Israeli finance minister Bezalel Smotrich says Gantz is in the U.S. to advance U.S. plans to establish a Palestinian state. Deputy Assistant to the President and Senior Adviser for Energy and Investment Amos Hochstein meets with Lebanese Parliament speaker Nabih Berri in Beirut, discussing the escalation between Hezbollah and Israel. UNRWA says some of its staff have been forced to give confessions under torture and ill-treatment by Israeli forces. The statement follows an Israeli claim that there are more than 450 Hamas and Islamic Jihad affiliated people working for UNRWA and the release of audio files purporting to be evidence that 2 UNRWA workers confessed to taking part in events on 10/7/2023. UN special representative of the secretary-general on sexual violence in conflict Pramila Patten says during a press conference that a UN investigation team has found that Palestinians in the West Bank are subject to “cruel, inhuman and degrading treatment” in detention and are subject to “disproportionate physical and sexual violence, including sexual harassment and threats of rape during house raids, including at night, and at checkpoints.” Patten also say that the team has “found clear and convincing information that sexual violence, including rape and sexual torture” has been committed against Israeli captives released after being held in Gaza and that there are “reasonable grounds to believe conflict-related sexual violence” occurred on 10/7/2023 in at least 3 locations. Patten says some highly publicized allegations of sexual violence were determined to be unfounded and stresses that the report is not the result of an investigation as Israel did not share any evidence of allegations. Israeli finance minister Bezalel Smotrich says, “the Egyptians bear considerable responsibility for October 7.” A spokesperson for the Egyptian Foreign Ministry says Smotrich is trying to divert attention from Israel’s own shortcomings. Foreign Minister Israel Katz and Interior Minister Moshe Arbel say UN special rapporteur on the Palestinian territories Francesca Albanese will be banned from Israel, citing her comments that the “victims of 7/10 were not killed because of their Judaism, but in response to Israel’s oppression.” U.S. representative to the UN Human Rights Council Michele Taylor accuses Albanese of having a “history of using anti-Semitic tropes.” (AJ, HA 2/12; AJ 2/13)

U.S. president Joe Biden meets with Jordanian king Abdullah II at the White House. Biden tells the press that Palestinians in Rafah need to be protected. The UN Security Council meets to discuss the situation in Rafah and an Algerian draft resolution calling for a ceasefire. Stephane Dujarric, spokesperson for the UN secretary-general, says the UN will not play a part in Israel’s plans for evacuation of Rafah, saying “there is no place that is currently safe in Gaza.” ICC chief prosecutor Karim Khan says he is deeply concerned about Israel’s plans in Rafah, adding “[a]ll wars have rules and the laws applicable to armed conflict cannot be interpreted so as to render them hollow or devoid of meaning.” Khan also says Israel has not changed its conduct in Gaza and “those who do not comply with the law should not complain later when my Office takes action pursuant to its mandate.” (AJ, HA, NYT 2/12; AJ, HA 2/13)

The U.S. Senate votes 70-29 to approve a bill which if approved by the House and President Biden would provide $95 billion in military aid to Ukraine, Taiwan, and Israel, including $14 billion to Israel, ban funding of UNRWA, and provide $9.15 billion in humanitarian assistance to civilians in conflict zones, including in Gaza and the West Bank. Biden calls on the House to immediately approve the Senate bill, which he says, “provides Israel with what it needs to protect its people against the terrorist groups like Hamas and Hezbollah and others.” Before voting in favor of the bill, Senator Chris Van Hollen (D-MD) says Israel is committing “textbook” war crimes in Gaza. The PA foreign ministry said Israel was preventing sufficient aid from entering Gaza, deliberately depriving Palestinians of their basic needs. UNRWA commissioner-general Philippe Lazzarini said Israel was “creating a stream of baseless misinformation” about UNRWA’s responsibility for the lack of aid deliveries to Gaza, saying it is Israel that is impeding aid deliveries. Israeli finance minister Bezalel Smotrich said Israel will not transfer the PA its tax revenue while he is finance minister. It has been reported that U.S. president Joe Biden told Prime Minister Benjamin Netanyahu that Israel should hand over the withheld PA funds to Norway, which will keep them until an arrangement is made to safeguard against the funds going to Hamas, a proposal Netanyahu made himself and that the PA reportedly accepted. South Africa invoked the Genocide Convention calling on the International Court of Justice (ICJ) to expedite hearings on the issue of Israel committing genocide and to order Israel to immediately stop the killing of Palestinians in Gaza. In its report delivered to the ICJ, South Africa described Israel’s actions as “genocidal in character because they are intended to bring about the destruction of a substantial part of the Palestinian national, racial, and ethnical group.” The Israeli Foreign Ministry called the South African action “blood libel.” The PA welcomed the South African action. U.S. secretary of state Antony Blinken approved the sale of M107 155mm projectiles worth $147.5 million to Israel, bypassing congressional approval. It was the second time the Biden administration bypassed congressional approval for weapons transfers to Israel since 10/7. Relatedly, unnamed Israeli officials told Al-Monitor that the U.S. had started to scale down its military support to Israel due to Israel’s failure to discuss its plans for Gaza after the war. Israeli forces also shot and killed 2 Palestinians, including a child, during raids in ‘Azzun and Burin. Elsewhere, Israeli forces shot and injured a Palestinian in Beitunia. Israeli forces also notified a Palestinian landowner that it will seize 2.5 dunams (.62 acres) of his land in Beit Dajan to construct a settler road. Meanwhile, Israeli forces demolished 6 residential structures and 1 agricultural structure in Shaab al-Butum in the Masafer Yatta area, displacing 20 people. 38 Palestinians were arrested during late-night raids in Bethlehem, Ramallah, Qalqilya, and Tubas. In Gaza, Israeli forces attacked Khan Yunis, Gaza City, Nuseirat refugee camp, Jabalia refugee camp, and the Indonesian and Kamal Adwan hospitals, killing at least 80 people. The number of fatalities was likely much higher given the lack of communication with hospitals and civil defense members in northern Gaza. 3 premature babies died at the Kamal Adwan Hospital due to the incubators failing as a result of a lack of fuel. The administration at the Indonesian Hospital said it had been ordered by Israel to evacuate the hospital. 14 ambulances arrived at al-Shifa Hospital to start evacuating the 250 remaining patients. The Red Crescent said 3 paramedics and a companion of a wounded Palestinian were detained by Israeli forces, with 1 of the paramedics being arrested, and that Israel obstructed the evacuation efforts. 190 patients were evacuated from the hospital over a 20-hour period. 2 Israeli soldiers were killed. The bodies were initially seized by Israel at al-Shifa Hospital and in Beit Hanun and handed over to Palestinian authorities prior to arriving in Khan Yunis in a shipping container. About 250 people fled northern Gaza to the south. Israel and Hamas agreed to the terms of a 4-day ceasefire that would see 50 women and children held in Gaza released in exchange for 150 Palestinian women and children being released from Israeli prisons. The start of the ceasefire would be announced within 24 hours, awaiting the Israeli High Court of Justice’s consideration of Israeli public appeals against the deal. The ceasefire could be extended for one additional day for every 10 additional captives released from Gaza. There are about 240 captives held by Hamas and Islamic Jihad. Israel agreed to stop military movement and allow people to travel from the north of Gaza to the south on Salah al-Din road, but said it would not allow movement to the north. 300 trucks carrying aid, including fuel, would be allowed into Gaza every day. Furthermore, Hamas said Israel had agreed to stop drone flights over southern Gaza during the period of the ceasefire and not fly over northern Gaza for 6 hours a day and that Israel could not attack or arrest anyone during the 4-day period. Israel published a list of 300 Palestinian prisoners, including 123 children, that it deemed eligible for release. Most of the prisoners on the list were arrested in the past 2 years for minor offenses. Islamic Jihad said the Israeli soldiers it is holding captive will not be released until all its members are released from Israeli prisons. PA president Mahmoud Abbas welcomed the agreement and thanked Qatar and Egypt for their mediation efforts. Israel claimed to have found a 525-foot-long tunnels underneath al-Shifa Hospital, saying it was used by Hamas. Videos of the tunnels released by Israel showed the tunnels were completely empty, aside from an air-conditioning unit. Former Israeli prime minister Ehud Barak said earlier this week that Israel constructed tunnels under al-Shifa in the 1980s. Amnesty International said Israel had committed war crimes by attacking a church in Gaza City on 10/19 and a residential building in Nuseirat refugee camp on 10/20, which killed 46 civilians, including 20 children. PA president Mahmoud Abbas called on the UN Security Council and the U.S. to quickly intervene to end the Israeli attacks and to end Israel’s expulsion of Palestinians in the West Bank and Gaza. Iranian president Ebrahim Raisi told the joint session that the U.S. bears full responsibility for the Israeli actions in Gaza and called on the groups to designate the Israeli government and military a terrorist organization. It was the first time Raisi visited Saudi Arabia and the first visit by an Iranian president since 2012. Turkish president Recep Tayyip Erdoğan called on the IAEA to investigate Israel’s possession of nuclear weapons and for an international peace conference to solve the overall conflict. Qatari emir Tamim bin Hamad Al Thani said Israel was using humanitarian aid as political blackmail and said the international community had failed in stopping Israeli war crimes. Hamas representative Osama Hamdan criticized the summit for failing to outline concrete steps to stop the Israeli attacks. PA prime minister Mohammad Shtayyeh met with Saudi non-resident ambassador to Palestine and consul general in Jerusalem Nayef al-Sudairi in Ramallah. It was al-Sudairi’s third day of meetings with Palestinian officials in the West Bank. Al-Sudairi also canceled a visit to the Haram al-Sharif compound on the occasion of Mawlid, reportedly after social media calls to prevent the visit in protest over the Saudi-Israeli normalization plans and due to the visit not being coordinated with the Jordanian-run Waqf, making the security a matter for the Israeli police. The U.S. admitted Israel into its Visa Waiver Program, allowing Israelis to enter the U.S. for 90 days without obtaining a visa. On the 2d day of a Middle East security conference in Warsaw, U.S. president Donald Trump’s son-in-law and senior advisor Jared Kushner says that the Trump administration’s long-awaited plan for Palestinian-Israeli peace will require compromises of both sides. “We hear Jordan, Saudi Arabia, and Israel and we understand that there is a chance,” he adds. “They do a better job than me to explain why there is a reason to be optimistic.” Kushner also says that the Trump administration’s plan is not based on the Arab Peace Initiative. “I think it was a great initiative, in 2002 when it was done, but it hasn’t produced peace.” After meeting with Israeli prime minister Benjamin Netanyahu, U.S. secretary of state Mike Pompeo says that “stability in the Middle East” won’t be achieved “without confronting Iran.” Netanyahu’s office later leaks a video recorded during a closed session in Warsaw on 2/13 depicting several Arab foreign ministers downplaying the Palestinian-Israeli conflict in relation to Iran in terms of issues threatening the security of the Middle East. A senior IDF officer says that the IDF recently identified a new Hezbollah observation post built to look like an environmental NGO site along the Israel-Lebanon border. It is the 6th such site the IDF has identified this year. “Hezbollah is building military infrastructure along the border with its men moving there armed when they are watching the Israeli border,” the officer says. “This is military infrastructure in civilian guise.” A UNIFIL spokesperson responds, rejecting Israel’s claim that there are armed forces in border zone. “UNIFIL has not observed any unauthorized armed persons at the locations or found any basis to report a violation of [UNSC] Resolution 1701 but continues to monitor activities closely.”  (HA, JP, TOI 10/22)
