In East Jerusalem, Israeli forces prevent Palestinians from reaching the Haram al-Sharif compound. In Gaza, Israeli forces bomb Rafah, Khan Yunis, Jabalia refugee camp, Beit Lahiya, and Nuseirat refugee camp, killing at least 183 people. Israeli forces also open fire at Palestinians fleeing from Khan Yunis to Rafah and fire tank shells at al-Amal Hospital. The Nasser Hospital in Khan Yunis suffers a complete electricity blackout as it is besieged by Israeli forces for the fifth day in a row. In Lebanon, Israeli forces strike Bayt Lif and Deir Aames, killing 2 people and injuring 4 in Bayt Lif. Hezbollah says it attacked 2 Israeli bases near the Blue Line. The ICJ rules that there is a basis to further investigate the South African genocide case against Israel and that the ICJ has jurisdiction to hear the case. The court issues 6 provisional measures: 1) Israel must take all possible measures to prevent acts as outlined in Article 2 of the Genocide Convention, including not killing members of a particular group [Palestinians], not causing physical or psychological harm to members of that group, not inflicting living conditions which are calculated to bring about the end of the existence of a people, and not carrying out acts to precent the births within the group. 2) Israel must ensure its military does not carry out any of the actions outlined in measure 1. 3) Israel must prevent and punish incitement to commit genocide. 4) Israel must ensure the delivery of basic services and essential humanitarian aid. 5) Israel must prevent the destruction of evidence of war crimes and allow fact-finding missions access. 6) Israel must submit a report on all steps taken to abide by the measures within 1 month. 4 of the orders are approved by 15 of the 17 judges, while 2 of the measures are approved by 16 of the 17 judges. The only judge to vote against all measures is Judge Julia Sebutinde of Uganda. Aharon Barak, the judge representing Israel, votes for measures 3 and 4. The measures issued by the court fall short of South Africa’s demand for a ceasefire. Hamas welcomes the ICJ orders and calls on the international community to force Israel to implement the decisions. PA ambassador to the UN Riyad Mansour calls the measures against Israel “historic.” South Africa calls the ruling a “decisive victory.” Israeli prime minister Benjamin Netanyahu instructs his ministers not to comment on the ICJ decision and calls the ruling “outrageous.” The U.S. State Department says the ICJ did not “make a finding about genocide” despite the court specifically saying that it is continuing its trial of Israel on charges of genocide. Senator Chris Van Hollen (D-MD) tells Axios that “Netanyahu has given Biden the finger” at every juncture and that the Biden administration pleads with Netanyahu but gets “slapped in the face over and over again.” Axios also says Secretary Blinken’s visit to Israel earlier in the week was contentious due to the Israeli refusal to pay the PA its full tax revenue. Save the Children says more than 1,000 Palestinian children in Gaza have had 1 or both legs amputated after being hit by Israeli bombs, many of the amputations are done without anesthetics. The Commission of Detainees and Ex-Detainees Affairs said a large number of Palestinian prisoners in the Ofer Prison have experienced food poisoning after being given spoiled meals. The Israeli human rights organization Yesh Din said 2023 was the worst year for Israeli settler violence against Palestinians since 2006 when the group started monitoring. Israeli foreign minister Eli Cohen claimed that Israel will allow ships to deliver aid from Cyprus to Gaza immediately. Under the agreement the aid would be inspected by Israel in Larnaca and shipped to Gaza. Later in the day Cohen swapped jobs with infrastructure and energy minister Israel Katz. Israeli finance minister Bezalel Smotrich said Israel would not allow 2 million Palestinians to live in Gaza after the war, saying it would benefit Israel if the number was 100,000 to 200,000 at the end of the war. Comments by Israeli prime minister Benjamin Netanyahu to the Knesset foreign affairs and defense committees were leaked to the press. Netanyahu said the “difference between Hamas and the PA is only that Hamas wants to destroy us here and now, and the PA wants to do it in stages.” Netanyahu also said Gaza will be under Israeli military control and that Gulf states will rehabilitate the area. U.S. National Security Council spokesperson John Kirby said the U.S. was “asking questions” in relation to reporting from Amnesty International and the Washington Post that Israel had used U.S.-supplied white phosphorus in Lebanon. The Post said a journalist had found remnants of 3 artillery shells that indicated that they were U.S.-made white phosphorous shells. Secretary of State Antony Blinken spoke with Israeli war cabinet member Benny Gantz, calling on Israel to take steps to avoid civilian harm and increase aid. EU high representative for foreign affairs Josep Borell called the destruction in Gaza “even greater than destruction suffered by the German cities during the Second World War,” noting that 60-70% of the casualties are civilians and 85% of the population have been internally displaced. Borell also said the EU will propose sanctions on violent Israeli settlers. France, Germany, and Italy also called on the EU to set up a special sanctions scheme to target Hamas. In the West Bank, a Palestinian man succumbed to injuries sustained from Israeli forces in al-Fara’a refugee camp on 12/8. Israeli settlers threw stones at Palestinian vehicles traveling near al-Lubban ash-Sharqiya; no injuries were reported. Israeli forces shot and killed a Palestinian man, claiming he had stabbed an Israeli soldier with a knife during an Israeli raid in Dura. Israeli forces also shot and killed a Palestinian child during a raid in ‘Azzun. In East Jerusalem, Israeli authorities delivered evacuation orders to several Palestinian families living on around 9 dunams (2.2 acres) of land in the Moroccan Gate area of the Old City, giving them 60 days to file objections. In Gaza, Israeli forces bombed Rafah, Khan Yunis, Nuseirat refugee camp, Gaza City Dayr al-Balah, Maghazi, Jabaliya refugee camp, and al-Bureij refugee camp, killing more than 200 people. Israel continued its siege of al-Awda Hospital in Jabalia refugee camp for the third day in a row, injuring 2 health workers. Israeli forces also shot and injured 2 paramedics in an ambulance outside of the European Hospital in Khan Yunis. The Red Crescent delivered medical supplies to al-Ahli Arab Hospital in Gaza City and evacuated 19 patients; 1 of the patients died during the evacuation and 1 Red Crescent staffer was beaten and interrogated for 4 hours by Israeli forces. 4 Israeli soldiers were killed in combat. In Tzrifin, an Israeli soldier was injured after being hit by a car; 2 were arrested, including a man from Rahat and a man from Qalqilya in the West Bank. In Lebanon, Israel attacked several targets and Hezbollah said it had attacked an Israeli naval base. In the Red Sea, France said a French warship had shot down 2 drones near Yemen. Videos by Israeli soldiers of Palestinians in the underwear surrendering to Israeli forces in Jabalia refugee camps circulated in the media. However, the videos were reportedly staged as in 1 video a man is shown surrendering a weapon while holding it in his right hand while a nearly identical video shows the same man surrendering a weapon while holding it in his left hand. Responding to videos of hundreds of Palestinians detained by Israeli forces in Gaza stripped to their underwear, advisor to Israeli prime minister Benjamin Netanyahu, Mark Regev, said the Middle East is warmer than Europe so “to be asked to take off your shirt, it might not be pleasant, but it is not the end of the world.” Israel later claimed that 10-15% of the Palestinians in the videos were Hamas operatives or identified with the Hamas. Israeli national security advisor Tzachi Hanegbi claimed that Israel has killed 7,000 members of Palestinian militant groups during its attacks on Gaza. In the West Bank, Israeli settlers uprooted 12 olive trees in Salfit and vandalized Palestinian property in al-Twana in the Masafer Yatta area. Israeli forces shot and killed 3 Palestinians, including a 12-year-old during raids in Balata refugee camp, Beita, and Burqa. Israeli forces also shot and injured 5 people during raids in Balata refugee camp, Habla, and Burqa. Israeli forces also issued stop work orders for 8 homes in al-Khader. 76 Palestinians were arrested during late-night raids in and around ‘Azzun, al-Arroub refugee camp, Nablus, Balata refugee camp, Jenin, Tubas, Bethlehem, Aroura, and Abu Dis. 3,130 Palestinians have been arrested in the West Bank since 10/7. In East Jerusalem, Israeli forces shot, injured, and arrested a Palestinian child in Jabel Mukaber. In Gaza, Israeli airstrikes killed around 270 Palestinians, including 30 in an airstrike on an UNRWA school in Jabalia refugee camp, 15 in Khan Yunis, 14 in Rafah, 10 in the Sheikh Radwan neighborhood of Gaza City, and 5 in Nuseirat refugee camp. Israel also bombed the Zeitoun neighborhood, Bani Suhaila, al-Daraj, and al-Tufah. Israel said it had assassinated Hamas naval commander Omar Abu Jallah. Israeli forces also attacked the Indonesian Hospital’s main gate, power generators, and administrative office. Elsewhere, Israeli forces arrested al-Shifa Hospital director Mohammad Abu Salmiya and other medical staff. After the arrest, the Gaza Ministry of Health suspended coordination with the WHO. 4 wounded Palestinians died during an evacuation from the Turkish-Palestinian Friendship Hospital to Khan Yunis. Israel said it attacked 300 sites in Gaza during the day. Rockets were fired from Gaza at Israel; no injuries were reported. In Lebanon, Israeli forces attacked several sites, saying they had been used to fire 35 rockets toward Israel, causing damage to 2 homes.
