PA ambassador to the UN Riyad Mansour says a ceasefire is needed to implement the provisional measures instituted by the ICJ on 1/26. The U.S. House of Representatives passes H.R. 6679, preventing entry to the U.S. of members of the PLO, Hamas, and Islamic Jihad in a 422-2 vote. The bill would need to be approved by both the Senate and the president. PLO secretary-general Hussein al-Sheikh calls the bill a “dangerous decision” and demands a response from the Biden administration. Haaretz reports that Israeli commanders have instructed soldiers to set fire to Palestinian homes in Gaza and that in the past months hundreds of homes have been destroyed by Israeli soldiers setting fire to them. A photo of a note left behind by Israeli soldiers reads “[w]e are not burning the house so you can enjoy it, and when you leave – you will know what to do.” (HA 1/31)

Haaretz also reports that in the aftermath of 10/7/2023, Zaka community emergency response volunteers staged scenes in Israeli villages that were attacked to attract donations for the organization instead of properly handling bodies of deceased Israelis and spread accounts of atrocities that never happened to garner media attention. The Israeli military decided from 10/7/2023 to let Zaka handle the bodies of the dead instead of using its unit trained in the identification and collection of human remains. (HA 1/31)

Axios reports that U.S. secretary of state Antony Blinken has instructed the State Department to review and present policy options on U.S. and international recognition of a Palestinian state. A senior U.S. official tells Axios that some people in the Biden administration think that recognition of a Palestinian state should be the first step toward ending the Israeli occupation rather than the last. A federal judge in Oakland, California, dismisses a lawsuit brought by Palestinian Americans seeking to end U.S. support for Israel’s campaign in Gaza on the basis of genocide, saying he would have issued an injunction but is legally not able to do so due to a lack of jurisdiction. The judge, Jeffrey White, instead implores the Biden administration to “examine the results of their unflagging support” of Israel on the basis that “it is plausible that Israel’s conduct amounts to genocide.” (NYT 1/31; AJ, INT, HA 2/1)

The city of Chicago follows a number of other U.S. cities in calling for a ceasefire in Gaza. Some 70 cities in the U.S., including Atlanta, Minneapolis, Seattle, Detroit, and St. Louis, have passed resolutions on the Israeli attacks on Gaza with most calling for a ceasefire. The ICJ rules that there is a basis to further investigate the South African genocide case against Israel and that the ICJ has jurisdiction to hear the case. The court issues 6 provisional measures: 1) Israel must take all possible measures to prevent acts as outlined in Article 2 of the Genocide Convention, including not killing members of a particular group [Palestinians], not causing physical or psychological harm to members of that group, not inflicting living conditions which are calculated to bring about the end of the existence of a people, and not carrying out acts to precent the births within the group. 2) Israel must ensure its military does not carry out any of the actions outlined in measure 1. 3) Israel must prevent and punish incitement to commit genocide. 4) Israel must ensure the delivery of basic services and essential humanitarian aid. 5) Israel must prevent the destruction of evidence of war crimes and allow fact-finding missions access. 6) Israel must submit a report on all steps taken to abide by the measures within 1 month. 4 of the orders are approved by 15 of the 17 judges, while 2 of the measures are approved by 16 of the 17 judges. The only judge to vote against all measures is Judge Julia Sebutinde of Uganda. Aharon Barak, the judge representing Israel, votes for measures 3 and 4. The measures issued by the court fall short of South Africa’s demand for a ceasefire. Hamas welcomes the ICJ orders and calls on the international community to force Israel to implement the decisions. PA ambassador to the UN Riyad Mansour calls the measures against Israel “historic.” South Africa calls the ruling a “decisive victory.” Israeli prime minister Benjamin Netanyahu instructs his ministers not to comment on the ICJ decision and calls the ruling “outrageous.” The U.S. State Department says the ICJ did not “make a finding about genocide” despite the court specifically saying that it is continuing its trial of Israel on charges of genocide. Saudi Arabia, Iran, Malaysia, Qatar, Spain, Ireland, Scotland, Belgium, and the AU welcome the ICJ ruling. Turkey and Egypt express disappointment that the court did not call for a ceasefire. In East Jerusalem, Israeli police dispersed a march by Israeli extremists who called for full Israeli control over the Haram al-Sharif compound. The march was dispersed after marchers violated the agreement with Israeli police. 6 Palestinians were arrested in Sur Baher and at the Haram al-Sharif compound. Israeli videos of dozens of Palestinian men being stripped to their underwear, forced to sit on the ground, and taken by Israeli forces to a large hole dug in the ground circulated in Israeli media and on social media. What happened to the men, who were taken from UN schools in Beit Lahiya, remained unknown as some of them were identified as civilians, including journalists, doctors, and academics. Hamas condemned the Israeli action, calling it revenge for Israel’s failed invasion and calling on human rights organizations to intervene. Human Rights Watch and Amnesty International said their investigation into the Israeli killing of Lebanese Reuters journalist Issam Abdallah on 10/13 revealed the killing was likely deliberate and should be investigated as a war crime. In Gaza, Israeli forces opened fire at Palestinians trying to retrieve their belongings in Tal al-Hawa and at a fishing boat off the coast of Dayr al-Balah. Doctors returning to al-Nasr Hospital in Gaza City said they found 5 partially decomposed bodies of premature babies after Israeli forces had retreated from the hospital. 39 Palestinian prisoners, all boys, were released during the third prisoner exchange. 17 Hamas-held captives were released to Israel via the Rafah crossing, including 14 Israelis and 3 Thai nationals. 1 of the released captives holds U.S. citizenship, while another holds Russian citizenship. Israel said 1 of the released captives, an 84-year-old woman, was hospitalized in serious condition. She was later said to be improving. A relative of 3 children released from captivity said they were treated “more or less okay.” Hamas said it was seeking to extend the temporary ceasefire and called on U.S. president Joe Biden to end the Israeli war on Gaza. U.S. senator Chuck Schumer (D-NY) said U.S. lawmakers would vote on a $14 billion military aid package to Israel next week. Senators Bernie Sanders (D-VT), Peter Welch (D-VT), and Chris Murphy (D-CT) had all suggested that U.S. military aid to Israel could be conditional on Israel following international law. National Security Advisor Jake Sullivan also said the Biden administration was considering conditioning the U.S. aid. Sullivan later said it was not something the White House would do. Human Rights Watch said that the explosion that killed and injured upwards of 500 Palestinians at al-Ahli Hospital resulted from “a rocket-propelled munition, such as those commonly used by Palestinian armed groups” but added further investigation was needed to determine the perpetrator. Elsewhere, Israeli settlers raided Shaab al-Butum in the Masafer Yatta area, demolishing a residential structure and vandalizing solar panels, water tanks, and 70 olive tree saplings. Israeli settlers also attacked 2 Palestinians and 2 foreign journalists during a raid in Manizil and al-Rakiz in the Masafer Yatta, causing bruises. Israeli forces shot and killed a Palestinian man during a raid near al-Arroub refugee camp. Israeli forces also shot and injured a Palestinian during a raid in Arrabah. Elsewhere, Israeli forces demolished a 4-story building under construction in al-Za’im. Nearly 50 Palestinians were arrested during late-night raids in and around Hebron, Deir al-Ghusun, Ramallah, Deir Ibzi, Bethlehem, and Qaryut. In Gaza, Israeli forces sealed off the Indonesian Hospital in Beit Lahiya; Israeli shelling of the hospital killed 12 people. 100 patients were later evacuated from the hospital. In Tayibe, Israeli police arrested a 14-year-old Palestinian citizen of Israel for allegedly posting support for Hamas on social media. The Israeli security cabinet decided to deduct funds from the PA tax revenue that is used in Gaza, in addition to the funds it deducts from the PA that are said to be used for paying stipends to the families of Palestinian prisoners and Palestinians killed by Israel. The cabinet also decided to no longer allow Palestinians from Gaza to work in Israel and to send those held in the Israeli internment camps back to Gaza. Interior Minister Moshe Arbel approved a memorandum making it easier for Israel to revoke the citizenship for people accused of supporting, inciting, or identifying with a terrorist organization. Arbel also transferred $50.4 million to 67 Palestinian municipalities in Israel after the funds had been frozen by Finance Minister Bezalel Smotrich since July. Israeli military chief of staff Herzl Halevi said Israel would allow fuel to enter Gaza to keep hospitals running. However, Prime Minister Netanyahu’s office rejected the move. The U.S. House of Representatives passed a bill that would provide $14.3 billion in aid to Israel and deduct the same amount from the Internal Revenue Service (IRS). The bill was unlikely to pass in the Senate due to the deduction in funds from the IRS and the lack of funding for Ukraine. Israeli prime minister Benjamin Netanyahu met with National Unity Party leader Benny Gantz, agreeing to form an emergency unity government and a war cabinet. The war cabinet will consist of Netanyahu, Gantz, and Defense Minister Yoav Gallant, with former military chief of staff Gadi Eizenkot of the National Unity Party and Strategic Affairs Minister Ron Dermer as observers. Opposition leader Yair Lapid did not join the emergency government, reportedly because he wants National Security Minister Ben-Gvir and Finance Minister Bezalel Smotrich removed. Gallant said “[w]e will wipe Hamas off the face of the earth,” and Netanyahu said “[e]very member of Hamas is a dead man,” and compared Hamas to ISIS. U.S. president Joe Biden gave a speech to Jewish American leaders, telling them “I never really thought I would see, have confirmed pictures of terrorists beheading children.” The White House later told the Washington Post “[t]he president based his comments about the alleged atrocities on the claims of Netanyahu’s spokesman and media reports from Israel,” noting that Biden and his team have not seen pictures or confirmed the reports. Hamas denied the report, calling it “Zionist slander and lies” and rejecting that Palestinians beheaded children and assaulted women. Hamas’ Izzeddin al-Qassam Brigades spokesperson Abu Obaida said the Qassem Brigades would not negotiate the release of captives while Gaza was being bombarded. Earlier in the day Abu Obaida said Qassam Brigades would begin executing 1 Israeli captive each time Israel bombs a civilian target. There was no indication that the threat was carried out as civilian buildings were being bombed by Israel. Hamas official Moussa Abu Marzouk told Al Jazeera that Hamas is open to discussing a truce and all political dialogue. Reuters reported that Qatar was mediating a prisoner exchange that will see Israeli women and children released by Hamas in exchange for the release of 36 Palestinian women and children from Israeli prisons. Egyptian sources also said that Egypt was in close contact with Israel and Hamas to prevent further escalation, calling on Israel to exercise restraint and Hamas to keep the captives in good condition. Israeli defense minister Yoav Gallant said that he had ordered that no power, water, food, or gas enters Gaza, saying “[w]e are fighting human animals and we act accordingly.” His office later said Gallant had ordered the intensity of the Gaza bombings to increase. The Washington Post reported that the U.S. is preparing for a prolonged war in Gaza and is assessing Israeli diplomatic, political, and military needs. The White House briefed members of Congress that Israel will need replenishment for the Iron Dome, ammunition rounds, precision-guided missiles, and small-diameter bombs. Biden said in a briefing that 11 U.S. citizens have been killed by Hamas and that there likely are U.S. captives being held in Gaza. The U.S. also said Iran was complicit in the Hamas attack and warned Iran about getting involved in the fighting. Iran denied any involvement or knowledge. 20 U.S. senators wrote a letter to U.S. president Joe Biden urging his administration to preserve the option of a two-state solution in a potential Saudi-Israeli normalization deal. The senators said Israel should commit to not annexing any of the West Bank; halt settlement expansion; dismantle illegal settlements, including those retroactively legalized; allow natural growth in Palestinian towns and cities; and allow Palestinians to travel within the West Bank without interference. Israeli settlers from the Im Tirtzu organization harassed and threatened a delegation of foreign diplomats touring Palestinian communities experiencing settler violence with members of B’Tselem near Ramallah. 1 settler were arrested by PA forces in Taibeh in Area B and transferred to Israel after PA forces fired warning shots at the settlers when they entered Taibeh. 1 of the settlers waived a gun at the PA forces when they arrived. EU high representative for foreign affairs Josep Borrel spoke to Israel foreign minister Eli Cohen about the incident. U.S. president Joe Biden met Israeli prime minister Benjamin Netanyahu on the sidelines of the annual UN General Assembly meeting in New York. According to a White House statement, Biden cautioned Netanyahu about further advancing his judicial overhaul without gaining a broad consensus and invited Netanyahu to the White House later in 2023. Israeli officials said the Biden-Netanyahu conversation mostly concerned the Israeli-Saudi normalization deal. U.S. national security council coordinator for the Middle East and North Africa Brett McGurk and presidential envoy on energy security Amos Hochstein, who have been leading the U.S. negotiations with Saudi Arabia on normalization, also attended the meeting. It was the first time Biden and Netanyahu met since Netanyahu took office in December 2022. According to an Israeli official, Netanyahu told Biden that there can be a Palestinian component to the deal but the Palestinians cannot have veto power. Saudi Arabian crown prince Mohammed bin Salman told Fox News in an interview that normalization with Israel is moving closer every day. Bin Salman said “[f]or us, the Palestinian issue is very important. We need to solve that part,” later saying “[w]e hope that it [the normalization talks] will reach a place that will ease the life of Palestinians and get Israel as a player in the Middle East.” Lastly, bin Salman said that if Iran gets a nuclear weapon, then Saudi Arabia will “have to get one.” One of the Saudi demands for normalization is that the U.S. aids the country in creating a nuclear program. UN envoy for the Middle East Tor Wennesland issued a report warning that the economic crisis in the West Bank and Gaza could threaten regional stability. The man’s family said he had been humiliated by Israeli forces at a checkpoint 2 weeks ago. Israeli forces later raided the man’s home in Deir ‘Ammar refugee camp, injuring 1 with live ammunition and 1 with a baton round; others suffered tear-gas related injuries. The magistrate court had ordered that both suspects be released. 4 Palestinians are being held in custody by Israel in relation to the settler attack. The Knesset approved a preliminary vote to ban flying the flag of a “hostile entity,” including the Palestinian flag. Israeli Foreign Ministry director general Ronen Levy met with U.S. officials in Washington D.C. to discuss ways to expand the normalization deals the U.S. has been brokering for Israel, particularly the prospect of normalizing ties with Saudi Arabia. Among the U.S. officials were White House Middle East coordinator Brett McGurk, presidential envoy on energy security Amos Hochstein, and White House senior director for African affairs Judd Devermont. Khalil Awawdeh, who in 2022 suspended a 172-day hunger strike after Israel promised to end his administrative detention on 10/2/2022, was sentenced to 16-months in prison for using a smuggled mobile phone while on hunger strike. Jewish Currents reported that progressive Democratic representative Jamaal Bowman (D-NY) and senator Bernie Sanders (D-VT) circulated a letter, addressed to the Biden administration, urging it to “undertake a shift in U.S. policy in recognition of the worsening violence, further annexation of land, and denial of Palestinian rights. Only by protecting democracy, human rights, and self-determination for all Palestinians and Israelis can we achieve a lasting peace.” Democrats further called for U.S. aid not to support Israeli settlements or violate the Arms Export Control Act. U.S. president Joe Biden expressed his dismay with Israeli prime minister Benjamin Netanyahu’s legislative agenda, saying that Israel “cannot continue down this road. I have sort of made that clear.” Biden also said that Netanyahu would not be invited to the White House in the near term. Biden’s comments came after U.S. ambassador to Israel Tom Nides said that he believed Netanyahu would be invited soon. Israelis protested against the Israeli government’s plans to overhaul the judicial system. The protests escalated after Israeli defense minister Yoav Gallant was fired by Prime Minister Benjamin Netanyahu on 3/26 following Gallant’s calls for a freeze on the legislation. The Israel airports trade union closed down Ben-Gurion International Airport for all incoming and outgoing flights. Later other unions followed, closing down several embassies around the world. Israeli president Isaac Herzog also issued a statement directed at Netanyahu calling on him to freeze his pursuit for control over the judicial branch of government. Later in the day Netanyahu survived 2 no-confidence votes in the Knesset, 59-53 and 60-51. In the evening Netanyahu announced a pause to his government’s plans “to give a real opportunity for real dialogue.” To appease National Security Minister Itamar Ben-Gvir, who had threatened to resign if the legislation was paused, Netanyahu promised him that he will establish a national guard under Ben-Gvir’s command. The New York Times reported that U.S. officials had intensely pressured the Netanyahu government to pause the legislation. The White House banned U.S. federal agencies from using commercially available spyware that poses national security and human rights risks. The executive order follows a report that more than 50 U.S. government employees in 10 countries have been targeted by spyware. The UAE informed the UN Security Council that it will not call a vote on a draft resolution to demand that Israel ceases its settlement activity. The decision not to call the vote was reportedly the result of intense lobbying by the U.S. targeting the UAE and the PA. Instead the Security Council members are set to vote on a statement condemning Israeli settlement activity. Part of the deal made by the U.S. involved the PA not pursuing action against Israel in international organizations until August while Israel would not expand more settlements and legalize more settlement outposts beyond the 9 settlement outposts that Israel said it would legalize on 2/12. It was also reported that the U.S. had offered the PA meeting with President Joe Biden at the White House, movement on reopening the U.S. consulate in Jerusalem, and aid. Leading Democrat and former presidential candidate senator Bernie Sanders (D-VT) said during an interview “I think we’ve got to put some strings attached to that [U.S. aid to Israel] and say ‘You cannot run a racist government,’ You cannot turn your back on a two-state solution. You cannot demean the Palestinian people there. You just can’t do it and then come to America and ask for money.” Senator Sanders also said he may introduce legislation to condition U.S. aid to Israel. (HA, MDW 2/20)

In the West Bank, 1 Israeli settler pepper sprayed 1 Palestinian minor in Huwwara. Israeli forces demolished 1 residential structure and 1 agricultural structure in Nabi Musa, demolished 15 commercial structures in Wadi al-Qelt, and demolished 2 homes in Duma. During the demolitions in Duma, Israeli forces shot and injured 1 journalist with a baton round and injured others with tear gas. Israeli forces also notified Palestinians in Hizma and Jaba’ that Israel will seize 500 dunams (123 acres) of land between the 2 villages to expand a settler-only road. 28 Palestinians were arrested during late-night raids in al-Mughayyir, Kafr Malik, al-Bireh, Nur Shams refugee camp, Nablus, Jericho, Aqabat Jaber refugee camp, and Hebron. In Gaza, 12 rockets were launched at Israel, causing no damage. Israeli forces subsequently launched airstrikes at Gaza, causing damage. PA prime minister Mohammad Shtayyeh attended the COP27 climate summit in Sharm el-Sheikh, Egypt. Israel and Jordan also signed a memorandum of understanding to continue work on an agreement made in November 2021 to exchange water, provided by Israel, for energy provided by Jordanian solar farms. In an interview with Kan, U.S. ambassador to Israel Tom Nides said that he will see how the next right-wing government speaks and acts before taking a position on the possibility of the Otzma Yehudit party forming part of the government. Ambassador Nides also said "[t]his is a country that is a democracy with elected leadership and I intend to work with them." Israel shut down the Jalamah and Salem checkpoints and prohibited Palestinians from Kafr Dan from entering Israel as a punitive measure for the early morning shooting (see above). Both the Palestinians killed were from Kafr Dan. (HA 9/14)

It was reported that Palestinian children in Tuba had been unable to attend school for 2 days as Israeli soldiers began refusing escorting the children to their school. Since 2004, Israeli soldiers have escorted children in Tuba to their school to protect them from settler attacks. Residents in Tuba said they believe canceling the escorting of the children was related to an incident on 9/12 where 1 Israeli settler was reported injured nearby after armed Israeli settlers attacked Palestinians working their land. The U.S. senate foreign relations committee passed an amendment to the Manager’s package of the State Department Authorization Act, requiring secretary of state Antony Blinken to submit a report on the circumstances surround the killing of Palestinian American journalist Shireen Abu Akleh. In an interview with the French newspaper Le Point, Qatari leader Sheikh Tamim bin Hamad Al Thani dismissed the idea of normalizing relations with Israel, saying “are things normal in Israel? No! There are still occupied Arab lands, refugees who have not been able to return to their homes for over 70 years, Muslims and Christians, living under siege in Gaza.” Sheikh Al Thani further called the “Israeli-Palestinian question” the most important, saying there will not be peace in the Middle East without it being solved. The Jerusalem Post said it had obtained a 3-page letter from then U.S. president Donald Trump to Israeli prime minister Benjamin Netanyahu from 1/26/2020. The letter stipulates that the U.S. will support Israel annexations of parts of the West Bank if Israel recognizes a Palestinian state. The leaked letter was seen as a response to details from Jared Kushner’s book Breaking History: A White House Memoir, where the former senior advisor to President Trump says that Trump was angry with Prime Minister Netanyahu for floating the idea of annexing parts of the West Bank.
