis and spread accounts of atrocities that never happened to garner media attention. The Israeli military decided from 10/7/2023 to let Zaka handle the bodies of the dead instead of using its unit trained in the identification and collection of human remains. (HA 1/31)

Ynet reports that Prime Minister Netanyahu told the UN envoys from Malta, Bulgaria, Czechia, Hungary, Romania, Ukraine, Slovenia, and Sierra Leone that UNRWA must be replaced during a meeting in Jerusalem. (AJ, AP, REU 1/31)

Axios reports that U.S. secretary of state Antony Blinken has instructed the State Department to review and present policy options on U.S. and international recognition of a Palestinian state. A senior U.S. official tells Axios that some people in the Biden administration think that recognition of a Palestinian state should be the first step toward ending the Israeli occupation rather than the last. U.S. National Security Council spokesperson John Kirby says the U.S. is looking for an extended pause in fighting in Gaza. State Department spokesperson Matthew Miller says the U.S. has warned Israel about reducing the size of Gaza. (AJ, HA 1/31)

A federal judge in Oakland, California, dismisses a lawsuit brought by Palestinian Americans seeking to end U.S. support for Israel’s campaign in Gaza on the basis of genocide, saying he would have issued an injunction but is legally not able to do so due to a lack of jurisdiction. The judge, Jeffrey White, instead implores the Biden administration to “examine the results of their unflagging support” of Israel on the basis that “it is plausible that Israel’s conduct amounts to genocide.” (NYT 1/31; AJ, INT, HA 2/1)

The city of Chicago follows a number of other U.S. cities in calling for a ceasefire in Gaza. Some 70 cities in the U.S., including Atlanta, Minneapolis, Seattle, Detroit, and St. Louis, have passed resolutions on the Israeli attacks on Gaza with most calling for a ceasefire. Egypt presented a proposal for ending Israel’s assault on Gaza to Israel, Hamas, the U.S., and European governments that would see Israel withdraw from Gaza, all the captives released from Gaza, many Palestinian prisoners freed by Israel, and a united technocratic Palestinian government installed. In the first stage of the plan, all civilian captives would be released over a 7 to 10 day ceasefire period where Palestinian prisoners would also be released. The second stage would see all female soldiers released in exchange for Palestinian prisoners over a weeklong period. In the last stage, Hamas and Israel would negotiate the release of the remaining captives and Palestinian prisoners. Hamas political leader Ismail Haniyeh arrived in Cairo for talks with Egyptian officials. Hamas official Ghazi Hamad told Al Jazeera that the party had tried to contact Fatah to begin talks about the situation in Gaza now and the future of a unified Palestinian political system, but that PA president Mahmoud Abbas had rejected talks. The Wall Street Journal reported that Hamas’ political bureau was in talks with other Palestinian factions about the situation in Gaza after the Israeli attack. Political bureau member Husam Badran told the Journal that the talks also included former Palestinian prime minister Salam Fayyad and former Fatah member Mohammed Dahlan. The Journal also reported that Hamas turned down a proposal to exchange a weeklong ceasefire for 40 captives held in Gaza. The Israeli security cabinet approved the reopening of the Karem Abu Salem (Kerem Shalom) crossing for humanitarian aid after U.S. pressure. Haaretz reported that the Israeli military, with approval from Religious Zionism leader Bezalel Smotrich and Otzma Yehudit leader  Itamar Ben-Gvir, had allowed 10,000 Palestinians from the West Bank to work in Israeli settlements upon request from settlement leaders. The Foreign Press Association and Al Jazeera condemned the Israeli killing of Al Jazeera journalist Samer Abudaqa. Al Jazeera said it would refer the killing of Abudaqa to the ICC. The Association for Civil Rights in Israel (ACRI) said Israel has established 100 “Community Security Squads” equipped with M16 rifles, adding the members of the militias have only received 7 hours of training and lacked proper oversight. Turkish president Recep Tayyip Erdoğan said “I consider even the debating of this plan as disrespectful to my Palestinian siblings. For us, this is not a plan that can be debated, considered, or discussed,” referring to Israeli suggestions that a buffer zone should be made within Gaza. The U.S. Senate failed to pass a $111 billion bill to provide $50 billion to Ukraine and $14 billion to Israel in a 49-51 vote. All Republicans and Democratic senators Bernie Sanders (D-VT) and Chuck Schumer (D-NY) voted against the bill. Republicans sought to separate the aid for Israel from the aid for Ukraine as many Republican senators are opposed to significant spending on Ukraine, while Sanders opposed spending on Israel given the Palestinian death toll in Gaza. Reuters reported that an “orientation note” circulated among EU foreign ministers ahead of a meeting showed the EU was considering tougher sanctions on Hamas and imposing sanctions against violent Israeli settlers. Israel claimed that it placed 80 gallons of diesel fuel near al-Shifa Hospital a day after the hospital ran out of fuel, saying Hamas had prevented the fuel from entering the hospital. Israeli military spokesperson Richard Hecht said Israel may not use the same “level of fidelity” in warning civilians before striking homes and apartment buildings. It had been reported that Israel no longer used smaller munitions to “knock” on the roofs of apartment buildings or call building managers before demolishing them with larger bombs. Hecht also called the parliament and ministries in Gaza legitimate targets. U.S. president Joe Biden gave a televised speech calling the Hamas operation on 10/7 “pure, unadulterated evil,” recounting unconfirmed Israeli narratives of militants committing rapes. Biden also compared Hamas to ISIS, attributed the operation to anti-Semitism, rather than resistance, and reiterated his stance in support of Israel, saying Israel has a “duty to respond,” despite the mass civilian casualties in Gaza. Biden further stated that the U.S. is sending ammunition and interceptors for the Iron dome to Israel. Lastly, Biden warned other countries and organizations against getting involved against Israel. Hamas called Biden’s speech deplorable and inflammatory, saying Hamas launched its operation to defend the Palestinian people and put an end to the occupation. Biden also spoke with Prime Minister Netanyahu about U.S. assistance. 392 members of the U.S. House of Representatives co-sponsored a resolution in support of Israel, calling the Hamas operation “barbaric.” It is unknown if the resolution will pass, as it is unclear if the acting speaker of the House Patrick McHenry (R-NC) has the authority to bring the resolution to the floor. EU high commissioner for foreign affairs Josep Borell said he had invited PA and Israeli foreign ministers Riyad al-Maliki and Eli Cohen to an EU foreign ministers meeting to discuss the situation in Palestine and Israel. Borell also said that Israel must adhere to international law, saying Israel violates the law by imposing a total blockade on Gaza. The UN high commissioner for human rights Volker Turk said the total siege of Gaza imposed by Israel was illegal under international law as it deprives civilians of goods essential to their survival. The Zionist anti-occupation organization Americans for Peace Now announced it had changed its position on U.S. military aid to Israel, saying it supports conditioning the aid. Israeli forces shot and injured 1 Palestinian-Israeli minor in Lydda, claiming he tried to throw a firebomb at them. 5 Palestinian-Israelis were arrested in Umm al-Fahm after a fire was ignited at the town’s city hall. 9 Palestinian-Israelis were arrested in ‘Akka. Israeli forces violently dispersed Palestinian-Israeli protesters in Kafr Kana, injuring 28. Israel also told international news outlets that it would conduct a ground invasion of Gaza shortly and then later apologized to the news outlets for providing false information; analysts suspected that Israel used the media outlets to lure Hamas militants into tunnels before heavily bombarding said tunnels; Israel said that dozens were killed in the attack on the tunnels. Israel denied responsibility and the interior ministry in Gaza said it would investigate the incident; the investigation concluded on 3/11 with the government saying an Israeli drone laden with explosive was caught in a fishermen’s net, killing the 3 fishermen. the Al Mezan Center for Human Rights had claimed that it was a militant faction from Gaza who was responsible. Israeli naval forces had earlier in the day opened fire at Palestinian fishermen within 3 nautical miles west of Gaza city, causing damage to 1 boat. 1 Palestinian man was sentenced to 2 years in prison, based on a plea bargain, by an Israeli military judge for not preventing an attack on an Israeli settler and for being a member of the PFLP. In the sentencing, the judge said a plea bargain had been reached, reducing the sentence because several Palestinians had been tortured during the interrogation related to the case. According to Axios, PA civil affairs minister Hussein al-Sheikh sent a letter to the U.S. deputy assistant secretary of state for Israel-Palestine Hady Amr asking for U.S. support in the upcoming Palestinian elections and saying that Hamas has committed itself to nonviolence and the PLO parameters for a 2-state solution. U.S. secretary of state Mike Pompeo announced that the U.S. administration had sanctioned ICC prosecutor Fatou Bensouda and head of the ICC’s Jurisdiction, Complementarity, and Cooperation Division Phakiso Mochochoko. In a recorded video, U.S. president Trump celebrates the opening and says the U.S. “remains fully committed to facilitating a lasting peace agreement” between Israel and the Palestinians. Outside the ceremony, Israeli police violently disperse approximately 200 protesters, including Joint List MKs Ahmad Tibi, Dov Khenin, Jamal Zahalka, Yousef Jabareen, and Masud Ganaim; 12 Palestinians are arrested. In the evening, the Palestinian leadership convenes in Ramallah to discuss the opening of the U.S. embassy in Jerusalem and the violence in Gaza. PA president Abbas calls the new U.S. embassy in Jerusalem a “settlement outpost” and reiterates that he has no plans to engage in any U.S.-mediated peace talks “in any way, shape, or form.” The assembled officials decide to file a war crimes complaint against Israel to the International Criminal Court (ICC) at The Hague over settlement construction in the West Bank. The South African government recalls its ambassador to Israel and Turkey recalls its ambassadors from Israel and the U.S. in protest of the killings in Gaza today. “The victims were taking part in peaceful protests against the provocative inauguration of the U.S. Embassy in Jerusalem,” a South African statement reads. Meanwhile, the U.S. blocks the UNSC from adopting a Kuwait-backed statement condemning the deadly violence in Gaza and calling for an “independent and transparent investigation” into Israel’s actions. The IDF lifts its 3-day general closure of the West Bank overnight, allowing Palestinians in the West Bank and Gaza to use border crossings into Israel again. Elsewhere in the West Bank, Israeli forces level 36 dunams (9 acres) of Palestinian land nr. Hebron, destroying numerous plum and olive trees. A delegation of ICC officials, including chief prosecutor Bensouda, arrives in Israel for a 5-day educational visit. They will meet with both Israeli and Palestinian officials. Bensouda is still conducting the preliminary examination into alleged war crimes that she initiated in 1/2015 at the Palestinians’ request. However, the ICC officials explicitly state that they are not in Israel to “engage in evidence collection in relation to any alleged crimes” or to “assess the adequacy of the respective legal systems to deal with crimes that fall within ICC jurisdiction." Following talks between Hamas leader Mishal and PA Pres. Abbas in Doha on 8/21 and 8/22, Hamas publicly agrees to support Abbas’s application to join the ICC. On the diplomatic front, Abbas travels to Cairo for talks with Egyptian pres. Abdel Fattah al-Sisi. After their meeting, Abbas says “my main goal is for the truce talks to resume in Egypt as soon as possible.” In an interview on Egyptian television, Abbas says that he is planning a major diplomatic initiative and that he will present the plan to U.S. Secy. of State John Kerry, who is scheduled to visit the region in the coming days. The plan reportedly includes asking the UN to set a timetable for the Israeli occupation and signing the Rome Statue on behalf of the PA, which would give the ICC jurisdiction over cases relating to the occupation.
