Israeli finance minister Bezalel Smotrich says, “the Egyptians bear considerable responsibility for October 7.” A spokesperson for the Egyptian Foreign Ministry says Smotrich is trying to divert attention from Israel’s own shortcomings. Foreign Minister Israel Katz and Interior Minister Moshe Arbel say UN special rapporteur on the Palestinian territories Francesca Albanese will be banned from Israel, citing her comments that the “victims of 7/10 were not killed because of their Judaism, but in response to Israel’s oppression.” U.S. representative to the UN Human Rights Council Michele Taylor accuses Albanese of having a “history of using anti-Semitic tropes.” (AJ, HA 2/12; AJ 2/13)

U.S. president Joe Biden meets with Jordanian king Abdullah II at the White House. Biden tells the press that Palestinians in Rafah need to be protected. The UN Security Council meets to discuss the situation in Rafah and an Algerian draft resolution calling for a ceasefire. Stephane Dujarric, spokesperson for the UN secretary-general, says the UN will not play a part in Israel’s plans for evacuation of Rafah, saying “there is no place that is currently safe in Gaza.” ICC chief prosecutor Karim Khan says he is deeply concerned about Israel’s plans in Rafah, adding “[a]ll wars have rules and the laws applicable to armed conflict cannot be interpreted so as to render them hollow or devoid of meaning.” Khan also says Israel has not changed its conduct in Gaza and “those who do not comply with the law should not complain later when my Office takes action pursuant to its mandate.” (AJ, HA, NYT 2/12; AJ, HA 2/13)

The U.S. Senate votes 70-29 to approve a bill which if approved by the House and President Biden would provide $95 billion in military aid to Ukraine, Taiwan, and Israel, including $14 billion to Israel, ban funding of UNRWA, and provide $9.15 billion in humanitarian assistance to civilians in conflict zones, including in Gaza and the West Bank. Biden calls on the House to immediately approve the Senate bill, which he says, “provides Israel with what it needs to protect its people against the terrorist groups like Hamas and Hezbollah and others.” Before voting in favor of the bill, Senator Chris Van Hollen (D-MD) says Israel is committing “textbook” war crimes in Gaza. In the West Bank, Israeli settlers throw stones and tear-gas canisters at cars traveling near Bizarya, causing injuries and damage. Israeli settlers also demolish a Palestinian-owned home, a water well, and agricultural structures and raze farmland in Shaghab Farsa in the Masafer Yatta area. Israeli forces shoot and kill a Palestinian man in Battir. Israeli forces also seize a vehicle in Jenin. Elsewhere, Israeli forces arrest 3 Palestinians in Jericho. In East Jerusalem, Israeli forces shoot and injure a Palestinian child in the Old City, claiming he tried to stab soldiers. The child succumbs to his injuries on 2/12. In Gaza, Israeli forces bomb Rafah, Khan Yunis, and Dayr al-Balah, killing at least 112 people, including at least 25 people in an airstrike on a home in Rafah. Israeli forces block the delivery of oxygen cylinders to al-Amal Hospital, resulting in the deaths of 3 patients. Al Jazeera reports that around 100 bodies are retrieved from Tel al-Hawa and Rimal in Gaza City after Israeli forces withdraw, most are killed with live ammunition. 2 Israeli soldiers are killed in combat. U.S. president Joe Biden speaks to Israeli prime minister Benjamin Netanyahu, discussing Israel’s planned invasion of Rafah. According to the U.S. readout of the conversation, Biden said Israel should not proceed without “a credible and executable plan to ensure the safety of and support for more than one million people sheltering there.” Biden also stress the need to capitalize on the ceasefire negotiations. Netanyahu tells the Israeli cabinet that Israel will remain in control of security in all the lands between the Jordan river and the Mediterranean. Axios reports that Biden pressed Netanyahu to agree to release more Palestinian prisoners than in the previous exchange to meet some of Hamas’s demands. Israel’s public defender’s office issues a report based on visits to the Carmel, Damon, and Eshel prisons and the Russian Compound, saying conditions for all prisoners are deteriorating and noting that half of all prisoners have less than 29.5 square feet of space while around 3,400 prisoners are sleeping on mattresses on the floor. The report says that prisoners are experiencing “[i]ntolerable overcrowding; poor sanitary conditions; hygiene problems and infestations; poor ventilations; a lack of basic equipment.” (HA 2/7)

Hamas responds to the Israeli, U.S., Qatari, and Egyptian ceasefire proposal. Hamas official Ghazi Hamad says Hamas is seeking to have as many Palestinian prisoners released as possible.   Hamas also says its response was delayed due to many issues in the proposal being “unclear and ambiguous.” Qatar calls the response “mostly positive.” Israel says it is “thoroughly” evaluating the response. The Israeli military opens an investigation into allegation its forces killed Israelis on 10/7/2023. The military also says that it believes that 32 additional captives out of the 136 remaining captives held in Gaza have been killed. Haaretz reports that the Israeli military has begun investigating dozens of incidents in Gaza that are suspected to have violated international law, including killings of civilians and targeting of hospitals, schools, and government institutions. The New York Times releases an investigation showing Israeli soldiers posting videos on social media of themselves gleefully destroying civilian property. U.S. secretary of state Antony Blinken meets with Qatari prime minister Mohammed bin Abdulrahman bin Jassim Al Thani in Doha, Egyptian president Abdel Fattah el-Sisi in Cairo, and later travels to Israel. At a press conference with Al Thani, Blinken says the U.S. will be promoting steps toward a Palestinian state and Israeli normalization deals after the war in Gaza. The U.S. House of Representatives rejects a standalone bill for $17.6 billion in assistance to Israel, unlike the Senate bill which includes Ukraine, Taiwan, and border funding. President Joe Biden previously said he would veto the House bill. The ICJ elects Ugandan judge Julia Sebutinde as its vice president for a 3-year period. Sebutinde was the only judge on the 17-member panel to vote against all provisional measures in South Africa’s genocide case against Israel in January. The Israeli government extends the Citizenship and Entry into Israel Law for a year, barring Palestinians married to Israelis from obtaining Israeli citizenship. The government also says it plans to hire 65,000 construction workers from India, Sri Lanka, and Uzbekistan to replace the 72,000 Palestinians employed at construction sites before 10/7/2023. Foreign Minister Israel Katz says UNRWA “perpetuates the false narrative of Palestinian ‘refugees’ needing to return to Israel. We are actively working to disengage UNRWA from Gaza.” National Security Minister Itamar Ben-Gvir tells the Wall Street Journal that the Biden administration “is busy giving humanitarian aid and fuel” to Gaza instead “of giving us his full backing.” Ben-Gvir also says he encourages Palestinians in Gaza to “emigrate to places around the world.” The High Court of Justice rejects a petition to recuse Prime Minister Benjamin Netanyahu from office. The U.S. Senate publishes a new proposal for a bill to provide aid to Ukraine, Taiwan, and Israel, earmarking $14.1 billion to Israel and $10 billion in humanitarian aid for civilians in Gaza and the West Bank, stipulating that no funds can go to UNRWA. The House has proposed a standalone bill for Israel to avoid funding Ukraine and Taiwan. UNRWA commissioner-general Philippe Lazzarini tells the Financial Times that Israel has not provided evidence to back its claim that 12 UNRWA staffers were involved in Operation Al-Aqsa Flood. EU high commissioner of foreign affairs Josep Borell calls the suspension of funding for UNRWA “disproportionate and dangerous.” Haaretz reports that Israel’s Bank Luemi has notified UNRWA that it will block the agency’s bank account due to “tangible suspicions it is transferring funds to terror groups in Gaza.” The bank also suspends the account of 1 of the settlers sanctioned by the U.S. on 2/1. The U.S. launched a new patrol mission in the Red Sea to counter Yemeni attacks on commercial ships. The UK, Bahrain, Canada, France, Italy, the Netherlands, Norway, the Seychelles, and Spain joined the U.S.-led mission. A Houthi spokesperson called the mission unnecessary, saying waters around Yemen are safe, except for Israel-linked ships or vessels traveling to Israel. Elsewhere, Israeli forces shot and injured 1 Palestinian girl at the Qalandia crossing, claiming she was carrying a knife. Israeli forces also seized 1 vehicle and vandalized 2 others during a raid in Shaab al-Butum in the Masafer Yatta area. 56 Palestinians were arrested during late-night raids in and around Hebron, Jericho, Jenin, and Bethlehem. In East Jerusalem, Israeli settlers toured the Haram al-Sharif compound. In Gaza, Israeli airstrikes killed 306 Palestinians, including mass casualties in strikes on residential buildings and UNRWA schools in Rafah and Khan Yunis. Israel also killed WAFA journalist Mohammad Abu Hasira and 42 members of his family in an airstrike in Gaza City. 450 people were injured in the Israeli airstrikes. The Red Cross said 5 trucks carrying aid to health facilities in Gaza City came under fire, damaging 2 of the trucks and lightly injuring a driver. The Red Cross did not say who attacked the convoy. At least 40,000 housing units have been destroyed and 220,000 have been damaged in Israeli airstrikes since 10/7. 93 aid trucks entered Gaza. 19 Palestinians, including 12 children suffering from cancer, and around 600 foreign nationals were evacuated to Egypt. The WHO said 160 health care workers have been killed while on duty in Gaza and that in some hospitals operations are performed without anesthesia due to lack of supplies. The Israeli military released a video showing thousands of Palestinians fleeing south from the northern part of Gaza. The UN said that 15,000 people fled from the north to the south today, 5,000 on 11/6, and 2,000 on 11/5. The Israeli human rights organizations ACRI, HaMoked, and Ir Amim petitioned the Israeli High Court of Justice to lift restrictions on Kafr ‘Aqab in East Jerusalem, which has been under a strict closure since 10/7, including being completely shut off from 5 p.m. to the next morning. The U.S. House of Representatives voted 234-188 to censor Palestinian American representative Rashida Tlaib (D-MI) for defending the pro-Palestinian phrase “from the river to the sea.” 22 Democrats joined Republicans in voting to censor Tlaib. Senator Chris Murphy (D-CT) blocked the fast-tracking of a bill that would provide Israel $14 billion in aid and cut the same amount from the budget of the Internal Revenue Service. 2 Israelis were sentenced to 11 and 4.5 years in prison for an attack on a Palestinian man in Jerusalem in 2021 during the Unity Intifada. Noam Elimelech was sentenced for stabbing the man 10 times in addition to punching and kicking him and for attacking a police officer. Naftali Elmakais was sentenced for punching the man after he was on the ground. The 2 Israelis also had to pay the Palestinian man $26,000 in damages. 2 other Israelis are convicted but have yet to be sentenced. (HA 9/14)

The Israeli Ministry of Justice said it managed to reconstruct a deleted video related to the arrest and assault on a Palestinian man in Shu’fat in August who had what appeared to be a Star of David imprinted on his face.
