Reuters reported that the Israeli refusal to offer concessions to Palestinians as part of the Israel-Saudi Arabia normalization deal will not hold up the deal, according to 3 sources Reuters spoke to. Axios reported that U.S. president Joe Biden and Israeli prime minister Benjamin Netanyahu agreed to a provision in the normalization deal that would preserve the prospect of a peace deal between Israel and Palestine during their meeting on 9/20. The UN Independent International Commission of Inquiry on the Occupied Palestinian Territory, including East Jerusalem, and in Israel, issued a position paper on the legality of the Israeli occupation to the ICJ for the court’s assessment of the issue, saying the occupation is unlawful under international law. In the West Bank, the Israeli military claimed that Palestinian militants had opened fire at Israeli soldiers on 3 separate occasions at the Salem checkpoint and in Dayr Sharaf and Jalbun, damaging 1 vehicle. Saudi Arabia, Jordan, Egypt, the UAE, and the EU sponsored a conference called The Peace Day Effort to advance the two-state solution through political, economic, cultural, and security-oriented means. The conference was held in New York on the sidelines of the annual UN General Assembly meeting and attended by around 30 foreign ministers. China’s ambassador to the UN and U.S. deputy assistant secretary of state for Israeli-Palestinian affairs Andrew Miller also attended. Saudi foreign minister Prince Faisal bin Farhan Al Saud said before the conference that it was convened as “[p]eople have started to losing hope in a two-state solution” and that there can be no solution to the Palestinian-Israeli conflict without the establishment of a Palestinian state. Ahead of traveling to the U.S. for the annual UN General Assembly session Israeli prime minister Benjamin Netanyahu said that Israelis who protest his government’s judicial overhaul are aligning themselves with the PLO and Iran. The Prime Minister’s office later clarified, after backlash from the Israeli opposition and Jewish organizations in the U.S., that Netanyahu was criticizing that Israelis were protesting Israel at the same time as supporters of the PLO and BDS were and that they should also protest “those who deny the State of Israel’s right to exist.” Later in the day, Netanyahu met with Tesla, X, and Space X owner Elon Musk in Silicon Valley, defending Musk against charges of anti-Semitism brought by the Anti-Defamation League, among others. Helicopter fighter pilot Shira Etting, a leader in the Israeli protest movement against the Israeli government’s judicial overhaul, told 60 Minutes that “[i]f you want pilots to be able to fly, and shoot bombs and missiles into houses knowing they might be killing children, they must have the strongest confidence in the people making those decisions.” (HA 9/18; HA 9/20)

Israeli defense minister Yoav Gallant signed an order to release a settler from administrative detention, saying he had confessed to his crimes. The settler was part of the settler attacks on Palestinians in the last week of June. (HA 8/25)

The UN Office for the Coordination of Humanitarian Affairs released a survey of the West Bank, finding Israel placed 645 obstacles to the movement of Palestinians. The UN counted 49 permanently staffed checkpoints, 139 intermittently staffed checkpoints, 304 roadblocks, 73 earth walls, road barriers, and trenches, and 80 obstacles of various types in H2 in Hebron, in addition to the restrictions posed by the separation wall. The Wall Street Journal reported that the Chinese state-owned company China National Nuclear Corp had offered to build a nuclear plant in Saudi Arabia. It has been widely reported that a condition for Saudi normalization with Israel depends on U.S. help with establishing a nuclear program in Saudi Arabia. 4 U.S. officials also told Axios that the U.S. has informed Israel that it would have to make significant concessions to Palestine if they are to strike a normalization deal with Saudi Arabia. The Dutch Supreme Court found that a Palestinian man, Ismail Ziada, cannot sue former Israeli military officials Benny Gantz and Amir Eshel over their involvement in the 2014 airstrike that killed 6 members of his family. A Hamas official told Haaretz that Hamas and the PA are working together to pressure Gulf countries to continue funding the World Food Programme cash payments to 200,000 Palestinians in Gaza, which is set to be shut down this summer due to funding cuts. (HA 6/2; MDW 6/10)

Haaretz reported that Israel is allowing 6 settlement outposts to operate in the part of Masafer Yatta that Israel has designated a firing zone and where the Palestinian residents will be forcefully expelled. 3 of the outposts were built after the High Court of Justice ruling in May 2022 allowing the Israeli government to expel the more than 1,000 Palestinians. UNRWA commissioner-general Phillippe Lazzarini said that his agency only had secured $107 million in new contributions of the $300 million needed during a donor conference. UNRWA did not say who had provided the new funds. Lazzarini said before the conference that UNRWA needs $150 million to keep its services running until the end of 2023, $50 million to start 2024 without liabilities, $75 million to keep food programs in Gaza running and $30 million for cash distributions in Syria and Lebanon. Israeli settlers threw stones at Palestinian vehicles traveling near Ramallah, al-Khader, Furush Beit Dajan, Nablus, Huwwara, Deir Sharaf, and Tuqu’, causing damage. Israeli settlers also set fire to greenhouses in Furush Beit Dajan. Israeli forces shot and injured 2 Palestinians and arrested 4 others during a raid in Beit Umar. Israeli forces also violently dispersed Palestinian protesters in Kafr Qaddum, injuring 6 with baton rounds and others with tear gas. Meanwhile, Israeli forces violently dispersed Palestinian protesters in Bayt Dajan, injuring 10 with tear gas. Israeli forces also raided Burqin, injuring 2 Palestinians with live ammunition and others with tear gas. In East Jerusalem, 1 Israeli settler shot at Palestinians who allegedly fired fireworks at Israeli settlement housing in al-Tur, no injuries were reported. Israeli police raided the Haram al-Sharif compound and arrested 15 worshippers it claimed had been waiving “terror flags,” referring to the Palestinian flag and Hamas’ flag. In Tel Aviv, 1 Palestinian man hit 8 people with his car, all tourists from Italy and the UK, before being shot and killed by Israeli police. It was unclear if the ramming was intentional. 1 Italian tourist was killed under circumstances that were not clear as Israeli media claimed he was hit by the Palestinian man and died of his injuries while eyewitness reports said he was shot by Israeli police. Leaders at the Arab-China Summit in Riyadh called for a just and lasting solution, based on the 2-state solution, to the Israeli occupation of Palestine in their final communique of the summit. In a speech at the summit PA president Mahmoud Abbas called for the international community to not work with any Israeli government that refused to work within the framework of international law. Palestinian member of the Knesset and leader of the Hadash party Ayman Odeh met with UN secretary-general António Guterres in New York, briefing Guterres on his concerns about the government Benjamin Netanyahu is expected to present within a couple of weeks. Israeli ambassador to the UN Gilad Erdan called the meeting “cowardly and shameful.” Israeli media reported that the meeting was made in coordination with the PA rather than with the Israeli foreign ministry. Egypt’s foreign ministry issued a statement warning Israel against continuing its attacks on Palestinians, noting that more than 200 Palestinians have been killed by Israeli forces in 2022. The ministry warned that the situation will continue to deteriorate if Israel continues its current practices. (HA 12/9)

In the West Bank, the body of 1 Druze citizen of Israel was kidnapped for a 2nd time after it was arranged that the body would be transferred to Israel in a Red Crescent ambulance. The ambulance was stopped by armed men and the body taken to an unknown location. The Druze man was taken from a hospital in Jenin on 11/22. The Israeli central command froze the administrative detention of Khalil Awawdeh while he is in the hospital for treatment related to his 170 days of hunger strike. The foreign ministers of Belgium, Denmark, France, Germany, Ireland, Italy, the Netherlands, Spain, and Sweden released a joint statement calling the Israeli raids on 7 Palestinian rights organizations “not acceptable,” expressing deep concern over the raids and reiterating that the countries have not seen evidence that justify the Israeli attacks on Palestinian civil society. Elsewhere, an Israeli military vehicle rammed into 1 Palestinian in Kufeirit, causing a fracture and bruises. 1 Palestinian was arrested during a late-night raid in Burqin. In Gaza, Israel launched an operation dubbed Operation Breaking Dawn by assassinating northern Gaza Islamic Jihad commander Taysser al-Jabari and 1 of his bodyguards in an air strike on the Palestine Tower, a 13-story building in Gaza City; 2 stories of the building were severely damaged. Shortly after, another 8 Palestinians were killed in air strikes throughout Gaza: 3 on a street in al-Shuja‘iya, including a 5-year-old; 1 in al-Zaytun; 1 in her home in al-Fukhari; 1 in Beit Lahiya; and 2 in Khan Yunis. 63, including 9 children, were injured in the air strikes, which also caused extensive damage to property. PA president Mahmoud Abbas spoke to Israeli prime minister Yair Lapid and Israeli president Isaac Herzog in phone calls. The phone calls come 1 day after defense minister Benny Gantz visited President Abbas in Ramallah and 1 week ahead of U.S. president Joe Biden’s visit to Palestine and Israel. It was the 1st direct call between Abbas and an Israeli prime minister since 2017. The Jerusalem district court froze registration of ownership of the Alexander Nevsky Church in the Old City of Jerusalem, saying that the decision of ownership of the church was for the Israeli government to decide. The Russian government has tried to register the ownership of the church for itself rather than the Imperial Orthodox Palestine Society. The Israeli justice ministry said in January 2020 that the church would be registered as owned by the state of Russia as part of a deal between Israel and Russia over the release of an Israeli citizen who was arrested in Moscow for drug trafficking. The Saudi Arabian state news agency SPA reported that Saudi crown prince Mohammed bin Salman said Israel could become an ally of Saudi Arabia if Israel “solve[s] its problems with the Palestinians.” Crown Prince bin Salman also said Saudi Arabia will continue talks with Iran to solve the 2 countries’ conflict. The Israeli company American Quality Products (AQP), which is licensed to manufacture and distribute Ben & Jerry’s ice cream in Israel, filed a lawsuit against Ben & Jerry’s and its parent company Unilever in a U.S. court. The lawsuit claims that Ben & Jerry’s decision to end its licensing agreement as part of a disengagement from Israeli settlements is unlawful. In the West Bank, up to 70 Israeli settlers attacked Palestinian shepherds with stones and clubs in Sa‘ir, causing fractures and bruises to an elderly man and his nephew. The forces blocked a vehicle carrying the 3 Palestinians and jumped out of the minibus, shooting dozens of bullets at their car. Turkish foreign minister Mevlüt Çavuşoğlu said that Turkey would not abandon its commitments to Palestine if the country normalizes its relations to Israel. Israel handed over the corpse of a Palestinian boy to the PA. It later recognized that it mistakenly handed over a corpse it did not intend to and would deliver the intended body soon. UK home secretary Pitri Patel announced that she had “taken action to proscribe Hamas in its entirety” as a terrorist organization. The decision will mean that anyone expressing support for Hamas or holding a meeting for the group can receive up to 10 years in prison. Home Secretary Patel’s decision still needs parliament approval. Patel said the decision was linked to combatting anti-Semitism in the UK. Hamas criticized the decision, saying that the UK chose to align itself with Israel’s occupation rather than apologizing for the Balfour Declaration and British imperialism. The PA said the decision will make Palestinians’ reconciliation efforts more complicated and undermines Palestinian democracy. The UK along with the EU had already designated Hamas’s military wing as a terrorist organization. The UK follows Israel, Canada, and the U.S. in designating its political wing as a terrorist organization. It was reported in Israeli media that PA president Mahmoud Abbas met with new director of the Shin Bet Ronen Bar in the last week. An Israeli military court refuted claims by defense and foreign ministers Benny Gantz and Yair Lapid that a Spanish woman working for Health Work Committees had any links to the 6 Palestinian rights organizations that Israel last month deemed terrorist. The 2 ministers had tried to justify the designation by using the conviction of the Spanish woman as evidence, which the military court then rejected. The cybersecurity firm ESET published a report saying that the Israeli spyware company Candiru’s spyware was used to hack 20 websites in the UK, Yemen, South Africa, Italy, Iran, and Syria, including Middle East Eye. Palestine Legal submitted a civil rights complaint against the George Washington University (GWU) to the DC office for human rights for discriminating against Palestinians. The Intercept and Local Call reported that Israeli settlers and soldiers had cooperated in the deliberately killing at least 4 Palestinians on 5/14, a day where Israeli soldiers and settlers ultimately killed 11 Palestinians across the West Bank. In videos obtained by B’Tselem, it is evident that Israeli settlers stand side by side with Israeli soldiers firing automatic rifles at Palestinians trying to protect themselves from a settler raid in ‘Urif. Haaretz said that documents they had examined revealed that the Israeli defense ministry had worked with a Jewish National Fund subsidiary, Himanuta, to purchase Palestinian-owned land in the West Bank and to prevent Palestinians from accessing the land in question. The deals between Himanuta and the defense ministry were made in 2018 and 2019. Among the purchases were a 1,000-dunam (250 acres) plot of land near the Hamra settlement, which Israel closed off to its Palestinian owners more than 50 years ago; a plot of land near Ramallah; the home of the Bakri family in Hebron; and a 218-dunam (54 acres) plot of land near the Argaman settlement. The New York Times reported that Israel is refusing to extricate a Mexican former federal prosecutor, Tomas Zeron De Lucio, who is wanted for falsifying evidence, torture, and misuse of the NSO Group’s Pegasus spyware. According to NYT sources, Israel is refusing the extradition because of the country’s perception of Mexico as supportive of Palestine. The Canadian cybersecurity research group Citizen Lab said that spyware from the Israeli company Candiru was used to spy on more than 100 activists from several countries including Saudi Arabia, Israel, Hungary, Indonesia, the UK, Palestine, Iran, Lebanon, Yemen, Spain, Turkey, Armenia, and Singapore. Spyware was installed on the users’ computers using the Microsoft operating system Windows. Microsoft said it had updated its software to close the hole in its security. 1 of the ways the spyware infected users’ devices was when a user clicked on a URL set up by the attacker. Israel also said it had assassinated 3 Hamas operatives, Shadi Abed Al-Hadi, Osama Shehadeh, and Zakaria Zarendah. Israeli air strikes also destroyed an interior ministry building west of Gaza City and 3 poultry farms near Rafah, killing more than 10,000 chickens. Israeli forces also struck the fishing ports in Gaza city and Khan Yunis. Damage to power lines in Gaza was reported, significantly reducing the amount of available electricity. In Israel, Israeli forces killed 2 people after several people crossed from Lebanon into Israel by Metula. Israel also said that 3 rockets were fired at Israel from Syria, with 2 landing in open land in the Israeli-occupied Golan Heights and 1 in Syria. 2 rockets from Gaza hit 2 houses in Sderot, causing damage and 1 injury. 1 rocket from Gaza lightly injured 1 Israeli driving near Beersheba. Israel barred people from outside of Lydda from entering the city from 4 p.m. and barred all its residents from leaving their homes after 9 p.m. 1 Palestinian-Israeli minor was seriously injured, and another minor lightly injured, after a firebomb was thrown at their house in Jaffa; Israeli police claimed without evidence that it was 2 Palestinian-Israeli men that had thrown the firebomb. Israeli forces were filmed kicking Palestinian-Israeli vehicles traveling in Umm al-Fahm and firing stun grenades at them for no apparent reason. Israeli forces shot and injured 1 Palestinian-Israeli minor in Lydda, claiming he tried to throw a firebomb at them. 5 Palestinian-Israelis were arrested in Umm al-Fahm after a fire was ignited at the town’s city hall. 9 Palestinian-Israelis were arrested in ‘Akka. Israeli forces violently dispersed Palestinian-Israeli protesters in Kafr Kana, injuring 28. Israel also told international news outlets that it would conduct a ground invasion of Gaza shortly and then later apologized to the news outlets for providing false information; analysts suspected that Israel used the media outlets to lure Hamas militants into tunnels before heavily bombarding said tunnels; Israel said that dozens were killed in the attack on the tunnels. Israel also shot down 1 drone sent from Gaza. 1 Israeli woman succumbed to injuries sustained after falling while running to a shelter in Neta’im on 5/11, raising the Israeli death toll to 9. In Jordan, some 500 protesters tried to enter the West Bank through the Allenby bridge, but were dispersed by Jordanian forces 3 miles from the border. In Amman, thousands of protesters called for the expulsion of the Israeli ambassador and ending the Jordanian-Israeli peace treaty. The Palestinian Health Ministry in Gaza said that 42% of the 119 people who have been killed in the Israeli attack on Gaza, at the time of reporting, were women and children. A letter co-signed by 11 Jewish Democrats in the house of representatives, led by Jerrold Nadler (D-NY), urged the Biden administration to be more active in ending the escalation of violence between Israel and Hamas and to do more to end the Israeli-Palestinian conflict. The 11 members of Congress also expressed concern about the violence in East Jerusalem and urged Israel to halt the “unjust eviction” of Palestinians from their homes in Shaykh Jarrah, and said that the U.S. must address the deepening occupation. ICC chief prosecutor Fatou Bensouda said that she will continue with her inquiry into potential war crimes committed by Israelis and Palestinians in the occupied Palestinian territories despite Israel’s refusal to cooperate. The U.S. lifted sanctions on ICC officials Fatou Bensouda and Phakiso Mochochoko, who were sanctioned by the Trump administration in June 2020 in retaliation for their work on the probe into war crimes committed in the occupied Palestinian territory and Afghanistan. Secretary of state Antony Blinken said, “[w]e continue to disagree strongly with the ICC’s actions relating to the Afghanistan and Palestinian situations . . . We maintain our longstanding objection to the court’s efforts to assert jurisdiction over personnel of non-States Parties such as the United States and Israel. We believe, however, that our concerns about these cases would be better addressed through engagement with all stakeholders in the ICC process rather than through the imposition of sanctions.” Secretary Blinken spoke with Israel’s foreign minister Gabi Ashkenazi before the announcement. During the call, Blinken told Foreign Minister Ashkenazi that the U.S. believes Israelis and Palestinians should have equal measurers of freedom security, prosperity, and democracy. The EU said that Iran and the U.S. will hold indirect talks in Vienna on 4/6. The meeting comes as the EU and the Joint Comprehensive Plan of Action signatories are trying to get the U.S. back into the 2015 Iran nuclear agreement and Iran to start complying with the agreement again. The ICC ruled that it has territorial jurisdiction to persecute alleged war crimes committed in the occupied Palestinian territories, as it found Palestine to be “a State Party to the [Rome] Statute.” The ICC defined the occupied Palestinian territories as the West Bank, including East Jerusalem, and Gaza. Israel has argued that the ICC does not have jurisdiction to prosecute matters pertaining to Israel and Palestine because Israel is not party to the Rome Statute and because Palestine is not a state. The latter 2 of the 3 ICC judges ultimately disagreed with erasing the final hurdle to start a formal investigation, 6 years after the ICC chief prosecutor Fatou Bensouda started her preliminary investigation into alleged war crimes made by Israel and Hamas. Israeli prime minister Benjamin Netanyahu called the ruling “pure anti-Semitism” and said, “[w]e will fight this perversion of justice with all our might.” The PA prime minister Mohammed Shtayyeh praised the decision. The U.S. State Department’s spokesperson said the U.S. has “serious concern about the ICC’s attempts to exercise its jurisdiction over Israeli personnel. We have always taken the position that the court’s jurisdiction should be reserved for countries that consent to it or that are referred by the UN Security Council.” Haaretz reported that Israel has started briefing military personnel on potential implications for them if the proceedings move to a trial. A group of 22 Republican members of the U.S. House sent a letter to U.S. president Donald Trump urging the president to declassify a State Department report mandated by Congress in 2012 that distinguishes between Palestinian refugees born in Palestine before 1948 and those born outside of Palestine. The 22 Republicans said in the letter that they do not believe that descendants of Palestinian refugees born in Palestine before 1948 can be considered refugees and called the Right of Return a “fiction” that should “end.” (Rep. The Saudi foreign minister Prince Faisal bin Farhan al-Saud said at a virtual meeting that Saudi Arabia’s demand before normalization with Israel is a “peace deal that delivers a Palestinian state with dignity and with a workable sovereignty that Palestinians can accept.” (AJ 12/4)

Concluding 2 days of talks in Cairo, representatives of Palestinian factions, including Hamas and Fatah, reaffirm the 10/12 reconciliation agreement (see JPS 47 [2]), emphasize the need for the PA to take control of Gaza, and call for a new round of elections for the PA presidency, the Palestinian Legislative Council, and the Palestinian National Council by the end of 2018. The Arab press reports that PA pres. Abbas has refused a phone call from senior advisor to U.S. pres. Trump Jared Kushner, apparently implementing the Palestinians’ threat, reported on 11/21, to cut off communication with the U.S. in response to the Trump administration’s threat to close the PLO office in Washington.
