The UN Office of the High Commissioner for Human Rights (OHCHR) says it has received information that Palestinian women and girls have been “arbitrarily executed in Gaza, often together with family members, including their children.” The office also expresses alarm over the arbitrary detention of hundreds of women and girls in the West Bank and East Jerusalem, including reports of sexual assault of detainees, including rape. U.S. State Department spokesperson Matthew Miller says the U.S. “strongly encourage[s] Israel to thoroughly and transparently investigate credible allegations and ensure accountability for abuses and violations” in response to the OHCHR’s statement. The ICJ begins hearings in the case of Israel’s occupation of Palestinian territories. 52 countries will present oral and written arguments before the court between 2/19 and 2/26. The case was triggered on 12/30/2022 when a majority of members of the UN General Assembly voted to seek an opinion on the legal consequences of the Israeli occupation of Palestine. PA foreign minister Riyad al-Maliki, PA ambassador to the UN Riyad Mansour, and academics and legal experts address the ICJ judges on the first day of the hearings. Al-Maliki urges the judges to order an end to the Israeli occupation. Israeli prime minister Benjamin Netanyahu says Israel does not recognize the legitimacy of the ICJ proceedings. A report by the London School of Hygiene & Tropical Medicine and the Johns Hopkins Center for Humanitarian Health projects that between 2/7 and 8/6/2024 the excess number of deaths in Gaza could range from 4,200 to 259,680. In the best scenario where a ceasefire is reached and no epidemics occur the mean estimate is 6,550 excess deaths while in the worst scenario where the attacks escalate and epidemics occur the mean estimate of excess deaths is 85,750. Israeli forces also seize building equipment and arrest 4 Palestinians during a raid in Deir Balut. In East Jerusalem, Israeli forces demolished an apartment on the third floor of an apartment building in Sur Baher. Israeli forces raided the home of al-Aqsa Mosque preacher Sheikh Ikrimah Sabri in Silwan, issuing a demolition notice for the 5-story building he lives in. Israeli authorities forced a Palestinian family to demolish their own home in Sur Baher. The U.S. said that an American warship and several commercial ships were attacked in the Red Sea. Yemen’s Houthi government said it had attacked an Israeli ship with a missile and attacked another with a drone. In East Jerusalem, Israeli settlers toured the Haram al-Sharif compound. Israeli forces demolished a Palestinian-owned home in Isawiya, displacing 6, and a structure in Silwan. In Gaza, the Israeli military said it had encircled Jabalia refugee camp. Israeli soldiers continued their sieges of the Indonesian and al-Shifa hospitals; around 500 patients and staff were evacuated from the Indonesian Hospital to a hospital in Khan Yunis later in the day. At least 120 Palestinians were killed in Israeli airstrikes on Nuseirat refugee camp, Gaza City, Jabalia refugee camp, Beit Lahiya al-Bureij, and Khan Yunis. Jordan said Israel had ordered the evacuation of its field hospital in Gaza, saying it would not heed the order. (AJ, HA 11/21)

Hamas said it had agreed to the terms of the first prisoner exchange and temporary ceasefire. Islamic Jihad said it was coordinating with Hamas on the prisoner exchange deal. The Israeli war, security, and government cabinets convened in separate meetings in the evening to discuss the deal. Prime Minister Benjamin Netanyahu said the deal was likely to happen, despite opposition from National Security Minister Itamar Ben-Gvir and Finance Minister Bezalel Smotrich, and that Israel would continue its war on Gaza after the temporary ceasefire. The meeting of the government cabinet was still ongoing at the end of the day. It was reported by Haaretz that the Israeli public would have 24 hours to appeal to the Israeli High Court of Justice if the government decides to approve the deal. U.S. national security council spokesperson John Kirby said the U.S. would not support Israeli military action in southern Gaza unless it “clearly articulated [a] plan for how they are going to protect the lives of the hundreds of thousands of people that have now added to the population because they were asked to leave by the Israelis.” Kirby also said that the Biden administration was considering redesignating the Yemeni Houthi government a terrorist organization, citing its attacks on Israel and the seizure of an alleged Israeli-linked vessel on 11/19. Pentagon deputy press secretary Sabrina Singh said the U.S. continued to supply Israel with “155 mm rounds, precision-guided munitions, and air defense systems.” Politico reported that the U.S. had sent Israel the coordinates for humanitarian sites, including hospitals, and gave Israel information about the movement of aid groups to avoid Israeli attacks on protected groups. Israeli military spokesperson Richard Hecht said Israel may not use the same “level of fidelity” in warning civilians before striking homes and apartment buildings. It had been reported that Israel no longer used smaller munitions to “knock” on the roofs of apartment buildings or call building managers before demolishing them with larger bombs. Hecht also called the parliament and ministries in Gaza legitimate targets. Hecht further said Palestinians in Gaza should flee to Egypt via the Rafah crossing, first saying that it is open and later tweeting that he did not know if it was open. U.S. president Joe Biden gave a televised speech calling the Hamas operation on 10/7 “pure, unadulterated evil,” recounting unconfirmed Israeli narratives of militants committing rapes. Biden also compared Hamas to ISIS, attributed the operation to anti-Semitism, rather than resistance, and reiterated his stance in support of Israel, saying Israel has a “duty to respond,” despite the mass civilian casualties in Gaza. Biden further stated that the U.S. is sending ammunition and interceptors for the Iron dome to Israel. Lastly, Biden warned other countries and organizations against getting involved against Israel. Hamas called Biden’s speech deplorable and inflammatory, saying Hamas launched its operation to defend the Palestinian people and put an end to the occupation. Biden also spoke with Prime Minister Netanyahu about U.S. assistance. 392 members of the U.S. House of Representatives co-sponsored a resolution in support of Israel, calling the Hamas operation “barbaric.” It is unknown if the resolution will pass, as it is unclear if the acting speaker of the House Patrick McHenry (R-NC) has the authority to bring the resolution to the floor. EU high commissioner for foreign affairs Josep Borell said he had invited PA and Israeli foreign ministers Riyad al-Maliki and Eli Cohen to an EU foreign ministers meeting to discuss the situation in Palestine and Israel. Hamas launched Operation Al-Aqsa Flood, entering Israeli towns and villages near Gaza through the Gaza fence and by air, using improvised paramotoring gliders, attacking military equipment with explosive drones, and firing thousands of rockets. Palestinian militants took control of at least 14 Israeli bases, police stations, and towns, in addition to the Beit Hanun (Erez) crossing, and bulldozed parts of the Gaza fence. More than 200 people were captured by militants and brought to Gaza, as were dozens of Israeli military vehicles. Hamas political leader Ismail Haniyeh said Hamas had warned Israel about damaging al-Aqsa Mosque, continued settlement expansion, and raids on Palestinian cities and towns, but that Israel had ignored its warnings. Haniyeh further stated, “Israel could have silenced us by giving us crumbs, but the government turned its back on any possibility of a prisoner exchange and continued the siege of the strip.” Islamic Jihad spokesperson Dauod Shihab said Israeli captives would only be released in a prisoner exchange, adding the organization had taken women and children captives because Israel does the same. PA president Mahmoud Abbas visited Jenin for the first time in 12 years, giving a speech in Jenin refugee camp. Abbas praised the steadfastness of the Jenin residents in light of Israel’s attacks. It was reported that a ceasefire between Hamas, Islamic Jihad in Palestine, and Israel had been brokered by Egypt and would take effect at 2 a.m. on 5/21. Shortly after the 2 sides announced the ceasefire, U.S. president Joe Biden praised Egyptian president Abdel Fattah al-Sisi for his role in the ceasefire and Prime Minister Netanyahu for agreeing to it. U.S. president Donald Trump announced that Morocco had decided to normalize relations with Israel in a deal where the U.S. reverses decades of policy to recognize Moroccan sovereignty over the Western Sahara. As part of the deal, Morocco will open a diplomatic office in Tel Aviv and Israel in Rabat, which eventually will be turned into embassies; both will also grant overflight rights to each other. The UN recognizes the legitimate rights of the Sahrawi people to self-determination as it does the Palestinian people. U.S. officials later told Reuters that the U.S. is negotiating with Morocco to sell 4 sophisticated drones to the country. According to the prime minister of Morocco Saad-Eddine El Othmani, the king of Morocco Mohammed VI and PA president Mahmoud Abbas spoke on the phone after the announcement of the normalization deal. Prime Minister El Othmani also said Morocco still rejects the U.S. peace plan and remains “supportive of the Palestinian cause.” Hamas called the normalization deal a betrayal while the PA has been silent. Moroccans protested the normalization in several cities after the announcement. It was reported by the New York Times that the U.S. also promised Morocco to facilitate an investment of $3 billion over 3 years as part of the deal. Al-Monitor reports that the Egyptian authorities decided to largely close the Rafah border crossing on 1/5 in part due to the PA’s withdrawal from the Palestinian side of the crossing, as was previously reported, but also in part out of displeasure with the Qatari transfers of money to Gaza. According to a Hamas source, the Egyptians were “furious” about Qatar’s growing influence in Gaza and wanted to punish Hamas. The Egyptian authorities reportedly only opened the crossing on 1/29 after pressure from the Israelis. (ALM 1/31)

Israel’s Public Security Minister Gilad Erdan signs an order extending the ban on several Palestinian institutions in East Jerusalem, including the Palestinian Prisoner’s Club, the Center for Palestinian Studies, and the Orient House, which once housed the PLO’s headquarters in East Jerusalem. “The PA has recently been trying to strengthen its presence in East Jerusalem in sophisticated ways, including the transfer of significant funds for activities,” Erdan says. “I will continue to strengthen Israeli sovereignty throughout Jerusalem, and prevent any Palestinian attempt to create a foothold in the eastern part of the city.” (JP, TOI 1/31)

After a meeting of the Israeli security cabinet, an Egypt- and UN-backed cease-fire between Israel and Hamas goes into effect. It is reportedly based on the principles of the cease-fire deal that halted Operation Protective Edge, Israel’s 2014 assault on Gaza, and it provides for a cessation of all hostilities. The Israeli cabinet reportedly approved the agreement in principle on 8/12 and only met today to review the details one last time. Earlier, Israeli DM Lieberman announced the reopening of the Kerem Shalom border crossing (effectively lifting the last of the restrictions the Israeli authorities imposed on 7/9) and the expansion of the fishing zone off Gaza’s coast to nine nautical miles, up from as few as three at the peak of the Israeli crackdown. “The opening of the Kerem Shalom crossing, after four days of quiet, is intended to indicate to the population in Gaza that maintaining quiet is first and foremost an interest for Gaza’s residents,” he says. The Palestinian Central Council convenes in Ramallah for its 29th regular meeting. The PLO body discusses a variety of issues related to statehood, including the stalled national reconciliation process, and plans to meet again on 8/16. In a speech kicking off the meetings, PA president Abbas says that Hamas is not serious about reconciliation. “Hamas principally does not have intentions to achieve reconciliation,” he says. The Israel Land Authority (ILA) publishes tenders for the construction of 602 new housing units in the Ramat Shlomo settlement of East Jerusalem. The 603 units are part of a larger development plan that dates back to 2010. The ILA separately reaches a $380 million agreement with the Jerusalem Municipality for a series of development projects across the city, including 20,000 new housing units. Concluding 2 days of talks in Cairo, representatives of Palestinian factions, including Hamas and Fatah, reaffirm the 10/12 reconciliation agreement (see JPS 47 [2]), emphasize the need for the PA to take control of Gaza, and call for a new round of elections for the PA presidency, the Palestinian Legislative Council, and the Palestinian National Council by the end of 2018.
