The Washington Post reports that the U.S. has raised allegations of beatings and torture of Palestinian prisoner Marwan Barghouti with Israel. Israel seizes 8,000 dunams (1,976) acres of land in the Jordan Valley for settlement expansion around the Yafit settlement near Fasayil and fast-track planning and construction of settler roads west of Ramallah. The seizure brings the total amount of seized land in the West Bank in 2024 to 10,640 (2,629 acres), more than the last 10 years combined. The PA calls the decision part of an “official policy racing against time to annex the West Bank and eliminate the possibility of creating a Palestinian state.” The Arab League condemns the decision. PA prime minister Mohammed Shtayyeh resigns on behalf of himself and the rest of the cabinet during the weekly cabinet meeting in Ramallah, saying “the next stage and its challenges require new governmental and political arrangements that take into account the new reality in Gaza and the need for a Palestinian-Palestinian consensus based on Palestinian unity.” Shtayyeh says he submitted his resignation to President Mahmoud Abbas on 2/20 but formally submitted his resignation in writing today. Abbas accepts the resignation of Shtayyeh and the rest of the cabinet, asking him and the rest of the ministers to stay on as caretakers until a new government is formed. Shtayyeh, who has been prime minister since March 2019, also cites the genocide in Gaza and the “unprecedent escalation in the West Bank and Jerusalem” as reasons for resigning. The New York Times reports that Israel has agreed to release 15 high-profile Palestinian prisoners in exchange for 5 female Israeli soldiers as part of the potential ceasefire deal. U.S. president Joe Biden says he hopes a ceasefire agreement can be reached by 3/4. Axios reports that Israeli military chief of staff Herzi Halevi and Shin Bet director Ronen Bar traveled to Egypt last week to assure the Egyptian government that Israel will take measures to prevent Palestinians from fleeing to Egypt during its planned invasion of Rafah. A delegation of Israeli officials arrive in Qatar for ceasefire talks. Defense Minister Yoav Gallant says Palestinians will not be allowed to return to northern Gaza until all Israeli captives are released. During the sixth and final day of the ICJ hearings on the legality of the Israeli occupation of Palestinian territories, the Arab League calls the occupation an “affront to international justice” and says Israel perpetrates “racial domination and apartheid” against Palestinians. Turkey, Zambia, Spain, Fiji, the Maldives, the African Union, and the OIC also present arguments. During the 6 days of hearings, only the U.S., Fiji, Hungary, and the UK spoke in favor of Israel’s argument that the court should not make a decision on the occupation while 50 other countries and organizations argued, to varying degrees, that the occupation is illegal and has to end. UN secretary-general Antonio Guterres says the UN Security Council’s “lack of unity on Russia’s invasion of Ukraine, and on Israel’s military operations in Gaza following the horrific terror attacks by Hamas on 7 October, has severely—perhaps fatally—undermined its authority,” calling for reform of the council. Human Rights Watch says Israel has ignored the ICJ provisional measures and “in some ways even intensified its repression, including further blocking lifesaving aid.” Amnesty International also says Israel has failed to comply with the measures. The UN Security Council meets to discuss the situation in Rafah and an Algerian draft resolution calling for a ceasefire. Details of Hamas’s counterproposal to the Israeli, U.S., Qatari, and Egyptian ceasefire proposal are unveiled. The Hamas proposal includes 3 stages of 45 days. In the first stage, Israel and Hamas would exchange the remaining female, child, and elderly Israeli captives for 1,500 Palestinian prisoners, see 500 trucks of aid enter Gaza daily, allow Palestinians to return to their homes in Gaza, allow the entry of 60,000 temporary homes and 200,000 tents, and stop Israeli settlers from entering the Haram al-Sharif compound. In the second stage, male captives would be exchanged for more Palestinian prisoners. In the third phase, the bodies of those killed would be exchanged. The proposal also calls for securing the reconstruction of Gaza and the complete withdrawal of Israeli forces. Hamas political bureau member Mohammad Nazzal says the Hamas proposal has clear deadlines which the original proposal lacked, that Qatar, Egypt, Russia, Turkey, and the UN will be guarantors for maintaining the ceasefire, and that the proposal is final. U.S. secretary of state Antony Blinken meets with PA president Mahmoud Abbas in Ramallah, discussing negotiations for a ceasefire in Gaza, Israel’s withholding of PA tax funds, and settler violence. Blinken also meets with Prime Minister Netanyahu, military Chief of Staff Herzi Halevi, Defense Minister Yoav Gallant, and President Issac Herzog. The Israeli Broadcasting Corporation reports that Netanyahu promises Blinken that Israel will not invade Egypt at the Philadelphi Corridor without coordination with Egypt. Blinken says at a press conference that Hamas will not play a role in the future governance of Gaza, that the death toll in Gaza remains too high, and that Israel should open the Beit Hanun (Erez) crossing to allow more aid to enter Gaza. Blinken also says that the Hamas response to the ceasefire deal has “clear non-starters,” but that he thinks there is space for an agreement to be reached. A UN Security Council resolution calling for ceasefire and the unconditional release of the Hamas-held captives was vetoed by the U.S., with the UK abstaining and the remaining 13 members voting in favor. Before the vote, PA UN envoy Riyad Mansour said the objective of the Israeli campaign was to ethnically cleanse Gaza, adding Israeli representatives were publicly admitting it. U.S. UN ambassador Robert Wood said the Hamas attack on 10/7 was the “worst attack on our people” in decades. After the vote Wood explained the veto, calling the resolution imbalanced for not condemning Hamas’ operation on 10/7. UNRWA commissioner-general Philippe Lazzarini said the constant Israeli bombings have made UNRWA’s ability to operate extremely limited. After the vote, Mansour called the U.S. vote a disaster. In Gaza, all telecommunications were cut off for the second day in a row as Israel’s ground invasion continued overnight. Israeli airstrikes killed at least 377 Palestinians; the death toll could be much higher as the breakdown in telecommunications made delivering news from Gaza extremely difficult. Hamas’ Izzeddin al-Qassam Brigades spokesperson Abu Obaida said the Qassem Brigades would not negotiate the release of captives while Gaza was being bombarded. Earlier in the day Abu Obaida said Qassam Brigades would begin executing 1 Israeli captive each time Israel bombs a civilian target. There was no indication that the threat was carried out as civilian buildings were being bombed by Israel. Hamas official Moussa Abu Marzouk told Al Jazeera that Hamas is open to discussing a truce and all political dialogue. Reuters reported that Qatar was mediating a prisoner exchange that will see Israeli women and children released by Hamas in exchange for the release of 36 Palestinian women and children from Israeli prisons. Egyptian sources also said that Egypt was in close contact with Israel and Hamas to prevent further escalation, calling on Israel to exercise restraint and Hamas to keep the captives in good condition. Israeli defense minister Yoav Gallant said that he had ordered that no power, water, food, or gas enters Gaza, saying “[w]e are fighting human animals and we act accordingly.” His office later said Gallant had ordered the intensity of the Gaza bombings to increase. The Washington Post reported that the U.S. is preparing for a prolonged war in Gaza and is assessing Israeli diplomatic, political, and military needs. The White House briefed members of Congress that Israel will need replenishment for the Iron Dome, ammunition rounds, precision-guided missiles, and small-diameter bombs. Biden said in a briefing that 11 U.S. citizens have been killed by Hamas and that there likely are U.S. captives being held in Gaza. The U.S. also said Iran was complicit in the Hamas attack and warned Iran about getting involved in the fighting. Iran denied any involvement or knowledge. Khalil Awawdeh suspended his over-170-day hunger strike to protest his administrative detention after Israel said it would not extend his administrative detention period beyond 10/2. Haaretz reported that Egyptian security officials had been mediating between Islamic Jihad and Israel to secure Awawdeh’s release and that talks continued for the release of Bassam al-Saadi. Their release was reportedly a demand by Islamic Jihad for agreeing to the ceasefire after Operation Breaking Dawn. Awawdeh is currently hospitalized for treatment related to his hunger strike. Israel’s civil administration told an Israeli court that it demolished the home of a Palestinian family in the West Bank by mistake. The family of 5’s home was demolished in July by Israeli forces despite the family’s pleas that there was a court order protecting their home. The Civil Administration said that the family’s home was thought to be the home of a different Palestinian family, whose home had already been demolished and blamed the mistake on “human error.” (HA 8/10)
