Israel’s public defender’s office issues a report based on visits to the Carmel, Damon, and Eshel prisons and the Russian Compound, saying conditions for all prisoners are deteriorating and noting that half of all prisoners have less than 29.5 square feet of space while around 3,400 prisoners are sleeping on mattresses on the floor. The report says that prisoners are experiencing “[i]ntolerable overcrowding; poor sanitary conditions; hygiene problems and infestations; poor ventilations; a lack of basic equipment.” (HA 2/7)

Hamas responds to the Israeli, U.S., Qatari, and Egyptian ceasefire proposal. Hamas official Ghazi Hamad says Hamas is seeking to have as many Palestinian prisoners released as possible.   Hamas also says its response was delayed due to many issues in the proposal being “unclear and ambiguous.” Qatar calls the response “mostly positive.” Israel says it is “thoroughly” evaluating the response. The Israeli military opens an investigation into allegation its forces killed Israelis on 10/7/2023. The military also says that it believes that 32 additional captives out of the 136 remaining captives held in Gaza have been killed. Haaretz reports that the Israeli military has begun investigating dozens of incidents in Gaza that are suspected to have violated international law, including killings of civilians and targeting of hospitals, schools, and government institutions. The New York Times releases an investigation showing Israeli soldiers posting videos on social media of themselves gleefully destroying civilian property. Israeli foreign minister Israel Katz meets with the UN envoy for humanitarian aid to Gaza Sigrid Kaag, saying the UN must find a way to bypass UNRWA in delivering aid. (AJ 2/6)

U.S. secretary of state Antony Blinken meets with Qatari prime minister Mohammed bin Abdulrahman bin Jassim Al Thani in Doha, Egyptian president Abdel Fattah el-Sisi in Cairo, and later travels to Israel. At a press conference with Al Thani, Blinken says the U.S. will be promoting steps toward a Palestinian state and Israeli normalization deals after the war in Gaza. The U.S. House of Representatives rejects a standalone bill for $17.6 billion in assistance to Israel, unlike the Senate bill which includes Ukraine, Taiwan, and border funding. President Joe Biden previously said he would veto the House bill. The ICJ elects Ugandan judge Julia Sebutinde as its vice president for a 3-year period. Palestinian officials say the PA will reform itself to comply with U.S. demands by appointing new governors in the West Bank and Gaza, making changes to the personnel of the PA security forces, appointing new staff at the its foreign consulates and embassies and at ministries, improving the financial system, appointing new directors at public institutions, improving tax collection, opening the communications market, and improving government oversight to combat corruption. Axios reports that senior security officials from the PA, Saudi Arabia, Jordan, and Egypt met in Riyadh on the 1/18, discussing plans for Gaza after the war and ways to involve a revitalized PA in Gaza. According to the report, Saudi Arabia, Jordan, and Egypt called on PA general intelligence service director Majed Faraj to ensure that the PA makes serious reforms, including providing more power to a new prime minister. Saudi Arabia is also said to have briefed the other parties on its requirements for normalization with Israel, including practical and irrevocable steps by Israel toward the creation of a Palestinian state. Austria and Romania announce they are suspending funding for UNRWA, becoming the 11th and 12th countries to do so since 1/26. Pakistan calls the suspensions of UNRWA funding “unjustifiable.” 20 human rights organizations, including Oxfam and Save the Children, issue a statement expressing “concern and outrage” over the funding suspensions. U.S. president Joe Biden says in a speech that he is “quietly working with the Israeli government to get them to reduce and significantly get out of Gaza.” Secretary of State Antony Blinken meets with Saudi crown prince Mohammed bin Salman in al-Ula, saying after the meeting that bin Salman has expressed “clear interest” in trying to normalize ties with Israel on the condition that Israel ends its war on Gaza and agrees to take practical steps to establish a Palestinian state. Hamas political leader Ismail Haniyeh arrived in Cairo for talks with Egyptian officials. Hamas official Ghazi Hamad told Al Jazeera that the party had tried to contact Fatah to begin talks about the situation in Gaza now and the future of a unified Palestinian political system, but that PA president Mahmoud Abbas had rejected talks. The Wall Street Journal reported that Hamas’ political bureau was in talks with other Palestinian factions about the situation in Gaza after the Israeli attack. The Journal also reported that Hamas turned down a proposal to exchange a weeklong ceasefire for 40 captives held in Gaza. 39 Palestinians were released from the Ofer Prison as part of the prisoner exchange, including 24 women and 15 children. 33 were released to the Beitunia checkpoint, while 6 were released to East Jerusalem. 13 Israelis, 10 Thai nationals, and 1 Filipino national held captive by Hamas were released to Israel via Egypt. Germany said 4 of the Israelis were also German nationals. The Thai and Filipino captives were released in a separate deal made between Hamas and Thailand, brokered by Iran. The director of the Schneider Children’s Medical center in Israel said the captives the hospital had received were in good physical condition. Hamas published videos of its militants handing over captives to the Red Cross. Hamas political leader Ismail Haniyeh said Hamas was committed to the ceasefire as long as Israel abides by the terms. Head of the Palestinian Prisoners’ Club Qadura Fares said Israel had violated the prisoner exchange terms by releasing 7 people who were arrested within the past year instead of prisoners who had been in prison for longer. The Prisoner’s Club also said Israel had imposed a ban on celebrating the release of Palestinian prisoners, imposing fines of $18,700 for public celebrations. UK foreign secretary David Cameron visited Ramallah, saying the UK has committed an additional $37.8 million in aid to Gaza. Cameron also said that Israel will not have long-term safety and security unless Palestinians have the same, calling settler violence “completely unacceptable” and urging Israel to prosecute the perpetrators. Cameron met with PA president Mahmoud Abbas, who called on the UK to help ensure that Israel will not succeed in separating the West Bank and Gaza or reoccupy it. At a press conference held at the Rafah crossing, Spanish prime minister Pedro Sanchez said that a permanent ceasefire was required and said Spain may unilaterally recognize Palestine even if the EU does not. At the press conference, Belgian prime minister Alexander de Croo said “[w]ay too many people have died. The destruction of Gaza is unacceptable.” Israel subsequently summoned the Spanish and Belgian representatives in Israel for a reprimand, prompting Spain to do the same to the Israeli ambassador to Spain. Later in a meeting with de Croo and Sanchez in Cairo, Egyptian president Abdel Fattah el-Sisi called for the establishment of a demilitarized Palestinian state with UN, Arab, or NATO forces guaranteeing the peace. In the West Bank, Israeli settlers attacked Palestinian herders in Kisan with sticks, injuring 2, including a child. Israel arrested High Follow-Up Committee for Arab Citizens of Israel chairperson Mohammed Barakeh and former MKs Haneen Zoabi, Sami Abou Shehadeh, and Mtanes Shehadeh who were planning to attend a small anti-war protest in Nazareth. Since Israel has banned large anti-war protests, Barakeh said he had told Nazereth police that he and 40 others would rally together, leading to his arrest. Protesters later demonstrated against the arrests of the Palestinian leaders outside of a police station in Tel Aviv; 15 were arrested. Egyptian foreign minister Sameh Shoukry complained that the international community has an “imbalance” in its conscience when it ignores Israeli violations of international law. Separately, PA presidential spokesperson Nabil Abu Rudeineh said Israel’s aim is to kill as many Palestinians as possible, referring to the many killed in the West Bank as Israel attacks Gaza. U.S. president Joe Biden said Israel had agreed to daily 4-hour pauses in its attacks on Gaza to allow Palestinians in the north to flee south, saying it had taken longer for Prime Minister Benjamin Netanyahu to agree to the pauses than he had hoped. Biden also said had asked for longer pauses that would help facilitate the release of captives. State Department deputy spokesperson Vedant Patel said Palestinians fleeing the north of Gaza should be able to return. The UN said that about 70% of Palestinians killed in Gaza are children and women. It is estimated that hundreds are still trapped in rubble. PA president Mahmoud Abbas met with Egyptian president Abdel Fattah al-Sisi and Jordanian king Abdullah II in Cairo. The 3 leaders were said to have been coordinating their stance on Israel for the upcoming UN general assembly meeting in October. President al-Sisi’s spokesperson said after the meeting that al-Sisi emphasized that the creation of a Palestinian state depends of reconciliation between the PA and Hamas. President Abbas called for renewed peace negations under the auspices of the International Quartet for Middle East Peace. An unnamed PA source said, according to Haaretz, that the Biden administration has conveyed to the PA that it will not exert pressure on the Israeli government to engage diplomatically with the PA while Israel is in budget negotiations. The Jewish National Fund (JNF) approved a project that will seek to obtain from Palestinians 530 properties in the West Bank and 2,050 properties in East Jerusalem by reviewing documents only registered by the JNF to see if they can be used to evict Palestinians using Israeli courts. 1 Palestinian-Israeli imam Shaykh Kamal Khatib, the deputy leader of the northern faction of the Islamic Movement in Israel, was charged with incitement to terrorism and identification of a terrorist organization. An Egyptian official said that Egypt had invited Israeli, Hamas, and PA officials to Egypt for separate talks about reinforcing the ceasefire and accelerating the rebuilding of Gaza. A public opinion poll released by the Arab American Institute said that 51% of Americans are for restricting U.S. military aid to Israel. 62% of Democrats supported restricting U.S. military aid to Israel. The UN Human Rights Council passed a resolution to investigate the latest escalation of violence between Israel and Hamas and Israeli attacks on Palestinians in East Jerusalem. 9 countries voted against the resolution, including Austria, Bulgaria, Cameroon, Czech Republic, Germany, Malawi, the Marshall Islands, U.K., and Uruguay. 14 countries abstained. Israel said it would not cooperate with the investigation. Hamas said its actions during the 11 days of violence were “legitimate resistance.” The U.S. said it opposed the investigation. The UN high commissioner for human rights Michelle Bachelet stated that Israeli attacks on Gaza may be war crimes and that rockets fired from Gaza were a violation of international law. 14 Palestinian factions, including Fatah and Hamas, released a joint statement following 2 days of meetings in Cairo confirming the Palestinian elections to be held in May, July, and August. German foreign minister Heiko Maas tweeted that Germany does not agree with the ICC on the issue of the ICC’s territorial jurisdiction in the West Bank, East Jerusalem, and Gaza, saying that the State of Palestine is not recognized in international law. Foreign Minister Maas’s tweet came 1 day after he spoke with Israeli foreign minister Gabi Ashkenazi, who has been reaching out to allies to have them publicly side with Israel in the matter of the ICC investigation. Unlike the U.S. and Israel, Germany is part of the ICC. The EU has said it supports the independence of the ICC. Canada and Australia, also members of the ICC, have also expressed dismay about the territorial jurisdiction ruling. The PA foreign ministry said it regretted that Israel had been successful in convincing Germany, Canada, Australia, Austria, Brazil, and others in opposing the ICC investigation. In an interview with CNN, U.S. secretary of state Antony Blinken said he applauded the normalization deals between Israel, the U.S., the UAE, Bahrain, Morocco, and Sudan, and said that peace between Palestine and Israel is far away, saying the 2 need to engage in peace before the U.S. can get involved. Secretary Blinken also said the Biden administration supported a 2-state solution but when asked about whether a Palestinian state would have East Jerusalem as its capital, he said it was part of final status issues, despite saying the U.S. considers Israel’s capital Jerusalem. Former secretary of state John Kerry said the U.S. supports East Jerusalem as a future capital of Palestine during the Barack Obama administration. Lastly, Secretary Blinken said that the Biden administration would consider supporting the return of the Golan Heights to Syria if Bashar al-Asad was no longer in power. Prime Minister Netanyahu also said on Facebook that “[w]e’re here [in the West Bank] to stay. We’re continuing to build the Land of Israel.” Leader of the Israeli opposition Yair Lapid of the Yesh Atid party called the announcement of the new settlement units “irresponsible,” citing the U.S. presidential transition on 1/20. France’s foreign ministry, the Organisation of Islamic Cooperation, Egypt, Saudi Arabia, and the PA denounced the settlement expansion. PA president Mahmoud Abbas issued 3 presidential decrees, 2 of which critiques say serves to bolster the power of the PA presidency ahead of potential elections later this year. 1 decree allows the PA president to select judges instead of approving judges, who would be selected based on seniority. The decree also allows the president to force Palestinian judges to retire 5 years before the set retirement age of 70. A 2d decree establishes administrative courts, which can hear petitions against officials and institutions, previously a duty of the High Court of Justice. The president of the administrative court is appointed by the PA president. (HA 1/28)

An Israeli court in Lod ruled that screening or distributing the movie Jenin Jenin from 2002 by Mohammad Bakri should be banned and copies of the movie destroyed. Bakri was also ruled to pay $55,000 to an Israeli soldier who appears in archival footage used for the movie and $16,000 for the cost of the trial. The Israeli judge said that Bakri did not do enough research to label the movie a documentary. The PA ministry of culture condemned the ruling. (HA 1/11; AJ, TOI, WAFA 1/12; WAFA 1/13)

Defense Minister Benny Gantz said that he regretted forming a coalition with Prime Minister Netanyahu, saying that Netanyahu “cheated me and cheated you [the Israeli public].” He then called on all opposition leaders, including the Joint Arab List’s Ayman Odeh, to join him in sending “Bibi [Netanyahu] home” in the upcoming election. The foreign ministers of Germany, France, Jordan, and Egypt met in Cairo to discuss reviving peace talks between Israel and Palestine. U.S. billionaire and mega-donor to Benjamin Netanyahu, Donald Trump, and Israeli settlements Sheldon Adelson died. Adelson had recently flown the convicted Israeli spy Jonathan Pollard to Israel from the U.S. so he could immigrate after being released from parole, and he bought the U.S. ambassador’s house in Tel Aviv from the U.S. state department earlier in 2020. A court in Israel rejected a lawsuit brought by 1 Palestinian-Israeli on behalf of his nephew and niece who have to travel outside the city of Carmiel to go to school as there are no Arabic-speaking schools in their city. The suit asked for the city to pay their expenses for traveling to the Arabic-speaking school, but the Israeli court dismissed the suit, citing the Jewish Nation-State Law saying the city’s Jewish character had to be preserved. The judge wrote in his ruling, “Carmiel, a Jewish city, was meant to establish Jewish settlement in the Galilee . . . Establishing an Arabic-language school . . . [and] funding school rides for Arab students . . . could change the demographic balance and damage the city’s character.” (Adalah, HA, HA 11/30)

Saudi Arabia allowed Israeli airlines to fly over their airspace for commercial flights 1 day before the 1st commercial flight between Israel and the UAE was set to happen. The flight was said to be at risk of being canceled; however, according to a U.S. official, U.S. special advisor to the president Jared Kushner and Saudi officials were able to “reconcile the issue.” Special Advisor Kushner is scheduled to visit Saudi Arabia, Kuwait, and Qatar this week. Concluding 2 days of talks in Cairo, representatives of Palestinian factions, including Hamas and Fatah, reaffirm the 10/12 reconciliation agreement (see JPS 47 [2]), emphasize the need for the PA to take control of Gaza, and call for a new round of elections for the PA presidency, the Palestinian Legislative Council, and the Palestinian National Council by the end of 2018. They reportedly tell Egyptian intelligence officials that they would allow the PA to take charge in Gaza and carry out new elections only if all Palestinian factions participated in a follow-up conference to elect a new national government. The Hamas-run energy authority in Gaza announces that it is exploring alternative means of paying for Egyptian fuel transfers, since the PA is blocking Hamas’s fuel payments (see 7/8). PA pres. Abbas meets with Egyptian pres. Abdel Fattah al-Sisi in Cairo to discuss Israeli settlement activity and bilateral relations, including Cairo’s improving ties with Hamas. PA pres. Abbas says that he may take “unprecedented steps” to end the Hamas-Fatah rivalry that prevents the PA from taking control of Gaza. “These days, we are in a dangerous and tough situation that requires decisive steps, and we are [ready] to take these decisive steps. Therefore, we are going to take unprecedented steps in the coming days to end the division,” he says. The Gaza-based Ministry of Interior announces that it will begin accepting applications for jobs in the security forces from female Palestinians. The change in policy marks the first time females will be hired as security forces since 2014. (MNA 4/13)

In Beijing, PA FM al-Maliki calls on China to play a more active role in the Palestinian peace effort, including support for Palestinian initiatives in international forums. China’s FM Wang Yi says that the fact that the Palestinians do not have a sovereign state yet is a “terrible injustice.” (HA, REU, WAFA 4/13)

Human Rights Watch (HRW) calls on the Egyptian govt. to “immediately disclose” whether or not it is detaining the 4 Palestinian men, all reportedly Hamas affiliates from Gaza, who were abducted on 8/19/2015 as they traveled by bus from the Rafah border crossing to Cairo. HRW says that Al Jazeera published a photograph purporting to show 2 of the men in a Cairo facility in 8/2016. The report reads, “incommunicado detention violates basic protections for both civilians and fighters under Egypt’s code of criminal procedure, which requires authorities to bring criminal suspects in front of a prosecutor within 24 hours and prosecutors to charge the detainee based on evidence or release the person immediately. It also violates international law, which requires that all detainees, regardless of their particular status, be brought ‘promptly’ (i.e., within days) before a judicial officer or equivalent to review the legality and necessity of their detention.” (HRW 4/13)

Hebron, according to Palestinian witnesses of the incident. Late at night, 2 Israeli soldiers mistakenly drive into Tulkarm using the GPS navigation app Waze. Residents throw stones at the 2 soldiers, lightly injuring both. The IDF and PASF coordinate their exit from the city. In a joint press conference with Luxembourg’s PM Xavier Bettel, Israeli PM Netanyahu says that the proposed meeting between himself and PA pres. Abbas, which was 1st planned for Cairo and then Moscow in recent weeks, may now happen in Luxembourg: “[Bettel] has invited me to Luxembourg, and he said the Palestinians might also come there; therefore, it’s either Moscow or Luxembourg.” (JP 9/12)

Uncoordinated stabbing and alleged stabbing attacks continue in the West Bank and Jerusalem, resulting in the deaths of 3 Palestinians. Two Palestinians open fire on an Israeli bus in Ramot, causing no damage. Israeli police then chase the shooters into the Old City, where they shoot and kill the 2 men after they allegedly attempt to ram their car into a Jewish Israeli pedestrian, causing no serious injuries. A 3d Palestinian is critically injured in the crossfire. The IDF maintains, for a 2d day, the closure of 1 village each nr. Qalqilya and Salfit. On the outskirts of the village nr. Salfit, Israeli soldiers open fire on 2 Palestinian youths as they approach an IDF checkpoint, killing 1 and critically injuring the other. In response to the string of attacks on 3/8 and after conferring with senior security officials, Israeli PM Netanyahu announces that Israel will complete the construction of the separation wall in the s. Hebron Hills. He also states that his govt. proposes new legislation to deter and punish Palestinians who enter Israel illegally, close Palestinian media outlets responsible for alleged incitement, and deny work permits to the families of Palestinians who commit serious crimes against Israelis. In Cairo, French FM Jean-Marc Ayrault says that France will not recognize the State of Palestine if the planned French peace initiative fails, effectively retracting his predecessor’s 1/29 pledge. “There is never anything automatic,” he says, adding that “France will present its initiative to its partners. Palestinians throw stones at an Israeli settler’s car nr. Jerusalem, then 1 of them stabs the settler when he exits his car, causing moderate injuries. An Israeli settler shoots and seriously injures a Palestinian youth nr. the Gush Etzion settlement bloc nr. Hebron. After the incident, IDF troops conduct raids in a nearby village, sparking clashes with stone-throwers and injuring 7 Palestinians. A Palestinian stabs and moderately injures an Israeli settler outside the Ariel settlement. Other Israeli settlers then attack and stab the Palestinian and, hours later, the IDF raids a nearby village, arresting the injured Palestinian. Across the West Bank, the IDF conducts patrols, late-night raids, and house searches, arresting 17 Palestinians. In East Jerusalem, Israeli forces conduct late-night raids in Issawiyya, accidentally detonating an improvised explosive device; 1 border police officer is injured in the blast. Further exacerbating Palestinian fears over the Judaization of Jerusalem, the Israeli press reports that PM Netanyahu recently proposed at a cabinet meeting the possibility of revoking the residency status of around 80,000 Palestinians in East Jerusalem who live in neighborhoods on the West Bank side of the separation wall, such as Shu‘fat r.c. According to sources present at the meetings, the cabinet did not discuss the proposal, and Netanyahu called for a separate meeting to discuss it further. A group of Palestinians in Israeli prisons cancels its plans, announced on 3/9, to begin a series of demonstrations on 3/10 in protest of the poor conditions. According to Al Jazeera, the move comes after the group makes a preliminary deal with the Israel Prison Service (IPS), allowing for more frequent family visits, but an IPS official will refute the report on 3/11.
