Israel’s public defender’s office issues a report based on visits to the Carmel, Damon, and Eshel prisons and the Russian Compound, saying conditions for all prisoners are deteriorating and noting that half of all prisoners have less than 29.5 square feet of space while around 3,400 prisoners are sleeping on mattresses on the floor. The report says that prisoners are experiencing “[i]ntolerable overcrowding; poor sanitary conditions; hygiene problems and infestations; poor ventilations; a lack of basic equipment.” (HA 2/7)

Hamas responds to the Israeli, U.S., Qatari, and Egyptian ceasefire proposal. Hamas official Ghazi Hamad says Hamas is seeking to have as many Palestinian prisoners released as possible.   Hamas also says its response was delayed due to many issues in the proposal being “unclear and ambiguous.” Qatar calls the response “mostly positive.” Israel says it is “thoroughly” evaluating the response. The Israeli military opens an investigation into allegation its forces killed Israelis on 10/7/2023. The military also says that it believes that 32 additional captives out of the 136 remaining captives held in Gaza have been killed. Haaretz reports that the Israeli military has begun investigating dozens of incidents in Gaza that are suspected to have violated international law, including killings of civilians and targeting of hospitals, schools, and government institutions. The New York Times releases an investigation showing Israeli soldiers posting videos on social media of themselves gleefully destroying civilian property. Israeli foreign minister Israel Katz meets with the UN envoy for humanitarian aid to Gaza Sigrid Kaag, saying the UN must find a way to bypass UNRWA in delivering aid. (AJ 2/6)

U.S. secretary of state Antony Blinken meets with Qatari prime minister Mohammed bin Abdulrahman bin Jassim Al Thani in Doha, Egyptian president Abdel Fattah el-Sisi in Cairo, and later travels to Israel. At a press conference with Al Thani, Blinken says the U.S. will be promoting steps toward a Palestinian state and Israeli normalization deals after the war in Gaza. The U.S. House of Representatives rejects a standalone bill for $17.6 billion in assistance to Israel, unlike the Senate bill which includes Ukraine, Taiwan, and border funding. President Joe Biden previously said he would veto the House bill. The ICJ elects Ugandan judge Julia Sebutinde as its vice president for a 3-year period. Sebutinde was the only judge on the 17-member panel to vote against all provisional measures in South Africa’s genocide case against Israel in January. The UN Office of the High Commissioner for Human Rights released a statement saying it had received reports that Israeli forces had executed 11 unarmed Palestinians in front of their families in the Rimal neighborhood of Gaza City between 8 p.m. and 11 p.m. on 12/19. The Israeli forces also reportedly forced women and children into a room and threw a grenade at them, causing injuries. The Human Rights Office called for an immediate and independent investigation. Hamas political leader Ismail Haniyeh arrived in Cairo for talks with Egyptian officials. Hamas official Ghazi Hamad told Al Jazeera that the party had tried to contact Fatah to begin talks about the situation in Gaza now and the future of a unified Palestinian political system, but that PA president Mahmoud Abbas had rejected talks. The Wall Street Journal reported that Hamas’ political bureau was in talks with other Palestinian factions about the situation in Gaza after the Israeli attack. Political bureau member Husam Badran told the Journal that the talks also included former Palestinian prime minister Salam Fayyad and former Fatah member Mohammed Dahlan. The Journal also reported that Hamas turned down a proposal to exchange a weeklong ceasefire for 40 captives held in Gaza. In the West Bank, a Palestinian man succumbed to injuries sustained during the airstrikes on Tulkarm refugee camp on 11/17. Israeli settlers attacked and wounded several Palestinian farmers in Ramin and vandalized their cars. Israeli forces shot and killed a Palestinian during a raid in Aqrabat Jaber refugee camp. Israeli forces also violently dispersed Palestinians celebrating the release of prisoners near the Ofer Prison, injuring 3 with live ammunition, 4 with baton rounds, and 22 with tear gas. Meanwhile, Israeli forces shot and injured 5 Palestinian during raids in Nablus, Deir al-Ghusun, and Tuqu’. Israeli forces also punitively demolished the family home in Rumana of a Palestinian who was shot dead by Israeli police in Tel Aviv earlier this year after he allegedly shot and killed several Israelis. Elsewhere, Israeli forces assaulted 5 Palestinians, arresting them and seizing their vehicles at a flying checkpoint near Aqraba. Israeli forces also assaulted 2 Palestinians during a raid in Taqqou. In East Jerusalem, Israeli forces violently dispersed Palestinians trying to reach the Haram al-Sharif compound from Wadi al-Juz, causing injuries from beatings and tear gas. Israeli forces also raided the homes of 3 Palestinian prisoners in Jabel Mukaber and Bayt Hanina, warning their families not to celebrate their release. In Gaza, before the ceasefire took effect (see below), Israeli forces raided the Indonesian Hospital, killing a wounded woman and injuring 3 others after shelling and destroying the first floor of the hospital. Israeli forces also bombed Nuseirat refugee camp, killing at least 27 people. After the ceasefire took effect, Israeli forces shot and killed 2 Palestinians and wounded 15 others who were trying to return to northern Gaza from the south. As of 11/18, at least 45,000 housing units had been destroyed and 233,000 had been damaged in Israeli airstrikes since 10/7, constituting 60% of all housing units. 2 ambulances, 4 trucks carrying diesel, 4 trucks carrying cooking oil, and 137 trucks carrying aid entered Gaza via the Rafah crossing. The UN delivered flour to 2 UNRWA facilities in the north of Gaza, the first delivery of aid the north in more than 1 month. 40 people were evacuated from al-Ahli Baptist Hospital in Gaza City to a hospital in Khan Yunis. Al-Ahli started to admit new patients despite a lack of electricity and essential hospital supplies. Fewer than 400 people fled the northern part of Gaza to the south. 44 wounded Palestinians and their companions were evacuated to Egypt. 39 Palestinians were released from the Ofer Prison as part of the prisoner exchange, including 24 women and 15 children. 33 were released to the Beitunia checkpoint, while 6 were released to East Jerusalem. 13 Israelis, 10 Thai nationals, and 1 Filipino national held captive by Hamas were released to Israel via Egypt. Germany said 4 of the Israelis were also German nationals. The Thai and Filipino captives were released in a separate deal made between Hamas and Thailand, brokered by Iran. The director of the Schneider Children’s Medical center in Israel said the captives the hospital had received were in good physical condition. Hamas published videos of its militants handing over captives to the Red Cross. Hamas political leader Ismail Haniyeh said Hamas was committed to the ceasefire as long as Israel abides by the terms. Head of the Palestinian Prisoners’ Club Qadura Fares said Israel had violated the prisoner exchange terms by releasing 7 people who were arrested within the past year instead of prisoners who had been in prison for longer. The Prisoner’s Club also said Israel had imposed a ban on celebrating the release of Palestinian prisoners, imposing fines of $18,700 for public celebrations. UK foreign secretary David Cameron visited Ramallah, saying the UK has committed an additional $37.8 million in aid to Gaza. Cameron also said that Israel will not have long-term safety and security unless Palestinians have the same, calling settler violence “completely unacceptable” and urging Israel to prosecute the perpetrators. Cameron met with PA president Mahmoud Abbas, who called on the UK to help ensure that Israel will not succeed in separating the West Bank and Gaza or reoccupy it. At a press conference held at the Rafah crossing, Spanish prime minister Pedro Sanchez said that a permanent ceasefire was required and said Spain may unilaterally recognize Palestine even if the EU does not. At the press conference, Belgian prime minister Alexander de Croo said “[w]ay too many people have died. The destruction of Gaza is unacceptable.” Israel subsequently summoned the Spanish and Belgian representatives in Israel for a reprimand, prompting Spain to do the same to the Israeli ambassador to Spain. Later in a meeting with de Croo and Sanchez in Cairo, Egyptian president Abdel Fattah el-Sisi called for the establishment of a demilitarized Palestinian state with UN, Arab, or NATO forces guaranteeing the peace. In the West Bank, Israeli settlers attacked Palestinian herders in Kisan with sticks, injuring 2, including a child. Israeli forces killed 14 Palestinians, including a PA officer, during a raid in Jenin and Jenin refugee camp. During the raid Israeli forces opened fire at ambulances, used drones to attack buildings with airstrikes, and used 4 bulldozers to raze paved streets. Israeli forces also shot and killed 4 Palestinians during raids in al-Am’ari refugee camp, Balata refugee camp, Hebron, and Bethlehem. Meanwhile, Israeli forces shot and injured 69 Palestinians during raids in Bethlehem, Beit Furik, Aqraba, Ni’lin, Jenin, Balata refugee camp, and al-Bireh. Israeli forces also displaced 20 Palestinian families from their homes in Khirbet Tana, demolishing homes and destroying beehives. 50 Palestinians, mostly people from Gaza working in Israel before 10/7, were arrested in Barta’a. In Gaza, Israeli airstrikes killed 243 Palestinians and injured around 430 others. Israeli airstrikes targeted the vicinity of al-Nasr Hospital, al-Awda Hospital, the Indonesian Hospital, and al-Shifa Hospital, killing at least 3 people and causing significant damage to the hospitals and 2 ambulances.  Israeli said it assassinated Hamas member Ibrahim Abu-Ma’asiv in an airstrike. 2 Israeli soldiers were killed in Gaza. Israel arrested High Follow-Up Committee for Arab Citizens of Israel chairperson Mohammed Barakeh and former MKs Haneen Zoabi, Sami Abou Shehadeh, and Mtanes Shehadeh who were planning to attend a small anti-war protest in Nazareth. Since Israel has banned large anti-war protests, Barakeh said he had told Nazereth police that he and 40 others would rally together, leading to his arrest. Protesters later demonstrated against the arrests of the Palestinian leaders outside of a police station in Tel Aviv; 15 were arrested. After the Palestinian leaders were released, Abou Shahadeh said he was arrested for “being a Palestinian citizen calling to end the war. During a speech at an aid conference in Paris, PA prime minister Mohammad Shtayyeh said that Hamas could not be eliminated because it is not just a military organization but “also an idea.” Shtayyeh also said Israel was waging war against all Palestinians, violating international law. French president Emmanuel Macron, who hosted the conference, said civilians in Gaza must be protected, calling for humanitarian pauses and for countries to work on a ceasefire. Egyptian foreign minister Sameh Shoukry complained that the international community has an “imbalance” in its conscience when it ignores Israeli violations of international law. Separately, PA presidential spokesperson Nabil Abu Rudeineh said Israel’s aim is to kill as many Palestinians as possible, referring to the many killed in the West Bank as Israel attacks Gaza. Abu Rudeineh called on the U.S. to force Israel to stop its attacks. Israeli prime minister Benjamin Netanyahu’s spokesperson Ofir Gendelman tweeted a video he claimed showed Palestinians staging people being injured and evacuated. However, the video was backstage footage from the Lebanese short film The Reality. Gendelman kept the tweet up even after X (formerly known as Twitter) clarified what the video actually showed. U.S. president Joe Biden said Israel had agreed to daily 4-hour pauses in its attacks on Gaza to allow Palestinians in the north to flee south, saying it had taken longer for Prime Minister Benjamin Netanyahu to agree to the pauses than he had hoped. Biden also said had asked for longer pauses that would help facilitate the release of captives. State Department deputy spokesperson Vedant Patel said Palestinians fleeing the north of Gaza should be able to return. Israeli national security minister Itamar Ben-Gvir called the pauses a “particularly serious mistake.” Netanyahu clarified in an interview with Fox News that he does not seek to govern Gaza. Israeli forces also seized Hamas political bureau deputy leader Salah al-Arouri’s home in Bani Zeid al-Sharqiya, turning it in to a Shin Bet facility. Meanwhile, Israeli forces prevented Palestinians from harvesting olives in Duma, Burin, Zabbuba, and Sebastia. More than 120 Palestinians were arrested during late-night raids in Aroura, Rantis, Bethlehem, Hebron, Deir Sammit, and Nablus. In Gaza, 10,477 applications to work in Israel were submitted at the local chamber of commerce in Jabalia refugee camp. Many of the applications were from Palestinian laborers, but the 7,000 available work permits were earmarked for merchants. According to Israeli officials, the decision to earmark the permits for merchants was made at the request of Hamas. A judge at the Jerusalem magistrate’s court ruled that Jewish worshippers are allowed to pray in silence at the Haram al-Sharif compound, drawing condemnation from the PA, Hamas, Turkey, and Jordan. The court also ordered the state to explain why Palestinians have not been allowed to work the land. The Palestinian and Israeli negotiators agree on an open-ended cease-fire deal, which PA Pres. Abbas confirms in a brief televised address. The agreement contains 3 points: Israel will permit humanitarian aid and construction material to enter Gaza; Israel will restore the fishing zone from 3 to 6 naut. mi. away from the shore, and gradually extend it to 12 by the end of 2014; and indirect negotiations will continue within 1 mo. in Cairo to deal with the remaining disputes, including Hamas’s demand for sea and airports in Gaza, and the release of recently rearrested prisoners who were released in the Shalit deal. Additionally, talks between Palestinian officials and Egyptian authorities are scheduled to take place soon with the goal of opening the Rafah crossing permanently. Israeli and Palestinian negotiators return to Cairo and reports appear in the press of a potential breakthrough. Senior Islamic Jihad officials Khalid al-Batsh and Ziad Nakhleh are quoted saying they believe an agreement will be made within hours. Lebanon-based Hamas official Usama Hamdan says “there has been positive and fast progress.” An anonymous Palestinian official says that the Palestinian delegation would accept the new Egyptian proposal that would open the crossings into Gaza for aid and construction material, and defer disputed points to further negotiations to be held in 1 mo. Notably, Egypt requires the Rafah crossing to be negotiated with the Palestinians directly, separate from the indirect negotiations with the Israelis. In closed meetings at the UN headquarters in New York, U.S. diplomats present principles for a UNSC res. that would call for a cease-fire in Gaza and conduct meetings with their German, French, and British counterparts, as well as Jordanians, in the hope of reconciling the 3 different proposals. Following talks between Hamas leader Mishal and PA Pres. Abbas in Doha on 8/21 and 8/22, Hamas publicly agrees to support Abbas’s application to join the ICC. On the diplomatic front, Abbas travels to Cairo for talks with Egyptian pres. Abdel Fattah al-Sisi. After their meeting, Abbas says “my main goal is for the truce talks to resume in Egypt as soon as possible.” In an interview on Egyptian television, Abbas says that he is planning a major diplomatic initiative and that he will present the plan to U.S. Secy. of State John Kerry, who is scheduled to visit the region in the coming days. The plan reportedly includes asking the UN to set a timetable for the Israeli occupation and signing the Rome Statue on behalf of the PA, which would give the ICC jurisdiction over cases relating to the occupation. For its part, the Egyptian Foreign Ministry releases a statement after the Abbas/al-Sisi meeting inviting the Israelis and Palestinians to return to Cairo for further cease-fire negotiations. In the morning in Cairo, Palestinian and Israeli negotiators, as well as Egyptian mediators, conduct talks on a long-term ceasefire agreement, specifically the Israeli demands for Hamas’s disarmament and the Palestinian demands for lifting the blockade. The Egyptian press reports that mediators in Cairo have offered a “final proposal” for a longterm agreement to extend the 5-day cease-fire. The agreement will reportedly end Israel’s military offensive, ease the siege, expand the fishing zone, and increase imports into Gaza. In addition, subsequent talks will deal with other issues such as prisoner swaps and establishing an airport and seaport for Gaza. Islamic Jihad spokesperson Yousef al-Hasayneh says that a truce agreement will be signed with Israel once the 5-day cease-fire ends. At a monthly meeting of the EU Council, the 28 EU FMs issue a statement that “strongly condemns the indiscriminate firing of rockets into Israel by Hamas and militant groups in the Gaza Strip” and also “condemns calls on the civilian population of Gaza to provide themselves as human shields.” Meanwhile, Secy. of State Kerry meets with Egypt’s Pres. al-Sisi in Cairo to discuss Gaza, and afterward, affirms that “there is a framework available to end the violence, and that framework was the Egyptian initiative.” Senior Fatah official al-Ahmad flies in to Cairo to also meet with Kerry. In Israel, UN Secy.-Gen. Ban meets with PM Netanyahu and at a Tel Aviv press conference, Ban condemns the rocket attacks, while the Israeli leader accuses Hamas of committing a “double war crime” of targeting Israeli civilians while using Palestinian civilians as human shields. IDF strikes in the Gaza Strip continue, except in the hours following the govt.’s acceptance of the Egyptian cease-fire, killing 13 Palestinians. The IDF warns 100,000 residents of the al-Zaytun and al-Shuja‘iya neighborhoods to evacuate before morning on 7/16. Palestinians fire more than 120 rockets into Israel, including dozens directed at Tel Aviv, in a barrage claimed jointly by al-Qassam Brigades and al-Quds Brigades. Nr. the Erez crossing, 1 Israeli civilian is killed by a mortar shell while distributing food supplies to IDF soldiers. Israel’s security cabinet votes 6–2 in favor of accepting the Egyptian cease-fire proposal from the previous day, and the IDF stops all strikes for several hours. PM Netanyahu says that if Hamas rejects the initiative, Israel will have “legitimacy” to take further action “to restore quiet.” PA Pres. Abbas, in Cairo for talks with Egyptian pres. al-Sisi, calls for the acceptance of the proposal. However, Hamas rejects the text, describing it as “an initiative of kneeling and submission,” and both the armed Palestinian groups and the IDF continue hostilities. Hamas spokesperson Abu Zuhri says that the group was ignored by Egyptian mediators, with Islamic Jihad official Khalid al-Batsh commenting that “initiatives shouldn’t be proposed through media outlets, but rather through the obvious channels, which are resistance factions and their leaders.” An unnamed senior PLO official says that “the Egyptians coordinated the initiative with Abbas and ignored Gaza,” and thus “Hamas leaders felt humiliated by the fact that the proposal was released without them being consulted about its contents ahead of time.” (AFP, AP, HA, MNA, REU, WAFA 7/15; PCHR 7/16)

In Vienna, reps. of Iran and the P5+1 powers continue their negotiations leading up to the 7/20 deadline for a comprehensive agreement on Iran’s disputed nuclear program. U.S. Secy. of State Kerry says they “have made progress . . . but there’s still more work to do.” Iranian FM Zarif says that Iran wants to “arrive at a solution everyone can be happy about.” The key issues remaining are Iran’s centrifuges and its uranium enrichment capacity over the next 10 years. The IDF strikes targets across the Gaza Strip on the 2d day of OPE, killing 39 Palestinians. Fatal strikes take place in al-Maghazi r.c., Bayt Hanun, Gaza City, Nussayrat r.c. and Bayt Lahiya. Among the dead is an Islamic Jihad commander, killed in a strike on his home in Bayt Hanun along with 5 civilians. Palestinians fire 82 rockets and mortar shells into Israel, with 48 rockets striking Israel and 21 intercepted by Iron Dome batteries. There are no injuries directly caused by projectile fire, but there is some damage to property. Rockets land in and around Dimona, Tel Aviv, Haifa, and Jerusalem. M-75 rockets are fired at Tel Aviv, as well as Nevatim military airport, 44 mi. away from Gaza City. Al-Qassam Brigades, al-Quds Brigades, and Ali Abu Mustafa Brigades (PFLP) all claim responsibility for rocket and mortar fire. Israeli PM Netanyahu says that “we have decided to further intensify the attacks on Hamas and the terror organizations in Gaza” and that “Hamas will pay a heavy price for the firing of rockets at Israeli civilians.” Hamas leader Khalid Mish‘al, in a press conference in Doha, Qatar, says that calm can be achieved through “an immediate halt to the aggression and bombings.” He also reiterates that he does not know who carried out the killing of the 3 Israeli settler teenagers in the West Bank. Meanwhile, PA Pres. Abbas accuses Israel of a “genocide” in Gaza and “a war against the Palestinian people as a whole.” He also describes diplomatic efforts at avoiding further hostilities, saying that Palestinian officials are talking to Egypt’s Pres. al-Sisi and UN Secy.-Gen. Ban. Israeli PM Netanyahu tells his Likud-Yisrael Beitenu faction at the Knesset that the govt. is not on the way to a final-status agreement with the Palestinians, ahead of U.S. Secy. of State Kerry’s on 12/11, his 9th trip to the region since taking office. Netanyahu also reportedly rejects the U.S. Gen. John Allen’s security plan, saying it was important to maintain Israeli forces on the border shared with Jordan. Meanwhile, PLO Secy.-Gen. Yasir ‘Abid Rabbuh also rejects the U.S. security proposals, which he says will lead to a “total failure” of Kerry’s efforts. Separately, PA Minister of Prisoners Issa Qarage says that any delays to the scheduled release of a 3rd group of Palestinian prisoners on 12/29 will be considered a serious blow to the peace process. Israel, Jordan, and the PA sign a watersharing agreement that includes the proposed construction of a desalination plant in Jordan on the Gulf of Aqaba, and a pilot study for a pipeline linking the Red Sea-Dead Sea. Israel also intends to sell more water from the Sea of Galilee to Jordan and to sell water to the PA at reduced rates. The agreement is signed at the World Bank in Washington. The U.S. Senate Foreign Relations Cmte. reaches an agreement on a draft authorization for the use of military force against the Syrian govt., with conditions narrower than those requested by Pres. Obama. The draft sets a 60-day time limit on any U.S. action with a conditional single 30-day extension possible. There is also a provision banning the use of ground forces. Speaking to the cmte., Defense Secy. Chuck Hagel says that the pres.’s national security team is now convinced that taking military action against the Asad regime targets would be the right course of action. Hagel also reveals that Obama approved plans in 1/2013 to give lethal aid to Syrian rebels, the 1st time such a decision has been made public. Meanwhile, pro-Israel Jewish community groups such as the American Israel Public Affairs Cmte. Rami Hamdallah, president of an-Najah University, announces that Pres.
