Tulkarm. Israeli courts sentence an Israeli Arab taxi driver to 15 yrs. for driving 2 suicide bombers to Tel Aviv, an East Jerusalem Palestinian to 6 yrs. for providing Palestinian militants with information used to carry out attacks on Israelis. The Israeli Central Elections Comm. decides to follow Atty. Gen. Rubinstein’s 2/19 advice to disqualify Israeli Arab MK Ahmad Tibi (Ta’al) fr. running in 1/03 elections on the grounds that he does not support the Jewish character of the State of Israel, supports armed attacks against it (a charge he denies); turns down a similar request to bar MK `Abd al-Malik Dahamshe and his United Arab List; rules that Herut mbr. Baruch Marzel, the fmr. head of the outlawed Kach movement who placed 2d on Herut’s slate of MK candidates, can participate in the 1/28 elections. The Knesset bans mbrs. of Kach, which advocates the deportation of Arabs fr. Israel and the occupied territories, from holding parliamentary office. The IDF assassinates wanted Hamas mbrs. Shaman Subuh, Mustafa Baqash in Jenin; demolishes 8 Palestinian homes, 3 brick factories, a dairy farm and damages 18 other homes in Rafah; demolishes 1 home, 3 blacksmith shops in Hebron; fires on residential areas of Khan Yunis; bulldozes part of the Silwan Sports Club in East Jerusalem; makes arrest raids in Anabta, Nablus. Israel lifts the curfew on Bethlehem for Christmas, says it will provide free public transportation to any Christian Arabs in Israel or the territories who want to visit the city in the next few days. The Israeli Housing Min. issues tenders to construct 232 new housing units in the ultra-Orthodox West Bank settlement of Emmanuel, even though the settlement is losing residents at the rate of 5% a year. Housing Min. figures show that 1,688 (75%) of the 2,178 tenders for public construction issued between 1/02 and 9/02 were for housing in the territories. Tenders for 28 units in Beitar Ilit, 102 units in Efrat's Givat Hazayit, 76 new units in Ariel, all in the West Bank, were also issued recently. (HA 12/24)

IDF tanks fire shells at 2 Palestinians “moving suspiciously” near Brakha settlement, killing them. The IDF raids a Palestinian radio station in Nablus, confiscating all equipment; demolishes a Palestinian house in Rafah without warning, while its residents are sleeping (6 are injured before they manage to flee); fires on residential areas of Ramallah; raids, demolishes an Islamic charitable society orphanage in Bayt Awla nr. Hebron that houses 300 children under 12. Jewish settlers seize a Palestinian house in East Jerusalem, nr. Jabal Mukabir, claiming they own the structure, which will be the basis of a new enclave. The Israeli High Court rules that the government can banish to Gaza the West Bank relatives of Palestinians accused of staging attacks on Israelis only in "extreme cases" where "that person, by his own deeds, constitutes a danger to the security of the state." The ruling argues that such forced transfer constitutes "assigned residence" under Articles 41 + n43 of the Fourth Geneva Convention, is there for legal under international law. The court thus upholds an 8/12 military court order to expel to Gaza for 2 yrs. the brother, sister of senior AMB mbr. Ali Ajuri (assassinated 8/6/02) for allegedly aiding in the staging of the 7/17/02 Tel Aviv bombing; overrules an order to expel another Palestinian for lending a car, food to his brother, Naseer Assida, without knowing he was (allegedly) plotting the 7/16/02 ambush of a settler bus; Assida has not been captured. Israeli police announce that they have broken up a Hamas cell operating in East Jerusalem that allegedly was responsible for the 7/31/02 Hebrew University bombing; say they have arrested 15 Palestinians in East Jerusalem, Ramallah connected to the cell but only identify 5, 4 whom have Jerusalem ID cards. The IDF shells residential areas of Khan Yunis, sends 20 tanks and bulldozers in to blow up 2 Palestinian homes, damaging 10 others, bulldozing the surrounding area, killing 1 Palestinian, injuring 6; conducts arrest raids in Jenin, detaining 3 Palestinians, blowing up their 3 cars, damaging 4 nearby homes; conducts arrest raids in Hebron, occupying an empty 3-story building as an IDF post. Israeli security denies entry to 52 French peace activists at Ben-Gurion Airport as part of Israel's ongoing effort to halt foreigners fr. making solidarity visits to Palestinians. Israel allows the group to enter after the French government intervenes, reminding Israel that the group was invited by an MK. In East Jerusalem, an IDF soldier on a passing commuter bus shoots, seriously wounds a Palestinian motorcyclist scuffling with an Israeli traffic policeman over a traffic incident. An Israeli dies of injuries received in 7/31 bombing, bring that toll to 9. The IDF demolishes Palestinian homes, 2 belonging to relatives of Palestinian militants (in Dahiriyya, Dura), 2 others (nr. Overriding a military court ruling(see 8/12), the Israeli High Court issues a 15-day injunction against the forced transfer to Gaza of 3 relatives of Palestinian militants, demanding that the government show cause why it would be permitted to carry out the expulsions. Hebron; delays ambulances at checkpoints in the Bethlehem, Hebron, Ramallah areas. A Palestinian suicide bomber detonates a device in a restaurant in Herziliya, killing 1 Israeli, wounding 8. The IDF fatally shoots a 9-yr.-old Palestinian boy when he strays too close to Netzarim settlement; 2 Palestinians in Gaza, who allegedly fired on a Jewish settler vehicle. The AMB fatally shoots 2 collaborators in Hebron. A 7th Palestinian is found dead nr. Erez crossing; the IDF claims a roadside bomb he was planting accidentally exploded. Nr. Hebron, 3 Jewish settlers are wounded when they accidentally trigger an explosive device in a field. A Palestinian stabs, wounds an Israeli policeman in Jerusalem. Israel's air, land, and sea assaults continue, leaving at least 16 Palestinians dead, more than 70 injured. The IDF enters Tulkarm r.c. and Nur al-Shams r.c., meeting fierce resistance. In Tulkarm r.c., IDF fire kills 2 Palestinian ambulance workers, wounds 4 others, plus 10s of Palestinians. IDF soldiers halt an ambulance in Salem, abduct a wounded Palestinian. After a Hamas gunman sneaks into a Atzmona settlement in Gaza and opens fire, killing 5 Jewish settlers and wounding 23 before being shot dead, the IDF sends 10s of tanks and armored personnel carriers (APCs) into Aida, Bethlehem, Dahaysha, 2 neighboring villages, meeting little resistance; soldiers cut electricity, conduct house-to-house searches, occupy numerous homes and schools as observation and staging posts. A PFLP suicide bomber detonates a device in Ariel settlement, lightly injuring 5 settlers; another Palestinian with a large bomb in a backpack is captured, disarmed in a Jerusalem cafe. A Palestinian gunman seriously wounds a Jewish settler nr. Nablus. IDF gunboats shell PA government buildings, political offices, intelligence headquarters, and a PSF compound in Gaza City, injuring 13 PSF officers and leaving only 2 of 25 buildings in the compound standing. Some 150 Israeli intelligence officers, border police, troops seal off the Jabal Mukabir section of East Jerusalem, where they surround the home of human rights activist Khader Shkirat, briefly take him into custody, search his home.
