The UN Office of the High Commissioner for Human Rights (OHCHR) says it has received information that Palestinian women and girls have been “arbitrarily executed in Gaza, often together with family members, including their children.” The office also expresses alarm over the arbitrary detention of hundreds of women and girls in the West Bank and East Jerusalem, including reports of sexual assault of detainees, including rape. U.S. State Department spokesperson Matthew Miller says the U.S. “strongly encourage[s] Israel to thoroughly and transparently investigate credible allegations and ensure accountability for abuses and violations” in response to the OHCHR’s statement. The ICJ begins hearings in the case of Israel’s occupation of Palestinian territories. 52 countries will present oral and written arguments before the court between 2/19 and 2/26. The case was triggered on 12/30/2022 when a majority of members of the UN General Assembly voted to seek an opinion on the legal consequences of the Israeli occupation of Palestine. PA foreign minister Riyad al-Maliki, PA ambassador to the UN Riyad Mansour, and academics and legal experts address the ICJ judges on the first day of the hearings. A report by the London School of Hygiene & Tropical Medicine and the Johns Hopkins Center for Humanitarian Health projects that between 2/7 and 8/6/2024 the excess number of deaths in Gaza could range from 4,200 to 259,680. In the best scenario where a ceasefire is reached and no epidemics occur the mean estimate is 6,550 excess deaths while in the worst scenario where the attacks escalate and epidemics occur the mean estimate of excess deaths is 85,750. Israeli forces continued their large-scale raid of Jenin, fatally shooting 4 people, including 2 children aged 8 and 15, and Mohammad Zubeidi, the son of prominent Islamic Jihad member Zakaria Zubeidi. Israeli airstrikes in the city destroyed a home and a vehicle while Israeli bulldozers tore up pavements, electric poles, and water and sewage pipes. Israeli forces also violently dispersed Palestinians near the Ofer Prison, injuring 1 with live ammunition and others with tear gas. In Gaza, Israeli forces opened fire at Palestinians trying to retrieve their belongings in Tal al-Hawa and at a fishing boat off the coast of Dayr al-Balah. 30 Palestinian prisoners, 15 children and 15 women, including prominent activist Ahed Tamimi who was arrested on 11/6, were released from Israeli prisons on the sixth day of the temporary ceasefire. 16 captives were released from Gaza to Israel, including 4 Thai nationals, 1 American Israeli, and 2 Russian Israelis. Hamas said it was working very hard to extend the ceasefire, which ends on 11/30. U.S. secretary of state Antony Blinken, who is scheduled to visit the Middle East this week, said the U.S. would like to see the ceasefire extended and that the topic of the future government of Gaza should be discussed. Hamas released a statement saying an Israeli airstrike had killed 3 members of the same Israeli family, including 2 children. They did not say when the airstrike occurred. Israel said it believed that 159 captives were still being held in Gaza. U.S. senator Chris Van Hollen (D-MD) said he spoke to National Security Advisor Jake Sullivan, who told him that the White House will not seek to place conditions on U.S. aid to Israel, despite earlier comments to the contrary. Sullivan met with dozens of senators on 11/28, discussing a $14.3 billion military aid package to Israel. Israel said 1 of the released captives, an 84-year-old woman, was hospitalized in serious condition. She was later said to be improving. U.S. senator Chuck Schumer (D-NY) said U.S. lawmakers would vote on a $14 billion military aid package to Israel next week. Senators Bernie Sanders (D-VT), Peter Welch (D-VT), and Chris Murphy (D-CT) had all suggested that U.S. military aid to Israel could be conditional on Israel following international law. Israeli forces killed 5 Palestinians in a drone strike on Fatah’s headquarters in Balata refugee camp, injuring 2 others. In East Jerusalem, Israeli forces violently dispersed students and staff at a school in Isawiya, physically assaulting them and causing tear-gas related injuries. In Gaza, Israeli airstrikes in Khan Yunis and on an UNRWA school in Jabalia refugee camp killed 116 people. Israeli attacks on Beit Lahiya, Beit Hanun, and Gaza City also killed dozens, including at Tal al-Zaatar, an UNRWA-run school, and the Kamal Adwan Hospital. The number of fatalities was likely much higher since the Gaza Ministry of Health was unable to communicate with hospitals and civil defense members in northern Gaza. The WHO said it would help evacuate those remaining at the hospital in the next 2-3 days. U.S. president Joe Biden published an op-ed in the Washington Post, saying that the U.S. may start issuing visa bans to extremist settlers to discourage settler violence. At the IISS Manama Dialogue security conference in Bahrain, National Security Council Coordinator for the Middle East and North Africa Brett McGurk linked humanitarian aid to Gaza with the release of captives, saying “the surge in humanitarian relief, the surge in fuel, the pause in fighting will come when hostages are released.” Jordanian foreign minister Ayman Safadi sharply criticized the U.S., saying it would have imposed sanctions on any other country that “did a fragment of what Israel” does in Gaza and that international calls for Israel to abide by international law do not change its behavior. In Gaza, an Israeli airstrike killed 471 Palestinians in al-Ahli Arab Hospital in Gaza City. The hospital, which was filled with patients and Palestinians seeking shelter from Israeli bombardment, had received evacuation warnings from Israel on 10/14, 10/15, and 10/16. Israel claimed it was an errant rocket fired by Hamas that caused the mass casualties, however all evidence presented by Israel was debunked in subsequent investigations. Other Israeli airstrikes killed around 200 Palestinians, mostly in Rafah and Khan Yunis. Israel also assassinated the head of Hamas’ Shura Council Osama Mazini, who led negotiations on the prisoner exchange that saw Gilad Shalit transferred to Israel in exchange for 1,000 Palestinian prisoners in 2011, and Hamas commanders Muhammad Alwadia, Ayman Nofal, and Akram Hijaz. Israeli airstrikes also reportedly killed 3 members of Hamas political leader Ismail Haniyeh’s family. 6 were killed in an airstrike on an UNRWA school sheltering Palestinians in al-Maghazi. In the West Bank, there were large demonstrations against the PA and the Israeli bombing of the al-Ahli Arab Hospital throughout the West Bank, with PA forces violently dispersing Palestinian protesters, killing a 12-year-old girl in Jenin with live ammunition, and injuring many others with tear gas. The Palestinian civil defense team said that more than 1,000 Palestinians were under the rubble of buildings in Gaza. Israel attempted to deny that it killed hundreds of Palestinian civilians in an airstrike on al-Ahli Arab Hospital in Gaza, presenting a range of questionable evidence to put the blame on Islamic Jihad. Israeli government social media accounts published what it claimed to be evidence that it was a rocket misfire not an airstrike, but later deleted the videos when a New York Times journalist questioned the timing of the videos. Military spokesperson Daniel Hagari said “[a]ccording to our intelligence, Hamas checked reports and understood it was a Palestinian Islamic Jihad misfire, then launched a global media campaign to inflate numbers of casualties.” Israel has previously employed misinformation campaigns to deflect blame for atrocities, on occasion then taking responsibility long after the event, as in the case of the killing of Shireen Abu Akleh. A UK Channel 4 investigation said evidence presented by Israel was both likely fabricated and contradictory, but did not reach a conclusion regarding the origin of the blast. Israeli president Isaac Herzog called reports that Israel conducted the airstrike “21st century blood libel.” Many Western leaders called for an investigation or referred to the loss of life without condemning the perpetrators. Leaders in the Middle East were unequivocal in their condemnation of the Israeli airstrike. King Abdullah II of Jordan, PA president Mahmoud Abbas, and Egyptian president Abdel-Fattah el-Sisi canceled meetings with U.S. president Joe Biden scheduled for 10/18 in Amman. The UAE and Russia called a meeting of the UN Security Council on 10/18 on the attack on the hospital. U.S. Defense Department spokesperson Sabrina Singh said in response to questions about the incident that Hamas puts “their command and control units inside hospitals,” adding the U.S. does not know who the perpetrator was. Biden said he spoke to Prime Minister Netanyahu and that his national security team will gather information about the incident. The U.S. announced that President Biden will visit Israel on 10/18. The New York Times reported that Biden’s visit will postpone Israel’s planned ground operation in Gaza by at least 24 hours. The Times also reported that Israel has asked the U.S. for $10 billion in emergency aid. Secretary of State Blinken said the announcement was made after Prime Minister Netanyahu committed to allowing aid to enter Gaza and to establishing safe zones at an 8-hour long meeting of the Israeli war cabinet that Blinken attended. New York governor Kathy Hochul said she will visit Israel. Biden also said he will visit Jordan. Senate majority leader Chuck Schumer said he would push through an emergency aid package to Israel “as quickly as possible.” 6 Republican senators introduced legislation to end all U.S. funding for UNRWA. King Abdullah II said Jordan and Egypt would not take in Palestinian refugees from Gaza, calling it a red line. Abdullah II also met with German chancellor Olaf Scholz in Berlin. Scholz later traveled to Israel where he met with Prime Minister Netanyahu, invoking the German genocide of the Jewish people as a reason for Germany to “ensure Israel’s existence and security.” Lebanese foreign minister Abdallah Bou Habib said Israel was “pouring oil on fire” at the Lebanese border. Israeli military spokesperson Richard Hecht said Israel may not use the same “level of fidelity” in warning civilians before striking homes and apartment buildings. It had been reported that Israel no longer used smaller munitions to “knock” on the roofs of apartment buildings or call building managers before demolishing them with larger bombs. Hecht also called the parliament and ministries in Gaza legitimate targets. Hecht further said Palestinians in Gaza should flee to Egypt via the Rafah crossing, first saying that it is open and later tweeting that he did not know if it was open. U.S. president Joe Biden gave a televised speech calling the Hamas operation on 10/7 “pure, unadulterated evil,” recounting unconfirmed Israeli narratives of militants committing rapes. Biden also compared Hamas to ISIS, attributed the operation to anti-Semitism, rather than resistance, and reiterated his stance in support of Israel, saying Israel has a “duty to respond,” despite the mass civilian casualties in Gaza. Biden further stated that the U.S. is sending ammunition and interceptors for the Iron dome to Israel. Lastly, Biden warned other countries and organizations against getting involved against Israel. Hamas called Biden’s speech deplorable and inflammatory, saying Hamas launched its operation to defend the Palestinian people and put an end to the occupation. Biden also spoke with Prime Minister Netanyahu about U.S. assistance. 392 members of the U.S. House of Representatives co-sponsored a resolution in support of Israel, calling the Hamas operation “barbaric.” It is unknown if the resolution will pass, as it is unclear if the acting speaker of the House Patrick McHenry (R-NC) has the authority to bring the resolution to the floor. EU high commissioner for foreign affairs Josep Borell said he had invited PA and Israeli foreign ministers Riyad al-Maliki and Eli Cohen to an EU foreign ministers meeting to discuss the situation in Palestine and Israel. Borell also said that Israel must adhere to international law, saying Israel violates the law by imposing a total blockade on Gaza. Leaders at the Arab-China Summit in Riyadh called for a just and lasting solution, based on the 2-state solution, to the Israeli occupation of Palestine in their final communique of the summit. In a speech at the summit PA president Mahmoud Abbas called for the international community to not work with any Israeli government that refused to work within the framework of international law. Palestinian member of the Knesset and leader of the Hadash party Ayman Odeh met with UN secretary-general António Guterres in New York, briefing Guterres on his concerns about the government Benjamin Netanyahu is expected to present within a couple of weeks. Israeli ambassador to the UN Gilad Erdan called the meeting “cowardly and shameful.” Israeli media reported that the meeting was made in coordination with the PA rather than with the Israeli foreign ministry. Egypt’s foreign ministry issued a statement warning Israel against continuing its attacks on Palestinians, noting that more than 200 Palestinians have been killed by Israeli forces in 2022. A Jerusalem court overturned an Israeli police decision to bar 3 Jewish people from entering the Haram al-Sharif compound after they violated the ban on praying at the Muslim site. PA president Mahmoud Abbas called the court decision “a grave assault against the historic status quo,” and Jordan said the ruling violates international law. Israeli prime minister Naftali Bennett’s office issued a statement saying that there had been no policy change at the Haram al-Sharif compound. Hamas said that the court decision crossed “all red lines and is a dangerous escalation.” Israeli police appealed the decision on 5/23. In Iran, a colonel in the Iranian Revolutionary Guard’s Quds Forces, Hassan Sayyad Khodaei, was assassinated in front of his house in Tehran by 2 people on a motorbike. The Israeli Civil Administration signed an order declaring 22,000 dunams (5,445 acres) of land in Area C south of Jericho an Israeli nature reserve. The nature reserve, dubbed Nachal Og Nature Reserve, is situated on 6,000 dunams (1,483 acres) of privately-owned Palestinian land. The nature reserve designations means that Palestinians will not be allowed to cultivate the land or have their livestock graze on it, without approval from the Israeli nature reserve officer. The office of the Israeli attorney general approved connecting Israeli settlement outposts built on Israel-declared state lands in the West Bank to the electrical grid. In the decision, the attorney general’s office also said that Palestinian villages in Area C, not recognized by Israel, should be given equal consideration in being connected to the electrical grid, citing international law of non-discrimination. Representatives from Ireland, Belgium, Cyprus, Estonia, Finland, France, Greece, Latvia, Lithuania, Luxembourg, Malta, Poland, Portugal, Spain, and Sweden signed a letter to EU enlargement commissioner Olivér Várhelyi of Hungary, urging him to disburse EU aid to the PA. The trial against 14 PA security officers charged with beating PA critic Nizar Banat to death on 6/24 began in Ramallah. Banat’s brother Ghassan Banat said that the PA was using the 14 officers as scapegoats and that the trial was incomplete without prosecution of the head of the Preventive Security Services and the interior minister. All 14 officers pledged not guilty to charges of battery, abuse of power, and violation of military instructions. According to a cousin of Banat, 1 of his other cousins was arrested before the hearing. The arrested cousin is said to be 1 of the key witnesses to the killing of Banat. (HA, REU 9/27; MEMO 9/28)

At a UK Labour conference in Bristol, members of the party voted for a motion that called for sanctions against Israel for its violations of international law, stopping arms trades with Israel, and ending trade with Israeli settlements. Israel released 1 pregnant Palestinian woman from prison after international and Palestinian pressure. The woman was released to house arrest and on $12,000 bail. PA president Mahmoud Abbas met with Egyptian president Abdel Fattah al-Sisi and Jordanian king Abdullah II in Cairo. The 3 leaders were said to have been coordinating their stance on Israel for the upcoming UN general assembly meeting in October. President al-Sisi’s spokesperson said after the meeting that al-Sisi emphasized that the creation of a Palestinian state depends of reconciliation between the PA and Hamas. President Abbas called for renewed peace negations under the auspices of the International Quartet for Middle East Peace. An unnamed PA source said, according to Haaretz, that the Biden administration has conveyed to the PA that it will not exert pressure on the Israeli government to engage diplomatically with the PA while Israel is in budget negotiations. The Jewish National Fund (JNF) approved a project that will seek to obtain from Palestinians 530 properties in the West Bank and 2,050 properties in East Jerusalem by reviewing documents only registered by the JNF to see if they can be used to evict Palestinians using Israeli courts. In the West Bank, the prominent critic of the PA, Nizar Banat, died at a hospital after being arrested by PA forces in his home in Dura; the family of Banat said he was brutally beaten by 20 PA officers. Banat was a candidate for the Liberation and Dignity party before the PA canceled the elections scheduled for 5/22. The PA said it would open an investigation into how Banat died. Protests against the PA broke out in several places in the West Bank and PA forces violently dispersed the protesters using tear gas and batons. The New York Times released a visual investigation of the killing of 44 Palestinians in Gaza by the Israeli military on 5/16. The investigation showed how the Israeli military used U.S.-manufactured munitions to strike civilian targets in the Rimal area of Gaza City. The investigation also said that Israel’s claim that it had sought to bomb an underground military facility in the heavily populated area was unsubstantiated and that Israel made no effort to warn the Palestinians living in the area that it would attack the alleged underground military facility. Hamas said it estimated that $92 million’s worth of damage was sustained to residential buildings and non-governmental offices since 5/10. $22 million’s worth of damage was sustained to the power grid as people in Gaza only are receiving 3-4 hours of electricity a day. An Israeli court ruled that Israeli forces had violated international law when they shot and killed 1 Palestinian 14-year-old in 2004 near Rafah, but that the family was not entitled to compensation, citing a wartime action principle. The Israeli soldiers shot her after she ran away from them as they fired warning shots. After she ran from the soldiers, they fired at her back and the commander shot her again as she lie dead on the ground. The commander was acquitted of all charges at an Israeli military court the year after. (HA 5/20)

A spokesperson for the Israeli military said that it had been trying to assassinate the head of Hamas’s military division Mohammed Deif throughout the duration of the ongoing attack on Gaza. Hamas later told AP that Deif is still alive and in charge of its military operations. (HA 5/19; AP 5/20)

1 Israeli journalist from Channel 20 was fired after saying, during a live broadcast, that “[o]ne [rocket] has fallen on a soccer field in a large Arab community [Shefa-Amr, a Palestinian-Israeli community]. U.S. president Joe Biden spoke to Israeli prime minister Benjamin Netanyahu, urging him to de-escalate the violence, according to a White House readout. It was the 4th time the 2 spoke in a week. Prime Minister Netanyahu said later in a statement that he was “determined to carry on with the attacks until calm and security are restored to Israeli citizens.” It was also reported that Egypt had secured a ceasefire agreement in principle between Hamas and Israel. Hamas spokesperson Hazem Qassem said calm could only be restored if Israel stopped its attack on Jerusalem and Gaza. A letter circulated among House Democrats by Debbie Dingell (D-MI) and Alan Lowenthal (D-CA) called for the U.S. secretary of state Antony Blinken to work toward a ceasefire between Hamas and Israel, and to provide humanitarian relief to Gaza. The letter also called for more than doubling the U.S. funding to the UNRWA, bringing the U.S. funding back to the level it was before the Trump administration ended all funding. Separately, more than 130 members of the House called on an immediate ceasefire. 3 Democrats in the House, Alexandria Ocasio-Cortez (D-NY), Mark Pocan (D-WI), and Rashida Tlaib (D-MI) also introduced a resolution aimed at blocking the $735 million’s worth of arms to Israel. 250 employees at Alphabet, the parent company of Google, wrote an open letter calling for Alphabet to review all business contracts, terminating those “with institutions that support violations of Palestinian rights,” including the Israeli military. At the UN, the U.S. again refused to support a UN security council (UNSC) statement calling for an immediate ceasefire after intensified pressure from France. The Arab League secretary-general Ahmed Aboul Gheit said Israel was responsible for the escalation between Hamas and Israel, stating that “Israeli violations in Jerusalem . . . is what led to the ignition of the situation in this dangerous way.” Secretary-general Gheit’s comments came after a meeting of Arab League foreign secretaries discussing the situation. German foreign minister Heiko Maas tweeted that Germany does not agree with the ICC on the issue of the ICC’s territorial jurisdiction in the West Bank, East Jerusalem, and Gaza, saying that the State of Palestine is not recognized in international law. Foreign Minister Maas’s tweet came 1 day after he spoke with Israeli foreign minister Gabi Ashkenazi, who has been reaching out to allies to have them publicly side with Israel in the matter of the ICC investigation. Unlike the U.S. and Israel, Germany is part of the ICC. The EU has said it supports the independence of the ICC. Canada and Australia, also members of the ICC, have also expressed dismay about the territorial jurisdiction ruling. The PA foreign ministry said it regretted that Israel had been successful in convincing Germany, Canada, Australia, Austria, Brazil, and others in opposing the ICC investigation. A top Iranian nuclear scientist, Mohsen Fakhrizadeh, was assassinated while driving his car in Absard some 40 miles east of Tehran. Iran said that there were “serious indications of Israeli responsibility.” An anonymous Israeli official confirmed to the NYT that Israel was behind the assassination. The NYT also had 3 other intelligence sources confirm Israel’s involvement. According to Iran’s Fars News Agency, Fakhrizadeh was killed by a remote-controlled machine gun attached to a deserted car. The NYT reported a different story of the events in which 12 assassins caught up to Fakhrizadeh’s car and shot him before leaving the scene unharmed. Israel has previously claimed that Fakhrizadeh was the scientist behind Iran’s nuclear program and Israeli prime minister Benjamin Netanyahu said in 2018 during a press conference that people should remember Fakhrizadeh’s name. Former CIA director John Brennan condemned the assassination, calling it “flagrant violation of international law.” The EU, UN, UAE, and Jordan also condemned the assassination. The U.S. state department issued new guidelines of how to refer to products produced in Gaza and the West Bank as secretary of state Mike Pompeo was visiting Israel and Israeli settlements in the West Bank. Under the new guidelines, products imported to the U.S. from Area C of the West Bank would have to be labeled “Made in Israel.” Products can no longer be labeled “Made in West Bank/Gaza,” so products made in Gaza should be labeled “product of Gaza” and products made in Area A and B of the West Bank should be labeled “product of West Bank.” In a statement by Secretary Pompeo, he said that the U.S. is adhering to a “reality-based” approach, which would indicate that the new guidelines are a way for the U.S. administration to recognize Israel’s annexation of Area C. The statement also stipulated that “Gaza and the West Bank are politically and administratively separate and should be treated accordingly.” Secretary Pompeo also made another policy announcement during a press conference with Israeli prime minister Benjamin Netanyahu. At the press conference, Pompeo announced that the State Department regards the Boycott, Divestment and Sanctions (BDS) movement as anti-Semitic and that the U.S. would start identifying organizations that support BDS to penalize them. The BDS movement released a statement reiterating that it rejects “all forms of racism, including anti-Jewish racism” and said it would resist “these McCarthyite attempts to intimidate and bully Palestinian, Israeli and international human rights defenders into accepting Israeli apartheid and settler-colonialism as fate.” The American Civil Liberties Union responded to Pompeo’s announcement that “[c]riticism of Israel, or any government, is fully protected by the First Amendment. Threatening to block government funds to groups that criticize Israel is blatantly unconstitutional.” Secretary Pompeo also visited the Israeli-occupied Golan Heights and was the 1st secretary of state to do so. Pompeo’s visit to Israeli settlements in the West Bank was also a 1st for a U.S. secretary of state. The EU informed BADIL Resource Center for Palestinian Residency and Refugee Rights that it had canceled its funding for a project called Mobilizing for Justice in East Jerusalem, totaling $1.9 million. BADIL had refused to sign what was called the anti-terrorism clause, which made the EU pull its funding.
